Statute overview

About this statute

Before a franchise is set up, the franchisor must give the prospective franchisee a Portuguese disclosure document with the required information, and must deliver it at least 10 days before signing or any fee payment, unless the process is a public bidding/pre-qualification. Article 6 is vetoed. Franchise agreements in international cases must be in Portuguese or have a certified Portuguese translation paid by the franchisor; if the contract chooses a forum, the parties must keep a qualified local representative there. This law takes effect 90 days after its official publication. This article says the law must be applied in line with the intellectual property legislation currently in force in the country.
