Court of Justice (Sexual Assault Awareness Training) Amendment Act, 2022 (Unproclaimed)

COURT OF JUSTICE (SEXUAL ASSAULT AWARENESS TRAINING) AMENDMENT ACT, 2022 Chapter 15 HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Amends RSA 2000 cC-30.5 1 The Court of Justice Act is amended by this Act. 2022 c15 s1;AR 75/2023 2 Section 1 is amended by renumbering clause (a) as clause (a.01) and by adding the following before clause (a.01): (a) “appointment eligibility list” means the list of persons who have been recommended for appointment as a judge through the review process provided for in section 32(a) of the Judicature Act and the process established by the Minister of Justice; 2022 c15 s2;2022 c21 s71 3 Section 9.1(2) is repealed and the following is substituted: (2) No person may be appointed as a judge unless the person (a) is a Canadian citizen, and (b) has completed education in sexual assault law and social context issues. (2.1) Despite subsection (2), a person who is on the appointment eligibility list at the time that this subsection comes into force may be appointed as a judge if the person is a Canadian citizen and undertakes to complete education in sexual assault law and social context issues after being appointed. 4 This Act comes into force on Proclamation.
