About this statute

If a delivery app company or a company that uses delivery services fails to comply with the law, it may receive a warning and, on recurrence, an administrative fine of R$ 5,000 per infraction. This article defines “empresa de aplicativo de entrega” and “entregador” for purposes of the law. A empresa de aplicativo de entrega deve contratar seguro contra acidentes, sem franquia, em favor do entregador cadastrado, para cobrir acidentes durante a retirada e entrega, inclusive acidentes pessoais, invalidez e morte. A empresa fornecedora do produto ou do serviço deve permitir que o entregador use as instalações sanitárias do estabelecimento e garantir acesso a água potável.
