PREMIER ’ S COUNCIL ON THE STATUS OF PERSONS WITH DISABILITIES ACT Chapter P‑21 Table of Contents 1 Definition 2 Council 3 Activities and powers 4 Members of Council 5 Staff 6 Bylaws and meetings 7 Annual report 8 Expiry HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: Definition 1 In this Act, “Council” means the Council established under section 2. 1988 cP‑14.5 s1 Council 2 There is hereby established the Premier’s Council on the Status of Persons with Disabilities consisting of the persons appointed under section 4. 1988 cP‑14.5 s2 Activities and powers 3 (1) The Council may (a) advise, report to and make recommendations to the Government on matters relating to the opportunity for full and equal participation of persons with disabilities in the life of the Province; (b) encourage public discussion and engagement and raise awareness through public consultation on all matters relating to the status of persons with disabilities; (c) prepare communication packages containing information respecting disabilities and persons with disabilities; (d) identify and review current and emerging issues and policies at all levels of government affecting and concerning the status of persons with disabilities; (e) review the provision of funding, services and programs to persons with disabilities; (f) make referrals and recommendations to and consult and collaborate with all levels of government, government agencies, volunteer associations, businesses, universities and other persons on matters affecting and concerning the status of persons with disabilities; (g) advise the Government regarding the alignment between policies and strategies affecting persons with disabilities and the principles of the United Nations Convention on the Rights of Persons with Disabilities ; (h) provide input into the development of business plans of Government departments that affect persons with disabilities; (i) advise the Government on reviews and development of policies, programs and initiatives and their implementation with respect to the effect on services to persons with disabilities; (j) in providing advice to the Government, endeavour to identify opportunities that support sustainability of services to persons with disabilities through innovation; (k) provide support with respect to the relationship between the Government and organizations or individuals who provide services to persons with disabilities. (2) The Council shall carry out any activity including or in addition to those referred to in subsection (1) that the Premier considers appropriate. (3) The Council in carrying out its activities under subsection (1) or (2) may (a) receive and hear presentations and suggestions respecting the status of persons with disabilities from individuals and groups, (b) undertake research on matters relevant to the status of persons with disabilities, (c) appoint subcommittees consisting of members and other persons who are not members of the Council, and (d) publish from time to time such reports, studies and recommendations as the Council considers necessary. RSA 2000 cP‑21 s3;2013 c22 s2 Members of Council 4 (1) The Council shall consist of not more than 15 members appointed by the Lieutenant Governor in Council in accordance with the Alberta Public Agencies Governance Act and any applicable regulations under that Act. (1.1) The membership of the Council must include persons with disabilities or individuals who have involvement and experience with disability issues. (2) Not more than 2 of the members of the Council may be members of the Legislative Assembly. (3) The Lieutenant Governor in Council may appoint one of the members to chair the Council. (4) A person appointed to the Council holds office for a term of not more than 3 years as prescribed in the appointment. (5) The members of the Council may be paid (a) remuneration at a reasonable rate prescribed by the Lieutenant Governor in Council in accordance with any applicable regulations under the Alberta Public Agencies Governance Act , and (b) their reasonable travelling, living and other expenses incurred in the course of their duties as members as determined by the Lieutenant Governor in Council in accordance with any applicable regulations under the Alberta Public Agencies Governance Act . (5.1) If regulations under the Alberta Public Agencies Governance Act establish rates in respect of remuneration referred to in subsection (5)(a), those regulations prevail, to the extent of any conflict or inconsistency, over any regulations prescribing a rate under subsection (5)(a). (6) A member of the Council continues to hold office after the expiry of the member’s term of office until (a) reappointed, (b) a successor is appointed, or (c) a period of 3 months has expired, whichever occurs first. (7) A member of the Council is, subject to the Alberta Public Agencies Governance Act and any applicable regulations under that Act, eligible for reappointment. RSA 2000 cP‑21 s4;2009 cA‑31.5 s67;2013 c22 s3 Staff 5 In accordance with the Public Service Act , there may be appointed the employees required to conduct the business of the Council. 1988 cP‑14.5 s5 Bylaws and meetings 6 (1) The Council, with the approval of the Premier, may make bylaws for the conduct of the business and affairs of the Council. (2) The Council shall meet at least 4 times in each fiscal year. (3) A majority of the members appointed constitutes a quorum at a meeting of the Council. 1988 cP‑14.5 s6 Annual report 7 (1) The Council shall, for each fiscal year, submit to the Premier an annual report consisting of a general summary of its activities. (2) On receiving a report under subsection (1), the Premier shall lay a copy of it before the Legislative Assembly if it is then sitting or, if it is not then sitting, within 15 days after the commencement of the next sitting.
