Administrative penalties 2 (1) The following are specified for the purposes of section 72.1 of the Act: (a) a provision of the Food Regulation (AR 31/2006); (b) section 71 of the Act, but only if the person who is obstructed, molested, hindered or interfered with is an executive officer or public health investigator exercising a power under section 59, 60, 60.01 or 60.02 of the Act, as the case may be, in relation to the Food Regulation (AR 31/2006); (c) section 72 of the Act, but only if the notice that is concealed, defaced, destroyed or removed was posted for public information in accordance with an order issued under section 62 of the Act in relation to a contravention of the Food Regulation (AR 31/2006). (2) A public health investigator may not issue a notice of administrative penalty in respect of the same contravention or failure to comply for which a violation ticket has been issued. (3) The amount of an administrative penalty must not exceed (a) $10 000 per contravention or failure to comply, or (b) $1000 for each day or part of a day on which a contravention or failure to comply continues. Collection, use and disclosure of information 3 (1) A public health investigator may collect, use and disclose health information as defined in the Health Information Act and personal information as defined in the Protection of Privacy Act in the course of exercising the public health investigator’s powers and carrying out the public health investigator’s duties under the Act and the regulations. (2) For the purpose of section 61.1 of the Act, a public health investigator may disclose to an executive officer, and an executive officer may disclose to a public health investigator, health information as defined in the Health Information Act and personal information as defined in the Protection of Privacy Act . Expiry 4 For the purpose of ensuring this Regulation is reviewed for ongoing relevancy and necessity with the option that it may be repassed in its present or an amended form following a review, this Regulation expires on January 1, 2032. Coming into force 5 This Regulation comes into force on January 1, 2027.
