Ruling

1. The Applicant was charged with the offence of stealing stock contrary to section 278 of the Penal Code Cap 63 (Laws of Kenya). He was also charged with the offence of handling stolen property. He was arrested on 3/7/2019 and arraigned in Court when he denied the charges. He was convicted and sentenced to five (5) years on Count II. The same was to run from the date the applicant was remanded i.e. on 5/7/2019. The sentencing was done on 9/4/2021. The earliest date of his release is on 5/11/2022 as per prison. The report by Jackline Mwei Probation Officer that was filed on 7/8/2022 recommends that the applicant be released on community service order on probation orders to be supervised by Nakuru Probation Office. I hereby adopt the recommendation in the said report and direct that the applicant serves the community service order until 5/11/2022. Orders accordingly.
