1. The matter is for mention for parties to confirm compliance of directions issued on 2nd April, 2025 in respect of the Notice of Motion application dated 25th March, 2025 in which the Applicant has sought for:-a.Spent.b.That the Honourable Court be pleased to allow the Applicant institute a Matrimonial Cause of time.c.That this Honourable Court gives any other appropriate orders as it deems fit in the interest of justice.

2. The application is premised on the grounds set out on its face and in the Supporting Affidavit sworn by the Petitioner, Ruth Hayzel Karimi Warui on 27th March, 2025.

3. The application was served upon the Respondents counsel and a Replying Affidavit sworn on 9th April, 2025 in which the Respondent has conceded to the prayers the Applicant has sought.

4. In the circumstances, the Notice of Motion application dated 25th March, 2025 has been compromised by the parties in the following terms:-a.The Applicant be and is hereby granted leave to institute a Matrimonial Cause out of time.b.No orders as to costs.It is so ordered.
