The land tribunal held that the Appellant had not made a prima facie case. He deponed that he was given that portion he was occupying by one, Abdul Kedir who had lived on that land for the 50 years prior to 1996. He had acquired another portion from Christine Namute bi in May 2003. He prayed Court to restrain the Respondent from trespassing on the approximately 128 Sq. Roliat Estate Agency Ltd Misc. Application 81.02}{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 submitted that there was no rule, as was h eld in the above case, that a prima facie case should be established before a court could grant a Temporary Injunction. \par }\pard \s15\ql \li14\ri8\sb624\sl360\slmult1\nowidctlpar\faauto\rin8\lin14\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 He submitted that the Tribunal should not have come to that conclusion without hearing the evidence in the main suit. \par }\pard \s15\qj \li9\ri22\sb638\sl360\slmult1\nowidctlpar\faauto\rin22\lin9\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 He further submi tted that, since the Respondent had averred in her affidavit that she had commenced construction on the suit land the tribunal should have known that a Construction on a contested piece of Land would cause irreparable damage to the Applicant. \par }\pard \s15\ql \li4\ri22\sb633\sl360\slmult1\nowidctlpar\faauto\rin22\lin4\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 He further submitted that the tribunal should have decided the matter on the balance of convenience if it had been in doubt. \par }\pard \s15\qj \li0\ri27\sb676\sl360\slmult1\nowidctlpar\faauto\rin27\lin0\itap0\pararsid11751380 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 Mr. Matovu for the Respondent submitted that since the hearing was by affidavits the Tribunal had clearly evaluated the evidence a nd came to the right conclusion. He contended that the Tribunal had taken into consideration the size of the land under contention and decided that }{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid11751380 129 sq. metres of land could adequately}{ \fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 be compensated for. \par }\pard \s15\qj \li33\ri13\sb633\sl360\slmult1\nowidctlpar\faauto\rin13\lin33\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 Learned Counsel Matovu further argued that wher eas the Respondent had produced a p}{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid11751380 lan for the construction of a bu}{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 ilding on the suit property, the Appellant had not done the same. P Custodian Board (1987) HCB 91. \par }\pard \s15\ql \li9\ri18\sl360\slmult1\nowidctlpar\faauto\rin18\lin9\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 In the instant case there was claim 117/05 pending before the Tribunal. \par }\pard \s15\qj \li0\ri23\sb686\sl360\slmult1\nowidctlpar\faauto\rin23\lin0\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid11751380 \par }{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 In paragraphs 2-6 of his affidavit the Appellant affirmed that he was a cust omary owner or kibanja holder of land situate in Kasenke 111, Naguru, Nakawa Division, Kampala District. He further affirmed that he had two houses in the said kibanja. }{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472 \par }{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid11751380\charrsid16602377 \par }\pard \s15\qj \li24\ri47\sl360\slmult1\nowidctlpar\faauto\rin47\lin24\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 In paragraph 8 he affirmed that when, on 13/8/2003, the Respondent trespassed on 128 sq. metres of his land he lodged a complaint before the Area LC1 Council which after hearing the matter between him and the Respondent ruled in his favour and he erected poles around the contested 128 sq. metres of his land. \par }\pard \s15\qj \li24\ri47\sb638\sl360\slmult1\nowidctlpar\faauto\rin47\lin24\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 On paragraph 10 the Appellant had affirmed that in the process of having two kibanja surveyed, for the purpose of obtaining a certificate of Title, he discovered that part of his customary kibanja, measuring approximately 128 sq metre had been included in the certificate of title of the Respondent, comprised in plot 15 Naguru Avenue, 2E Nyonyintono LRV 3126 Folio 19. \par }\pard \s15\qj \li10\ri0\sb638\sl360\slmult1\nowidctlpar\faauto\rin0\lin10\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 The Tribunal stated the above facts in its ruling and came to the conclusion that } {\b\i\fs28\ul\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 "The Applicant had not shown a prima facie case and since h e has not shown a prima facie case, he has not show that he is in physical possession of the property or that the Respondent is occupying it unlawfully''. \par }\pard \s15\qj \li5\ri47\sb633\sl360\slmult1\nowidctlpar\faauto\rin47\lin5\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 With due respect to the Tri bunal the Appellant/Applicant had affirmed in paragraph 6 of his affidavit that he had two houses on the kibanja of which the 128 sq metres formed apart. \par }\pard \s15\qj \li0\ri47\sb633\sl360\slmult1\nowidctlpar\faauto\rin47\lin0\itap0\pararsid11751380 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 When the Appellant/Applicant filed Claim No. 117/05 there was a Suit pending before the Tribunal and the Appellant had affirmed that he was the owner of the 128 Sq Metres erroneously included in the Respondent's certificate of Title. Since both parties were claiming the same piece of land there were issues which justified the case to be heard on merit.
\par }\pard \s15\qj \li19\ri4\sb676\sl360\slmult1\nowidctlpar\faauto\rin4\lin19\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 T he Appellant had proved by affidavit that he had a prima facie case against the Respondent with a likelihood of success. This is because he had already been buttressed by the ruling of the LC1 Council that the disputed piece of land belonged to him.
\par }\pard \s15\ql \li19\ri28\sb638\sl360\slmult1\nowidctlpar\faauto\rin28\lin19\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 Conse quently I hold that the Tribunal neglected to take into consideration the content of the affidavit affirmed by the Appellant. \par }\pard \s15\qj \li9\ri9\sb590\sl360\slmult1\nowidctlpar\faauto\rin9\lin9\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 Moreover establishing "}{ \fs28\cf1\lang2057\langfe1033\sub\langnp2057\insrsid11751380 a}{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 }{\i\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid11751380 prime facie case\'94}{ \i\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 }{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 does not mean proof beyond reasonable doubt or on the balance of probability. It means that the Applicant has raised triable issues for determination by a cou}{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid11751380 rt of law. Unless otherwise prov}{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 ided for in a legal document, the question of ownership of a contested property cannot be determined by affidavits without evidence provided by both parties in a court of law and each side subjected to cross examination. \par }\pard \s15\ql \li0\ri28\sb638\sl360\slmult1\nowidctlpar\faauto\rin28\lin0\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 One cannot by merely reading affidavits decide that one side has proved its case and the other had not. \par }\pard \s15\ql \li0\ri0\sl360\slmult1\nowidctlpar\faauto\rin0\lin0\itap0\pararsid16602377 {\fs28\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 \sect }\sectd \marglsxn2160\margrsxn1227\margtsxn2270\linex0\sectdefaultcl\sftnbj \pard\plain \s15\ql \li38\ri19\sl360\slmult1\nowidctlpar\faauto\rin19\lin38\itap0\pararsid16602377 \fs24\lang1033\langfe1033\cgrid\langnp1033\langfenp1033 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 By coming to the conclusion cited above, the Tribunal determined the outcome of claim 117/05 without trying the issues in the case. \par }\pard \s15\ql \li47\ri1415\sb638\sl360\slmult1\nowidctlpar\faauto\rin1415\lin47\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 Concerning proof of irrepar}{ \fs28\cf1\lang2057\langfe1033\langnp2057\insrsid11751380 able injury, the Tribunal ruled:- \par }\pard \s15\ql \li47\ri1415\sb638\sl360\slmult1\nowidctlpar\faauto\rin1415\lin47\itap0\pararsid11751380 {\b\i\fs28\ul\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 "In the event that the suit is decided in the Claimant's favou r any construction on the Suit land which measures approximately }{\b\fs28\ul\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 128 }{\b\i\fs28\ul\cf1\lang2057\langfe1033\langnp2057\insrsid11751380 sq}{ \b\i\fs28\ul\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 metres can be adequately compensated for by award of damages" \par }\pard \s15\qj \li14\ri14\sl360\slmult1\nowidctlpar\faauto\rin14\lin14\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 "Irreparable injury" is relative. 128 sq. metre of land appropriate by someone else may cause irreparable injury to anoth er person. To some one who own lots of square miles of land it might be compensatable to another with a small piece of land the compensation; much as it may be may not be satisfactory. One might even say that there is no adequate compensation for the loss of land. \par }\pard \s15\ql \li14\ri38\sb667\sl360\slmult1\nowidctlpar\faauto\rin38\lin14\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\charscalex87\langnp2057\insrsid8945472\charrsid16602377 In E. Dispossession of land owners from their land have led to tragic consequences. \par }\pard \s15\ql \li33\ri47\sb628\sl360\slmult1\nowidctlpar\faauto\rin47\lin33\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 On the balance of convenience the Tribunal ruled:- \par }\pard \s15\ql \fi62\li378\ri1655\sb4\sl360\slmult1\nowidctlpar\faauto\rin1655\lin378\itap0\pararsid16602377 {\i\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 "In view of the Respondents registered interest in the land and the construction taking place therein the amount of inconvenience that she might be put into if the injunction was granted would be greater than any inconvenience the Applicant might suffer, since his only stake in the land is the kibanja interest. The balance of convenience is in favour of the Respondent'~ \par }\pard \s15\qj \li5\ri23\sb585\sl360\slmult1\nowidctlpar\faauto\rin23\lin5\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 In the 1}{ \fs28\cf1\lang2057\langfe1033\super\langnp2057\insrsid8945472\charrsid16602377 st}{\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 place this was an application for a }{ \b\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 TEMPORARY }{\b\fs28\cf1\lang2057\langfe1033\charscalex90\langnp2057\insrsid8945472\charrsid16602377 INJUNCTION. }{ \fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 This means that any inconveniences caused to both parties would be temporary until the main suit would be disposed of. \par }\pard \s15\qj \li0\ri33\sb638\sl360\slmult1\nowidctlpar\faauto\rin33\lin0\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 The tribunal was of the view that a registered interest in the land would be superior to that of a kibanja interest. He deponed that the Respondent's land was acquired after his occupation and that it was adjacent to his own kibanja. On the balance of convenience the person who was on the land before the advent of the Respondent is the one wh o would be inconvenient if he is evicted from the land. \par }\pard \s15\qj \li5\ri61\sb681\sl360\slmult1\nowidctlpar\faauto\rin61\lin5\itap0\pararsid16602377 {\fs28\cf1\lang2057\langfe1033\langnp2057\insrsid8945472\charrsid16602377 The Appellant did not dispute the ownership of the rest of the land, he disputed the inclusion of his 128 sq metres into the Respondent's Certificate of Title. The Respondent should have involved all the neighbours during the survey of her land.
