I have carefully considered the submissions made by Mr. Ochwa advocate for the ex-parte applicant in support of the Amended Chamber Summons dated 13th October 2008.  I have also considered the supplementary affidavit sworn by Asha Mwaro Okumu on 6th October 2008.  I am convinced of the merit of this present application and it is hereby allowed in terms of prayer 1(a), 1(b) (2) & (4) thereof.
