Sentence
1. I have considered the pre-sentence review report filed herein on 30. 7.2024 and I note that the same is favourable and recommends placement of the subject on community based order.
2. As earlier stated this court cannot overlook the fact that the subject committed a heinous act to another minor.
3. It is also noteworthy that the subject is currently expectant as she is three months pregnant.
4. In light of the provisions of Sections 225 and 227 of the Children Act 2022 I do hereby issue an order placing the subject on probation for a period of 1 year.
5. The subject’s parents DM and FLM are hereby directed to exercise parental care and responsibility over the subject and ensure that she receives counselling, prenatal care and formal education.
6. The Probation Officer Kakamega is directed to supervise the subject.
7. Upon attainment of 18 years I do direct that the matter be mentioned before the court for confirmation of her status on rehabilitation.
