1. The Applicant is charged with an offence of Burglary Contrary to Section 304(2) and Stealing Contrary to Section 279(b) of the Penal Code. The particulars of the offence are that on the night of 24th day of October 2022 at Boma in Turbo Sub County within Uasin Gishu County jointly broke and entered the dwelling house of Mary Ekeno and stole from therein one television set skyworth 32” one G-stat woofer and one mobile phone sum tap and all valued at Ksh 62,000. The property of the said Mary Ekeno

2. The Applicant after a full trial was found guilty convicted and sentenced as follows:Count 1: 1 sentence the accused to serve twelve months imprisonmentCount 2: 1 sentence the accused to serve twelve months imprisonment

3. This court has read and appreciated the content of the Probation Officer’s Report and the sentence is amenable to review and substituted with a non-custodial sentence of 3 months of performing public works at the Chief’s office at Langas location. The period from the time of preparing the report and release of this order be given as credit to the Applicant by the Probation Officer.
