RULING

The application dated4th September 2013 is made pursuant totheprovisions of Order XLI Rule 4( 1)and section 3AoftheCivil ProcedureAct. Itseeks that court grantsorders ofstay ofexecution of theorders dated 26/10/2009 which read thus:-

"1. THAT,the Applicant’ssummonsfor Revocation ofthe Grant beand is hereby disallowed and that the Grant berectified to the effect that the 2ndrespondent beand is hereby awarded 5 acres ofL.R.NYANDARUA/SOUTH KINANGOP/7 while the applicant gets the remainder thereof.

2. THAT thecostsoftheproceedings tothe respondents."

Theapplicant isaggrieved bytheorders onground that the2ndrespondent (DANSONMWAURA MWANGI)never exhibitedtothecourt,thatthe1strespondent (MARGARETGAKENIANDERITU)was dead.He fears that therespondents are at theverge of executingthe ordersandtheonlylegalavenueistoallowthe application.

In thesupporting affidavit, theapplicant deposes that his family has been residing onthesaid parcel since theyear 1963, occupying 3 acres of thesame, until thetime when therespondentsbegun demarcating the portion ofland in question.Helaments thatthecontested orders of 26/10/2009 ineffect awardedthe2ndrespondent5 acres, resulting inhisloss of some acreage.

The applicant contends that the1st and 2nd respondent hadbought land from the deceased andthesame had already been divided duringthedeceased's lifetime, but upon thedeceased's demise, both parties found out that they had been given less land than they had purchased, and theland had been divided according totheratio they had each purchased.

Further,that, although execution isproceeding, the respondentshavefailedto disclosethat the1st respondent is deceased.

Inopposingtheapplication,the 2ndrespondenthas deposed by wayof a replying affidavit that theapplication isfrivolous andnotmerited,and judgmentwas pronouncedbefore thedeath of the1strespondent.The certificate ofconfirmationofGrantwas alsoextracted before the1st respondent's demise.

Hedescribes theapplication asbeingdesignedto frustrate himfromenjoying thefruits ofthejudgment. Healso laments that the applicant has disobeyed court ordersbyfailingtosigndocumentswhichwouldgive effecttotheorders dated 05/10/2011 issued byOuko J (ashethenwas)whichrequiredtherespondentto demolish thestructure standing onthe2ndrespondent's portion of land.

The applicantdeniesanydisobedience,statingina supplementary affidavit that theTitleDeedissued tothe 2nd respondent is suspect, as it wasissued long after the 1strespondent's death.Inany event, hehas been ailing andhe hasfiledanotice ofappealchallengingthe decision, hence hisreluctance to demolish thestructure whichhedescribes as his home, and where his son's grave stands.

The court directed that the application be disposed of by wayof written submissions, but Ionlyreceived written submissions fromthe2nd respondent's counsel.The submissions gavea background of this matter, which was heard and determined byHon.Justice Mugo.The 2nd respondent's counsel submits that there is no basis for issuance of stay orders orreview of those orders, four yearsafterthey weremade.He draws tothe court's attention thenotice of appealwhich waslodged on1st October 2009 and says noserious attempt has everbeen made topursue that appeal.Counsel points out that the firm of Charles Gai & Co.Advocates which has filedthe notice of appeal arestrangers tothis case, as they never participated intheproceedings. Counsel contends that in any event thefactthat a notice of appeal has been filedisnotgood reason towarrantgrantingstay of execution.The death of the1st respondent isdescribed ashaving noeffectontheorders issued,asallthe transferdocuments had been duly executed.The court is urged to dismiss the application.

Theapplication on theface of itdoes notdisclose what would bepending whilethestay is inforce.Itseems to suggest that applicant is seeking stay pending hearing of applicationfor review. However,in the supporting affidavit, itseems thestay issought ongrounds that the applicant intends toappeal againstthe order, although nomemorandumofappealhasbeenfiled. Ifthe application isforreview,then theapplicant has failed to satisfactorily addressthecourton whatportionofits decision requirestobereviewed.Hehas notdisclosed any newand important matter which mayhave existed at thetimethecourt made theorders,and which even with due diligence hewould not have discovered.

Heappears tosuggest that there isan error ontheface oftherecordregardingthe acreageawardedtothe respondent, yethehas annexed nothing to support that, and itwould appeartomethat iftheerror was inthe trial Judge's understanding/ comprehension ofthe facts, and the final decision, then I donotthinkreview offers the solution. This would be tantamount toa judge of equal jurisdiction sitting onappeal overthedecision of another judge.

This then brings us to the issue of the “pendingappeal" which has nomemorandum annexed.A notice of appeal was filed 4 years ago, and beyond that, the applicant has done absolutely nothing. It would seem hehas content with the statusthenexisting,thataslongasthe respondent didnothing to execute he'd also donothing to purse the appeal.

Ithas notbeenclarified tothis court howthe death of the1strespondent affects theexecutionprocessbeing pursued bythe 2nd respondent. It is also notclear what is “suspect''regarding the 2ndapplicant's titledocument.

Order 42 Rule 6 of the Civil Procedure Rules is clear that an appeal by itself does not operate as a stay.There has to be sufficient cause for such an order to issue and this would require the applicant under Order 41 Rule 6(2)to:-

(a) Demonstrate that hewillsuffer substantialloss, and thatthe application hasbeen made without unreasonable delay.

(b) Security for due performance of the decree.

Theapplicant has moved this court fororders of stay 4 years after the orders wereissued, and noexplanation whatsoever is givenfor this delay. Theonlyreasonable conclusionIcandraw isthat theapplicationismade witha lotofmischief andisintendedtofrustratethe applicantanddeny him, foras long as ispossible, the fruits of the judgment.

Secondly, the applicant says theorder will result inhis family losing "quite some acreage." The issues he finds fault with were considered by the trial judge in her decision. Theloss healleges is notsaid to be irreparable, and although heclaims that thestructures ordered tobe demolished houses hisfamily house and son's grave, this iscontested inthefurtherreplying affidavit ongrounds that the structures were only erected soon after the application forrevocation was filed. Further that the2nd respondent whohas livedontheland for32years has never seen a grave onthe5 acre portion. I take note that the purported deceased's sonis nameless and it is not even specified when hedied, orhowlong the grave has been in existence.

I am not satisfied by the applicant's claims and I reject the same.The application for stay orders is notmerited, and is dismissed with costs to the2nd respondent.
