In it }{\insrsid10954077\charrsid9787878 the }{\insrsid15802672\charrsid9787878 applicant, a registered}{\insrsid10954077\charrsid9787878 }{ \insrsid15802672\charrsid9787878 proprietor of apiece of land }{\insrsid10954077\charrsid9787878 comprised }{\insrsid15802672\charrsid9787878 in a Freehold Register Volume 141 }{\insrsid10954077\charrsid9787878 Folio}{\insrsid15802672\charrsid9787878 2 Block 82 plot 2 }{\insrsid10954077\charrsid9787878 at }{\insrsid15802672\charrsid9787878 Mwenge in Kabarole District, sough}{\insrsid10954077\charrsid9787878 t an order (a) that the Chief }{\insrsid15802672\charrsid9787878 Registrar of Titles furnishes grounds }{\insrsid10954077\charrsid9787878 or}{\insrsid15802672\charrsid9787878 }{\insrsid10954077\charrsid9787878 substantiates}{\insrsid15802672\charrsid9787878 the grounds for refusing the applican}{ \insrsid10954077\charrsid9787878 t\rquote s application to have his re-}{\insrsid15802672\charrsid9787878 entry on his said land noted in. the Register, }{\insrsid10954077\charrsid9787878 \par (b}{\insrsid15802672\charrsid9787878 ) that the chief Registrar of }{\insrsid10954077\charrsid9787878 Titles notes the said re-}{\insrsid15802672\charrsid9787878 entry on the Register without further }{\insrsid10954077\charrsid9787878 delay and \par }{\insrsid15802672\charrsid9787878 (c) that cost of this application be provided for. }{\insrsid10954077\charrsid9787878 \par }{\insrsid15802672\charrsid9787878 The application is grounded }{\insrsid10954077\charrsid9787878 on the fact that the applicant }{\insrsid15802672\charrsid9787878 who is the registered proprietor of the said land comprised in Freehol d Register Volume 141 Folio 2 Block 82 plot 2 }{\insrsid10954077\charrsid9787878 at Mwenge had in 1988 re-}{\insrsid15802672\charrsid9787878 entered upon a Lea}{\insrsid10954077\charrsid9787878 se to one Deryck Vanghan Broad }{ \insrsid15802672\charrsid9787878 head William }{\insrsid10954077\charrsid9787878 and to}{\insrsid15802672\charrsid9787878 ok physical possession of the land. That this land was by operation of the law brought under the Management of the DAPCB, }{ \insrsid10954077\charrsid9787878 that}{\insrsid15802672\charrsid9787878 when the applicant applied to the Chief Registrar of Titles to note the said}{\insrsid16403553\charrsid9787878 Re-}{\insrsid15802672\charrsid9787878 entry in the Register, the later refused and subscribed no reasons for the refusal. }{\insrsid16403553\charrsid9787878 \par }{\insrsid15802672\charrsid9787878 The application was }{\insrsid16403553\charrsid9787878 supported by an affidavit which was }{\insrsid15802672\charrsid9787878 sworn on 20/12/9}{\insrsid16403553\charrsid9787878 0}{\insrsid15802672\charrsid9787878 by Sam }{\insrsid16403553\charrsid9787878 Rukuba. \par At the commencement of the heari}{\insrsid15802672\charrsid9787878 ng of th}{\insrsid16403553\charrsid9787878 e application, counsel for the a}{\insrsid15802672\charrsid9787878 pplicant appeared but the Chief Registrar of Titles did not appear. He was otherwise duly served and }{\insrsid16403553\charrsid9787878 there is on the file e}{\insrsid15802672\charrsid9787878 vidence of s}{\insrsid16403553\charrsid9787878 er}{\insrsid15802672\charrsid9787878 vice to }{\insrsid16403553\charrsid9787878 that}{\insrsid15802672\charrsid9787878 effect. }{\insrsid16403553\charrsid9787878 I}{\insrsid15802672\charrsid9787878 nstead he sent a non }{\insrsid15802672\charrsid9787878 advocate}{ \i\insrsid15802672\charrsid9787878 }{\insrsid15802672\charrsid9787878 as a representative with }{\insrsid16403553\charrsid9787878 instruction}{\insrsid15802672\charrsid9787878 to apply for }{\insrsid16403553\charrsid9787878 adjournment of the case.}{ \insrsid15802672\charrsid9787878 The}{\insrsid16403553\charrsid9787878 reason given }{\insrsid15802672\charrsid9787878 for his non- appearance and for the }{\insrsid16403553\charrsid9787878 adjournment sought was that the Chief registrar of Ti}{ \insrsid3213598\charrsid9787878 tles was engag}{\insrsid15802672\charrsid9787878 ed with representatives of the World Bank and t}{\insrsid3213598\charrsid9787878 herefore could not attend court. A}{\insrsid15802672\charrsid9787878 ft}{ \insrsid3213598\charrsid9787878 er hearing counsel for the applicant}{\insrsid15802672\charrsid9787878 , I refused to entertain the }{\insrsid3213598\charrsid9787878 r}{\insrsid15802672\charrsid9787878 equest for adjournment firstly }{ \insrsid3213598\charrsid9787878 because the so-}{\insrsid15802672\charrsid9787878 called representative }{\insrsid15802672\charrsid9787878 wa}{\insrsid3213598\charrsid9787878 s}{\i\insrsid15802672\charrsid9787878 }{\insrsid15802672\charrsid9787878 not an }{\insrsid3213598\charrsid9787878 authorised person}{\insrsid15802672\charrsid9787878 to represent the}{\insrsid3213598\charrsid9787878 Chief Registrar. He was not an}{\insrsid15802672\charrsid9787878 }{\insrsid3213598\charrsid9787878 advocate}{ \insrsid15802672\charrsid9787878 . I was not informed that he w}{\insrsid3213598\charrsid9787878 a}{\insrsid15802672\charrsid9787878 s a }{\insrsid3213598\charrsid9787878 Registrar}{\insrsid15802672\charrsid9787878 . }{\insrsid3213598\charrsid9787878 Secondly}{\insrsid15802672\charrsid9787878 no }{\insrsid3213598\charrsid9787878 sufficient}{\insrsid15802672\charrsid9787878 ground to justify the grant of adjournment was given. B.}{\b\insrsid15802672\charrsid9787878 }{\insrsid15802672\charrsid9787878 Williams as not noted in the Register }{\insrsid3213598\charrsid9787878 of Freehold, there}{\insrsid15802672\charrsid9787878 was a danger, of the land being sold out by the }{\insrsid3213598\charrsid9787878 D}{\insrsid15802672\charrsid9787878 APCB. There is an affidavit in support of this application. This affidavit is not challenged. . }{\insrsid3213598\charrsid9787878 The Chief Registrar of Titles did not file in any affidavit in reply}{\insrsid15802672\charrsid9787878 }{ \insrsid3213598\charrsid9787878 to the supporting affidav}{\insrsid15802672\charrsid9787878 it. Counsel declined }{\insrsid3213598\charrsid9787878 to secure the attendance of the CR}{\insrsid15802672\charrsid9787878 . of Titles to court to }{ \insrsid3213598\charrsid9787878 substantiate}{\insrsid15802672\charrsid9787878 his refusal. }{\insrsid3213598\charrsid9787878 \par Section 190 of t}{\insrsid15802672\charrsid9787878 he }{\insrsid3213598\charrsid9787878 R. T.
