That is some }{\fs24\insrsid12991175\charrsid9008885 divisional }{\fs24\insrsid14434154\charrsid9008885 services }{ \fs24\insrsid9008885\charrsid9008885 are still}{\fs24\insrsid12991175\charrsid9008885 controlled }{\fs24\insrsid9008885\charrsid9008885 from Kampala}{\fs24\insrsid12991175\charrsid9008885 City Council. Among }{\fs24\insrsid9008885\charrsid9008885 such services}{\fs24\insrsid12991175\charrsid9008885 are those of the City Advocate. It is also common knowledge that the Principal Assistant }{\fs24\insrsid9574928\charrsid9008885 T}{\fs24\insrsid12991175\charrsid9008885 own Clerks in charge of the respective City}{\fs24\insrsid9574928\charrsid9008885 Divisions are still centrally c}{\fs24\insrsid12991175\charrsid9008885 ontrolled fr}{\fs24\insrsid9574928\charrsid9008885 o}{\fs24\insrsid12991175\charrsid9008885 m Kampala City Council.}{\fs24\insrsid14434154\charrsid9008885 \par }{\fs24\insrsid12991175\charrsid9008885 \par }{\fs24\insrsid15551812\charrsid9008885 This court is entrusted with a Constitutional duty }{\fs24\insrsid9008885\charrsid9008885 to administer}{\fs24\insrsid15551812\charrsid9008885 justice in conformity with the law and with the values}{ \fs24\insrsid7745128\charrsid9008885 , norms and aspirations }{\fs24\insrsid15551812\charrsid9008885 o}{\fs24\insrsid7745128\charrsid9008885 f}{\fs24\insrsid15551812\charrsid9008885 }{\fs24\insrsid9008885\charrsid9008885 the people}{ \fs24\insrsid15551812\charrsid9008885 . I agree that the requirement for the Statutory Notice is mandatory but considering all that I have pointed out above and for the proper adjudication of this matter}{\fs24\insrsid9008885\charrsid9008885 , I}{ \fs24\insrsid7745128\charrsid9008885 }{\fs24\insrsid15551812\charrsid9008885 find that the 1}{\fs24\super\insrsid15551812\charrsid9008885 st}{\fs24\insrsid15551812\charrsid9008885 defendant must have received the Statutory Notice before reacting to it through }{\fs24\insrsid2907774\charrsid9008885 its Acting City Advocate. In the premises the first objection is overruled.}{\fs24\insrsid12991175\charrsid9008885 \par }{\fs24\insrsid2907774\charrsid9008885 \par Secondly Mr. Mutyaba submitted that the suit against the second defendant, the City }{\fs24\insrsid7016134\charrsid9008885 Council of}{\fs24\insrsid2907774\charrsid9008885 Kampala}{\fs24\insrsid5071653\charrsid9008885 }{ \fs24\insrsid7016134\charrsid9008885 Central}{\fs24\insrsid2907774\charrsid9008885 Division is time barred. This Court in its ruling dated 25}{\fs24\super\insrsid2907774\charrsid9008885 th}{\fs24\insrsid2907774\charrsid9008885 May 2007 in Miscellaneous }{\fs24\insrsid7016134\charrsid9008885 A}{\fs24\insrsid2907774\charrsid9008885 pplication No. 164 of 2007 allowed the plaintiff to add City Council of Kampala Central Division as a defendant to this suit. An }{\fs24\insrsid7016134\charrsid9008885 a}{ \fs24\insrsid2907774\charrsid9008885 mended plaint was accordingly filed on 1}{\fs24\super\insrsid2907774\charrsid9008885 st}{\fs24\insrsid2907774\charrsid9008885 June 2007. Mr. Mutyaba argued that the cause of action ar}{ \fs24\insrsid7016134\charrsid9008885 o}{\fs24\insrsid2907774\charrsid9008885 se in 2003. In paragraph 5 of }{\fs24\insrsid7016134\charrsid9008885 the plaint}{\fs24\insrsid2907774\charrsid9008885 it is alleged that the defendants}{ \fs24\insrsid7016134\charrsid9008885 \rquote }{\fs24\insrsid2907774\charrsid9008885 servants and employees acts complained }{\fs24\insrsid7484477\charrsid9008885 of }{\fs24\insrsid2907774\charrsid9008885 and which gave }{ \fs24\insrsid7016134\charrsid9008885 ri}{\fs24\insrsid4404523\charrsid9008885 se to the cause of action happened on 25}{\fs24\super\insrsid4404523\charrsid9008885 th}{\fs24\insrsid7484477\charrsid9008885 December 2002. T}{ \fs24\insrsid4404523\charrsid9008885 he suit }{\fs24\insrsid7484477\charrsid9008885 against the}{\fs24\insrsid4404523\charrsid9008885 }{\fs24\insrsid7484477\charrsid9008885 2}{\fs24\super\insrsid7484477\charrsid9008885 nd}{ \fs24\insrsid7484477\charrsid9008885 Defendant was commenced by the A}{\fs24\insrsid4404523\charrsid9008885 mended }{\fs24\insrsid7484477\charrsid9008885 P}{\fs24\insrsid4404523\charrsid9008885 laint filed about four and half years later. Incapacity}{\fs24\insrsid10096661\charrsid9008885 in the eyes of the law\emdash \'93}{\fs24\insrsid749060\charrsid9008885 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid9008885 {\fs24\insrsid10096661\charrsid9008885 \par }{\fs24\insrsid4482147\charrsid9008885 a}{\fs24\insrsid10096661\charrsid9008885 nd aware that errors of Coun}{\fs24\insrsid4482147\charrsid9008885 se}{\fs24\insrsid10096661\charrsid9008885 l should not be visited on an innocent party, and having found that the statutory notice of intended suit prepared for the applicant by M/S Nile Chambers Advocates clearly showed that the applicant}{\fs24\insrsid4482147\charrsid9008885 \rquote }{ \fs24\insrsid10096661\charrsid9008885 s intention was to proceed against City Council of Kampala }{\fs24\insrsid4482147\charrsid9008885 Central }{\fs24\insrsid10096661\charrsid9008885 Division but that when the suit was filed by M/S Luba & Co Advocates, it was against City Council of Kampala solely}{\fs24\insrsid4482147\charrsid9008885 ;}{\fs24\insrsid10096661\charrsid9008885 found that applicant had in the eyes of the law been incapacitated by its lawyers who had erroneous file}{\fs24\insrsid4482147\charrsid9008885 d}{\fs24\insrsid10096661\charrsid9008885 the suit leaving out the Division as a defendant yet originally so intended. The so amended plaint was filed on 1}{ \fs24\super\insrsid664559\charrsid9008885 st}{\fs24\insrsid7277741\charrsid9008885 June 2007 thu}{\fs24\insrsid664559\charrsid9008885 s within 12 months from }{\fs24\insrsid15293454\charrsid9008885 the date}{\fs24\insrsid664559\charrsid9008885 when the plaintiff ceased to be under the disability. \par \par However, the disability under section 5 is an exception to the general limitation provisions in section 3 of the Act. To }{\fs24\insrsid3539097\charrsid9008885 determine}{\fs24\insrsid664559\charrsid9008885 whether a suit is time bar Court is required to consider the plaint as it stands to answer the question whether that is so.
