IN THE HIGH COURT OF KENYA AT NAIROBI MISC APPLICATION NO. 23 OF 2003 IN THE MATTER OF VERONICA NJERI NJENGA AND ROBERT NGETHE NJENGA RULING

This is a petition brought under the Mental Health Act. The applicant is the daughter of Veronica Njeri and sister of Robert Ngethe Njenga. Both Veronica Njeri and Robert Ngethe Njenga have been certified as persons suffering from mental illness.

The applicant has filed reports from the Mathari Hospital where by the two patients have been treated and their mental condition has been assessed.

Veronica Njeri the applicant’s mother is said to be suffering from depression and senile dementia while the applicant’s brother is diagnosed with schizoprenia and mental retardation.

According to the applicant’s supporting affidavit both her mother and brother are impaired in their day to day functions andare unable to make decisions, she has therefore sought to be appointed as their legal guardian to manage the properties of Veronica Njeri Njenga.

I have given due consideration to the petitions filed herein and the medical reports regarding the patients mental state. I am satisfied with the material presented with the application that Irene Wangari Njenga should and is hereby appointed as the legal guardian of Veronica Njeri Njenga and Robert Ngethe Njenga for a period of two (2) years from the date hereof.

The applicant is at liberty to apply for an extension if need be.

It is so ordered.
