This was the position even before Francis Kizito died. \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10779339\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10779339\charrsid11544339 The evidence of PW2 and PW4 contradicts the evidence of the plaintiff that the first defendant had not settled on Francis Kizito\rquote s land at Kambe village, Kakiri, by the time of the death of the said Francis Kizito. \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10779339\charrsid11544339 The plaintiff als}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 o gave no plausible explanation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10779339\charrsid11544339 as to why the first defendant was allowed to burry the remains of his child to the ancestral grounds of plaintiff and }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 late }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10779339\charrsid11544339 Francis Kizito, and also of being brother-in-law i.e. Muko, to the daughter of the plaintiff, at her wedding, if he, first defendant, had not been accepted by the deceased, Kizito Francis as his son. All these pieces of evidence }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 lend credence to PW1\rquote s assertion, as a mother of the first defendant, that Kizito Francis was the father of the first defendant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 , and that the said Kizito Francis had accepted this fact}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10779339\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 The plaintiff, through his witness, PW7, Rev. Father Charles Lwanga Ssengendo, attempted t o prove that the Baptismal certificate produced by first defendant showing deceased as his father was a forgery. There was however no evidence that first defendant was responsible for the forgery. At any rate, the overriding consideration is the fact th at deceased died having accepted first defendant as his son and or member of his family. \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 This court therefore holds that on the basis of the evidence before it, the deceased, Kizito Francis, die}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6357313\charrsid11544339 d, having agreed and allowed }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 the first defendant either as his biological son or }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 as a member of his family, o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5439649\charrsid11544339 r}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 otherwise, to settle and li}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6357313\charrsid11544339 v}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 e on part of his land at Kambe village, Kakiri Sub-county, Wakiso District. \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5439649\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 It is also asserted by the plaintiff that the defendants fraudulently obtained the letters of Administration to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 late }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 Francis Kizito\rquote s estate because they stated that one John Kennedy Kizito, a son }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 of the deceased, was stated to be a surviving son of the deceased, when in actual fact, he was already dead. \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 In paragraph }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6357313\charrsid11544339 8 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 of his \'93statement on oath\'94 dated 07. 12.04, the plaintiff states that John Kennedy Kizito died on 01.05.04 and was buried on 03.05.04 at Kambe village, Kakiri, Sub-county. This is contrary to what is stated in annexure \'93C\'94 to the said statement on }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3283697\charrsid11544339 oath, w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 here it is stated that the said John Kennedy Kizito died in the year 2003.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 At any rate, the Court file of Administration Cause No.517 of 2003,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 clearly}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 shows that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076162\charrsid11544339 the defendants informed court that John Kennedy Kizito was dead. This was before Letters of Administration were granted to them. They thus acted truthfully.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 This court on the basis of the contradictory nature of the evidence of the plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6357313\charrsid11544339 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 the fact that the death of John Kennedy Kizito was made known to court}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 by the defendants}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 , is unable to hold that any fraud has been conclusively proved against the defendants. \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 Court observes that the deceased}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 Kizito Francis, died possessed of land and house in Mulago, Kampala }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8223143\charrsid11544339 District,}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11214308\charrsid11544339 and also at Kambe, Kakiri Sub-county, Wakiso District. In the High Court the value of deceased\rquote s estate }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 w as stated to be Shs.3,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6357313\charrsid11544339 000,000/=. Court believes thi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 s estimation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6357313\charrsid11544339 of the value of the deceased\rquote s estate}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 . \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 The value of such properties obviously made the deceased \rquote s estate to be outside the monetary jurisdiction of the Grade II Court. It follows therefore that the grant of Letters of Administration to the plaintiff in respect of Francis Kizito\rquote s estate was made by }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13458221\charrsid11544339 a }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 Court that was not seized of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13458221\charrsid11544339 pecuniary }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 Jurisdiction to do so}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6357313\charrsid11544339 at the material time}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 . Such a grant was a nullity. \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 Court therefore answers the fi rst issue to the effect that the defendants as children}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13458221\charrsid11544339 , and or accepted member of the family of deceased in case of the first defendant, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 of the deceased}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13458221\charrsid11544339 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 are entitled to administer the deceased\rquote s estate. The grant made to the plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13458221\charrsid11544339 by and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9648281\charrsid11544339 in Kakiri }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15030982\charrsid11544339 C ourt Administration Cause Number 003 of 2003 on 07.04.03, was made by a court that was not seized of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13458221\charrsid11544339 pecuniary }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15030982\charrsid11544339 Jurisdiction to do so. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13458221\charrsid11544339 The grant was thus a nullity.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15030982\charrsid11544339 The same is therefore set aside by reason thereof. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7829006\charrsid11544339 The}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15030982\charrsid11544339 grant made by the High Court, in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \b\insrsid15030982\charrsid11544339 Administration Cause Number 517 of 2003}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15030982\charrsid11544339 , is a valid grant and the same shall continue to operate.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3230233\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15030982\charrsid11544339 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5439649\charrsid11544339 \par }\pard \ltrpar\qj \li0\ri0\sl480\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11544339 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15030982\charrsid11544339 The second issue is whether the first defendant is a beneficiary in the estate of the late Francis Kizito or otherwise. \par This Court has already held that, on the evidence adduced, the deceased, Kizito Francis, had already accepted and allowed the first defendant to settle at the land in Kambe, Kakiri Sub-county, Wakiso District.
