The court found that the Plaintiffs, as legal administrators of the estate of Mwatu Ngunzi Tama, had established their entitlement to the land parcels in question based on the Minister's final and binding decision in appeal No.756 of 1986. There was no evidence that this decision had been quashed or set aside. The Defendants failed to challenge the Plaintiffs' evidence or file submissions. Accordingly, the Plaintiffs were entitled to a permanent injunction restraining the Defendants from interfering with their use and possession of parcels 390 and 296 within Kaumoni Adjudication section. The court held that the Plaintiffs had proved their case on a balance of probabilities and granted the orders sought.
