He classified the injury as harm. PW2, Dr.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6624804\charrsid1142436 Kagyen a medical officer, examined the accused on 23/8/1988 and found him aged 20 years. PW3 Bashir Juma as RCI secretary for Security of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275\charrsid1142436 Bujumbura }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6624804\charrsid1142436 village arrested accused on 26/7/1987 in connection with the present charge of robbery }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 and handed him to Bugangari sub-}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6624804\charrsid1142436 county authority from where PW4 John Kamugisha, Administration Askari transferred the accused to Rukungiri Police Station. \par As I directed the assessors and as both }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 counsels}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6624804\charrsid1142436 agree, t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 here are two principal issues }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6624804\charrsid1142436 to be considered thoroughly in this case in the light of the evidence adduced by the prosecution and the defence. One of the two issues is whether robbery was committed and if so whether it is capital robbery as charged. For her she opened the front door only to find Byanyima who shorn a torch at her ordering her to go back.. She did not explain how at that stage she was able to identify Byanyima. She returned to the bedroom. She was apparently followed by Byanyima. There she found accused. According to her, she recogni}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 sed the accused because Byanyim}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 a who was behind her shone a torch whose light fell upon the whole body of the accused. She recognized him. He was bare chested but wore a pair of shorts. Unfortunately the duration of the lighting on accused was not established. Accused raised a panga to strike her. She put up her right hand to protect h erself. In consequences her fingers were cut. In the bedroom the accused removed Shs, 780,000/}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275\charrsid1142436 = (}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 new currency) from under the pillow. He also removed her disco watch from a tray. The accused ordered }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 her to close the rear door. As}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 the two robbers left she immediately ran to PW6\rquote s home wearing only half slip and reported the robbery naming accused and Byanyima as the robbers . PW6 tied up her wounded fingers by way of first said. In fact she claimed there was a third man armed with a gun that stayed outside her house during the robbery but she never identified him. That man had the gun slung over his shoulder. He threatened to shoot her. PW5 and PW6 went to one Fred watirayo, her brother to whom she reported the robbery. All the three returned to her home and st ayed there overnight. The following day she sent information to her husband. On 29/4/l987, PW7, a brother of accused took a watch to her having recovered it from potato garden of father of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 accused}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 . According to pw7 he did not know whose watch it was. Infact he had f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 irst taken it to his father (pw1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 ) and brothers who said it belonged to none of them.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 They advised him to take it to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 PW5. She accepted it as hers. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 According to PW5, she had earlier in the day seen Byanyima in the home of and the company of the accused. According to her}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 the robbery lasted 3 minutes. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 She subseu}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 q}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 ent1y received medical treatment. Apparently her husband,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 may be}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 in her co}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 mpany, reported the robbery to R}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 ukungiri Police Station. It is not quite clear when reporting was m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 ade because D/AIP Christopher k}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 arweremera (Pw8) who }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 appear}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 s to have received the report muddled up his testimony in court. He gave me the impression that he did very little very casually and rather late by way of investigation. So his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 evidence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 unreliable}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 . I did not know whether the conduct }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 f this witness was due to inexperience, lack of mea}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 ns of transport or the general m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 laise that affects some individu}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 als about wo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 rk. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 The accused gave unsworn evidence and raised an alibi. He claimed that on th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 e ni}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 ght of the robbery he was in bed sick. That he had been sick for some time (for a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 b}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 out a month from 18/4/1987 to 19/5/1987). There after he went to his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 grandmother}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 to attend to his gardens for 6 days. Upon his return he was obliged to visit and at}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 end to his sick maternal }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275\charrsid1142436 Grandmother}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 till 27/7/1987 when he returned. On his way home he was arrested by PW4 in connectio}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 n with this case. Subsequently u}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 uccessful attempts were made to settle the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 matter with PW5\rquote s husband at Bug}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 angari }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275\charrsid1142436 Sub county}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 Headquarters. He claimed that PW\rquote 5 husband caused this case to be planted on him (accused) because the accused had, before the robbery, refuse to sell his land to PW5\rquote s husband. DWI, Desiderio K}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 agyentita, supported the accused gene}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 rally about sickness, the visits and attempts to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 settle the matter. He also supp}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 orted the accused that PW5\rquote s husband wanted to buy land which DWI had earlier }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 given}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 to the accused. As it emerged from DWI\rquote s eviden}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 ce it appears it was DWI who }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 actually wanted to have the land sold. There wer}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 e some contradictions between the s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 tatement of the accused and the evidence of DWI whi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 ch might have affected the valid}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 ity of accused\rquote s alibi. However, the prosecution produced PW7, the brother the accused, who testified on behalf of the prosecution.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 \par On }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 oath }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275\charrsid1142436 PW7}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 stated that the accused was in fact sick and in bed on the day of the robbery. The answer was given casuall}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 y following a question in cross-}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 exanimation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 by defence counsel. This was before the accus}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12143275 ed made his unsworn statement. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 It is the duty of the prosecution to prove the case against the accused beyond reasonable doubt. It was incumbent upon the prosecution to show by evidence that the accused\rquote s alibi was not true. \line Learned defence counsel submitted that the prosecution had not proved the case against the accused beyond reasonable doubt. That the period of 3 minutes available to PW5 and the circumstances obtaining at the time of the robbery could not allow }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 proper }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 identification. He said the alibi had not been proved false. On the other hand, Mr. Kikomeko, the learned Resident State Attorney, submitted hat because of the knowledge of accused by PW5, in the circumstances of this case she identified the accused and, therefore, the alibi has been disproved \line It is true PW5 knew accused very well. In fact I got a favorable impression of the }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12452815\charrsid12463860 way}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12452815\charrsid1142436 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 PW5 gave her }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 testimony; she}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 appeared to me to be an honest witness. However there are }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 aspects}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 in the prosecution case which casts a long looming shadow of doubt on the prosecution case. First PW6 and the brother of PW5 did not make any attempt at all to check at the home of the accused on the night of the robbery. That home is stated to be only 1/2km away. No explanation was offered for this omission. It would be reasonable to assume that even the husband of PW5 who has not testified did not check at the home after PW5 sent a report to him. PW5 claimed that the accused was in hiding. But there is no evidence to show that at least before 8/5/87 any efforts were made to check on accused particularly at his home. }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12463860\charrsid1142436 Furthermore}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 the evidence of Pw7 undoubtedly supports the alibi of the accused. True }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid12452815\charrsid12463860 PW7}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12452815\charrsid1142436 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 is a brother of the accused. But that is all. The pros}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12463860 ecution called him to testify. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 He did testify for the prosecution. }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid12452815\charrsid12463860 In}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12452815\charrsid1142436 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 the process he tore up the prosecution }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12463860\charrsid1142436 case }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 if not perforating it. There is nothing to show that he (PW7) was telling lie}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12463860 s to save his brother\rquote s skin. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12463860\charrsid1142436 His}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 evidence has to be accepted .the story of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 accused is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12463860\charrsid1142436 suspect but}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 that is all }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 he cannot be convicted on suspension.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6959252\charrsid1142436 \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12463860 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 In these circumstances and as I directed the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 assessors the probability that PW }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 5 could have made an honest but mistaken identity of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 accused}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12452815\charrsid1142436 has not been ruled }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10316256\charrsid1142436 out.
