R U L I N G

This is an application dated 5th June, 2014.  It seeks to facilitate the execution of a judgment delivered by this court on 10th October, 2013.

I grant prayers 2 and 3 in the application in the following terms:

1. An order is issued ordering the Respondent/Defendant, his heirs, assigns, agents and family members to give vacant possession of the Land Parcel NO.TIMAU/SETTLEMENT SCHEME/1066 situated at Timau to the applicant Zaccheaus Gitonga Turuchiu and in default he be forcibly evicted.

2. It is ordered that the OCS Timau Police Station do facilitate the execution of Order 1 above and more particularly the eviction of the defendant and any one claiming under him.

Costs are awarded to the plaintiff.
