Statute overview

About this statute

States may need a state solid waste plan to access federal resources, incentives, or financing for waste-management projects and services. This article replaces the wording of article 56, §1º, and states that anyone who abandons certain products/substances, uses them against environmental or safety rules, or handles hazardous waste contrary to law or regulation incurs the same penalties. Reverse logistics for the products covered by items V and VI of article 33 must be implemented gradually under a schedule set by regulation. Nas áreas de disposição final de resíduos ou rejeitos, ficam proibidas certas atividades, incluindo catação, criação de animais domésticos e fixação de habitações temporárias ou permanentes. The persons or legal entities referred to in Article 20 must fully implement and operate the approved solid-waste management plan, and they remain responsible for damage caused by improper waste handling even if they hire outside services.
