Ruling
1. This is an application for bond pending hearing and determination of the murder trial against the Applicant.
2. In opposition to the application for bail, the prosecution caused to be filed an affidavit by the investigating officer one PC Stanley Wachira who deposes that the accused person is charged with very serious offences and faces a custodial sentence and if released on bond there is high likelihood of absconding.
3. That the applicant actively participated in the commission of the offence.
4. That after the commission of the offence the accused went missing only to be arrested on a later date and hence the accused is a flight risk. That these are compelling reasons to deny the accused bond.
5. The court called for a pre-bond report. I have perused the report dated 8th December 2023 and I find that it is favourable for bond placement.
6. The application for bond has merit and it is allowed.
7. The accused may be released on a bond of Kshs. 1 million with one surety of similar amount.
