Therefore bringing the application pursuant to order 9 rule 20 of the Civil Procedure }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 Rules was misconceived. However,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 M}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 r. Arthur Mugenyi, learned Counsel for the applicant, realised the misconception and applied for proceeding under S. 101 and order 48. 1 must }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2887768\charrsid15012780 say}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 that the decision which is being sought to be reversed by setting aside the dismissal of the suit was arrived at pursuant to order 15 rule 4 which provides: }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 \par }\pard \ltrpar\s15\qj \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid11339277 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line \'93 (4) Where any party to a suit to whom }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 time has been granted fails to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 produce his evidence, or to cause the at}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 tendance of his witness, or to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 perform any other act necessary to further progress of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 the suit, for }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 which time has been allowed, the court }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid11339277 may}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid7102968\charrsid15012780 , }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 notwithstanding such }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 default, proceed to decide the suit forthwith.\'94 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 \par }\pard \ltrpar\s15\qj \fi900\li-180\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin-180\itap0\ipgp1\pararsid11339277 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line I have to state that in dismissing the appli}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 cation for adjournment and the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 entire suit, I derived solace from the provisions }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 of Rule 4 of Order 15 of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 Civil Procedure Rules, as well as the uncertainty}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 between the plaintiff and his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 Counsel }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 which caused so much vacillation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 and}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 inordinate delay. Needless to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 say, it was in order for the applicant to have brought this applicati}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 on under }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 Order 15 rule 4 and Order 48 of the Civil P}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 rocedure Rules, as it was also }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 nothing unusual }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 to cite S. 101 of the Civil Procedure Rules in his aid. \line Whereas, however, I agree that S. 101 of the Civil Procedure Act vests the judge with very wide inherent discretiona}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 ry powers which are beyond any }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 powers provided by the Rules of procedure, I }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 confess, I am unable to follow }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 the decision of Goudie, Judge in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid7102968\charrsid2887768 Girado -}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid11339277\charrsid2887768 vs - Alarm & Sons, Ltd [1971] }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid7102968\charrsid2887768 448}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 where at page 449 he states:\'93}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 \par }\pard \ltrpar\s15\ql \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid11339277 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 \'93}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 At }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 the same time all the authorities support the view that the court has \line inherent power to restore a suit dismissal for default even if no \line sufficient cause is shown.\'94 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11339277 \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid13922094 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line Surely, some cause must be shown for the court }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 to base its inherent powers to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 restore a suit, otherwise it would be merely }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 a question of some application }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 being made, and without a question the court }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 merely restoring the suit. The inherent powers or }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 discretionary powers }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 of the court must be exercised }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 judicially and that, to me, means that some facts must be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13922094 put before the court }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 for consideration before a decision. \par }\pard \ltrpar\s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid15012780 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14777759 As we revert to the c ase under consideration then what is therefore before me for consideration? The applicant alleges that he personally knew the case was com}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 ing up for hearing on 18/2/99. H}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14777759 e says he wrote to his advocates to say that he had to attend to a relative who had suffered from a stroke and he had to attend to him. The applicant adduces a letter (}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 Annexure}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6245529 \lquote A\rquote ) to the affidavit by which he de}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 pones to in paragraph 2 and 3. T}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6245529 hat letter contravenes Rule 8 of the Commissioner for Oaths (Advocates)}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6245529 Rules (see Cap 53 of the Laws of Uganda \tab which provides that:- \par }\pard \ltrpar\s15\ql \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid10295179 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6245529 \'93 All exhibits to affidavits shall be securely sealed thereto under the seal of the Commissioner (for Oaths) and shall be marked with serial letters of identification.\'94 \par }\pard \ltrpar\s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid15012780 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6245529 Apart from being identified with the serial letter \lquote A\rquote the letter was not securely sealed under the seal }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 of the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6245529 commission. I can therefore not treat it as part of the affidavit because}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 there is always the danger of falsifying such annextures. \par In paragraph 4 of the affidavit, the deponent applicant depones that:- \par }\pard \ltrpar\s15\ql \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid10295179 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 \'93 Sometime early February I developed a serious eye problem, and I was advised by Dr. Margaret Whitehead not to travel to Uganda until I had been treated.\'94 \par }\pard \ltrpar\s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid15012780 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 He states in paragraph 5:- \par }\pard \ltrpar\s15\ql \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid10295179 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10295179 \'93 That I rang my lawyers M/s Mugerwa Matovu &company and informed one of the lawyers, who did not disclose his name to me, of my inability to attend court on 18/2/99.\'94 \par }\pard \ltrpar\s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid15012780 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6245529 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line As Mr. Rugasira observes, the applicant cannot be telling the truth. If he wanted court to believe him he should have produced the written advice of Dr . Margaret Whitehead advising him not to travel to Uganda until his eyes had been treated. Equally, he should have endeavoured to identify that one of the lawyers in the firm of Mugerwa, Matovu & Co. Advocates whom he talked to on telephone telling him of

his inability to attend court on 18/2/99. In any case, if the applicant had told one of the lawyers about his inability to attend court, Mr. Sekatawa would not have beaten about the bush when he was applying for an adjournment of the case to give the appl icant a last chance. Counsel Sekatawa would have straight away conveyed the applicant\rquote s message to court about his inability to attend Court on 18/2/99. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14777759 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line Finally, after listening to Counsel for the defendants\rquote respondents on 18/2/99, particularly, after listening to Mr. Tibesigwa and reading Mr. Philip Karugaba\rquote s letter Ref }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid11350062 . }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid11350062 PK/}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid7102968\charrsid11350062 554/298/97}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid7102968\charrsid15012780 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 dated 17th February 1999, I disbelieved the story that Mr. Karugaba had been held up on a case at the Kasese Court. The reasons why I did not believe the story are not far to find: - }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line In the first place the letter states, and Mr. Tibesigwa }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062\charrsid15012780 confines}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 , that Mr. Karugaba discussed with Mr. Tibesigwa in the morning of 17/2/99. Later on Mr. Karugaba wrote to Mr. Tibesigwa confirming the mornings\rquote telephone discussion. Mr. Sekata wa told the court from the Bar that Mr. Karugaba left for Kasese on 17/2/99 at mid-day. If he was going to attend }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 court in Kasese then he would }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2887768 attend}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 on 18/2/99. In such circumstances then he cannot be said to have been held up at the Kasese Court. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062\charrsid15012780 He}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 would have deliberately }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 left for Kasese with the intention not to attend this court on 18/2/99. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 The question arises why should he have preferred appearance in the Kasese Court. I do not know what Court at Kasese but it must be the Magistrates Court, unle ss it was a Court other than a Court within our system. It was also not made clear whether the court he was attending was a Civil or a Criminal Court, bearing in mind that where a person is confronted with attending two Courts at the same time, he/she sho uld attend the higher one. Why then couldn\rquote t Mr. Karugaba attend this court and a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 sk Mr. Sekatawa to hold his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line brief in the Kasese Court? }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 \line It is for the above reasons that I did not believe the story about Mr. Karugaba having been held up in Kasese. And }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 it was for the reasons I have al}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 ready given, namely, under Order 15 rule four of the Civil Procedure Rules, for the fact also that Counsel was not fully in touch with his client, and the vacillation occasioning inordinate delay rampantly clogging our case sys tem. I am not disposed, for the same reason, to reinstate this suit. One other reason advanced by Mr. Mugenyi for the applicant is the reason often advanced by negligent Counsel. This is that the faults of Counsel should not be visited against his client. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7102968\charrsid15012780 In this case, Mr. Mugenyi shifted the blame against Mr}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11350062 . If they should not be visited on the client of the faulting advocate, then on whom should they be visited? Certainly not on the client of tile advocate who has conducted his clients\rquote case diligently. I think that either the client who engaged the negligent Counsel should suffer the consequences, or his Counsel should. In that case then, why should the client not sue his negligent Counsel to be indemnified? \par In the result I dismiss this application to restore the suit and to allow it to proceed to hearing.
