In view of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 the foregoing, therefore, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688\charrsid11037802 issues}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 that Court}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 must resolve are two, namely,
\par }\pard \ltrpar\s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid485688 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 1. Whether the plaintiff\rquote s employment was lawfully terminated? \line 2. The available remedies? \line }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid485688 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 During the hearing of the suit the plaintiff called one witness in support of her c}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 as}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 e, namely, herself (}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688\charrsid11037802 i.e.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 PW1). She briefly testified as follows. That in the early part of 198}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 2}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 s he took up employment with the defendant as a clerk. She worked diligently until the early part of December 1994 when the defendant suspended her from duty on the allegation that she was involved in a bank fraud. She was arrested, interrogated, searched a nd detained by the police. She spent 3 days in a crowded, filthy cell at Kampala Central Police Station. After her release on police bond she continued to report to the police, from time to time. Eventually, the police referred her back to the defendant \rquote s personnel department where the defend}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 ant handed her a letter dated }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688\charrsid485688 1}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid11037802\charrsid485688 8th} {\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid11037802\charrsid11037802 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 September 1995. That letter terminated her service with the defendant, but it gave no reason for the termination. In her opinion the termination of her service was wrongful because it did not follow her terms and conditions of service; and that has greatly inconvenienced her and caused her anguish. \line }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 In its defence the defendant relied on the testimony of Jennifer Magombe (DW1) which was briefly as follows. That at the time the defendant terminated the plaintiffs service she was her supervisor in the clearing department. The nature of their work was, among other things, to receive cheques from the Clearing House which were made in the defendant\rquote s favour and those which the defendant had to pay against. They would then record those cheques, raise the relevant documents (}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688\charrsid11037802 i.e.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 vouchers and schedules) as evidence of the existence of such cheques and finally send the cheques and documents to the defendant\rquote s various branches around the city for a ction. However, before dispatch the plaintiff and her other workmate would record the cheques in the register book and sign the register. On the 2\rquote December 1994, the plaintiff dealt with cheques and the relevant documents (}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688\charrsid11037802 i.e.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 vouchers and schedules) for }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 he}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837\charrsid11037802 defendant\rquote s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 branches which included Bwaise. In the course of that day, Magombe\rquote s te}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 am }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 discovered that there was an anomaly in their wo}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 rk which they could not fully und}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 erstand. There was an apparent imbalance of }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid485688 shs.25.6m/}{ \rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid11037802\charrsid485688 =.}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid11037802\charrsid11037802 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 After cross-checking their w ork and communicating with various people they discovere}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 d that a cheque emanating from }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 the Centenary bank was responsible for the anomaly. That cheque was ostensibly raised against a dormant account at the defendant\rquote s Bwaise branch. The relevant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 documents for the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 cheque had been raised in the defendant\rquote s clearing department and were in existence. However, the mystery surrounding the said cheque was how it had reached the defendant\rquote s Bwaise branch wit}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 hout leaving behind any record.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 The above was a serious in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 mat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 ter because if the anomaly was not detected in time, the amount cited in the bogus cheque would have been paid to the greatest detriment of the defendant. In all this, the plaintiff was the first suspect. When Magombe, therefore, asked her to explain h ow the cheque in question had reached the defendant\rquote s Bwaise branch without leaving behind any record the plaintiff could not explain. Later on, the plaintiff appeared before the Disciplinary Committee. Magombe was present during those proceedings. The pla intiff once again failed to explain why she did not record the cheque in ques}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 tion in the register (Exh. \'93Dl\'94}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 ). In the defendant\rquote s view it was justified in terminating the plaintiff\rquote s service without giving her any notice and benefits which she thought she}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 was entitled to. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 Court has had the opportunity of considering the evidence and submissions on record and it is now in a position to resolve the two issues referred to earlier on. It will do so in }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 the order in which they occur. \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14114768 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 With regard to the first i ssue, the law is that an employer has the right to terminate the service of his employee any time and for any reason or for none, provided that is done in accordance with the law. In essence, that means that no one ought to force an employer to keep an em p loyee he does not want to retain in his service. The employer has, therefore, the right to discontinue such employee at any time for any reason or for none. However, in doing so the employer must follow what he agreed with the employee in the contract of service and in the rules and regulations governing the employment. For example, where the contract of employment provides for termination on notice, either party may terminate it on giving the stipulated notice. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid485688 (}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid11037802\charrsid11037802 See John Okori Otto v UEB Civil Suit No. 472 of 1982 reported in the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid485688 [1981]}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid11037802\charrsid11037802 HCB at}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid14114768 pg}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid11037802\charrsid11037802 }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \ul\insrsid11037802\charrsid14114768 52}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\ul\insrsid11037802\charrsid11037802 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid11037802\charrsid11037802 and Nuwemugizi }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid14114768 v National Water and Sewerage Co}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid11037802\charrsid11037802 rporation Civil Appeal No. 26 of 1993 as per Platt (J. S. C) (as he then was) at page }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\ul\insrsid11037802\charrsid11037802 52. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 With the above in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837 m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 ind, the important questions to answer now are two. What was agreed upon by the parties in the contra}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837 ct of employment in the event of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 termination of service? What do the rules and regulations governing the plaintiff\rquote s employment with the defendant say about termination of service? In paragraph 4 of the plaintiff\rquote s letter of appointment }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid11037802\charrsid14114768 P/C/S1224}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid11037802\charrsid11037802 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 dated 31}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid14114768\charrsid14114768 st}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 March, 1982 termination of servic}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 e was provided for as below, \par }\pard \ltrpar\s15\ql \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid14114768 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 \'93... }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid11037802\charrsid11037802 Should circumstances so require, during and after the probation, period \line appointment may be terminated by either party giving one month\rquote s noti ce in writing to the other or salary in lieu of notice. If however, you misconduct yourself in any way, the Bank reserves the right to dismis}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid14114768 s you from service without notic}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid11037802\charrsid11037802 e\'94}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid14114768 \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14114768 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 Clearly, the parties agreed that normal termination would be by one month\rquote s notice or payment of one month\rquote s salary in lieu of such notice. However, in the event of misconduct the defendant had the right to dismiss the plaintiff without notice. In addition to that, the service regulations (i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 e. Uganda Commercial Bank Personnel Policie}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 s Manual - Exh. P10}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 ) had this to say in paragraph}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 8.01 about summary dismissal, \par }\pard \ltrpar\s15\qj \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid14114768 {\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid11037802\charrsid11037802 \'93 Summary dismissal can only be taken when a serious offence is committed. This means that the employee shall leave the service of the Bank immediately without notice...\'94 }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid14114768 \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14114768 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 It is apparent from the defendant \rquote s letter PC/S/224 dated }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid11037802\charrsid14114768 6}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \super\insrsid11037802\charrsid14114768 th}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid11037802\charrsid11037802 }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 December 1994 that when it suspended the plaintiff from work it did so only on the basis of suspicion of her involvement in the fraud in question. Indeed, if the defendant had better evidence, at th at stage, it is most likely that it would have invoked the plaintiff\rquote s letter of appointment and the service regulations to discontinue her service immediately and without notice. However, since it had no such evidence, at hand, it chose to suspend the pla intiff as an interim measure pending police investigations to confirm or to dispel the suspicion. This, of course, was a lawful course of action for the service regulations authorised such sus}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 pension for a specific period. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 Be that as it may, in her evidence the plaintiff testified, among other }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837\charrsid11037802 things that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 the police investigations referred to above finally ended in her favour. For that reason she was not prosecuted for any offence. That evidence was neither challenged nor con}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837 tradicted by the defendant Company th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 erefore takes it that it represents the truth. That means that in the eyes of the law, the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837\charrsid11037802 plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 was innocent of any wrong doing. Accordingly, at that stage, the defendant had only two legal options to exercise in respect of the plaintiff \rquote s emplo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 yment. \par {\listtext\pard\plain\ltrpar \s15 \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 \hich\af0\dbch\af0\loch\f0 (a)\tab}}\pard \ltrpar\s15\ql \fi-360\li720\ri0\sb100\sa240\sbauto1\sl360\slmult1 \widctlpar\wrapdefault\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid14114768 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 it ha}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 d to reinstate her; or \par {\listtext\pard\plain\ltrpar \s15 \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 \hich\af0\dbch\af0\loch\f0 (b)\tab}}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 to discontinue her in the normal way by giving her notice in accordance with her letter of appointment }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837\charrsid11037802 or}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 to pay her one month \rquote s salary in lieu of notice. \line }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114768 \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14114768 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 Indeed the option in (b) entitled her to all her ot}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 her benefits there and then. \line }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 Unfortunately, the defendant did not choose an}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 y of the two legal options above}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 , In its letter }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid11037802\charrsid5123238 EXIPC/S1427}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid11037802\charrsid14114768 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 dated 18}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid11037802\charrsid5123238 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 September 1995 it terminated the plaintiff\rquote s service with immediate effect; and subsequently refused to pay her ent itlements. That course of action was, to say the least, illegal because it was outside the framework of what the parties had agreed upon and the rules and regulations which governed their working relationship. In the circumstances, Court has no choice but to find that the defendant did not terminate the plaintiff\rquote s employment lawfully. The first issue is therefore resolved in favour of the plaintiff. \line }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5123238 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 With regard to the second issue, Court has this to say. Since it has resolved the first issue in favour of the plaintiff it means that her suit has succeeded; and she must obtain the remedies she prayed for. She will therefore obtain the payments which the parties agreed upon during the hearing as some of the amounts that would be due to her in the event of su c cess. That aside, Court will below determine the measure of general damages which the plaintiff is entitled to recover as a result of wrongful termination, defamation among her fellow employees and wrongful detention for 3 days in an over-crowded filthy p o lice cell. In that respect Court is satisfied that the plaintiff suffered mental anguish and inconvenience as a result of the wrongful termination of her employment, defamation among her fellow employees and detention for 3 days in an over-crowded filthy police cell. Taking into account everything, Court is willin}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid924837 g to award her a sum of shs. 8m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5123238 as general damages. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 In addition to the above, the plaintiff prayed for exemplary damages for wrongful detention. Her detention was wrongful not only because it had no valid basis, it was also quite highhanded in that it exceeded the legitimate 48 hours which the Constitution requires the police to detain a pr before taking that person to court: According to the plain}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5123238 tiff\rquote s uncontroverted }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802 evidence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 the police detained her at the Central Police Station (Kampala) for 3 days; and during that period they did not take her to court to answer any criminal charge. Obviously, that conduct breached Article 23(3}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5123238\charrsid11037802 ) (} {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 b) of the Constitution. Consequently, since the defendant (as the complainant) was privy to the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5123238 detention, it must pay shs. 1m/}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 = as exemplary damages in respect thereof. \par }\pard \ltrpar\s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid924837 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11037802\charrsid11037802 All in all, judgment is hereby entered in favour of the plaintiff in the following terms, \line 1.
