"general regulation" means the Apprenticeship and Certification — General Regulation , Manitoba Regulation 154/2001. (« règlement général ») "piping systems" means piping equipment, tubing, fittings, supports and accessories (a) used (i) for processes in industrial, commercial, residential or institutional installations, or (ii) for heating, cooling or humidification in any installation; and (b) that contain or will contain substances, either under pressure or vacuum, including but not limited to (i) chemicals, (ii) petroleum products, including fuel oil, natural gas, liquefied petroleum gas and lubricants, (iii) air or other gases, including medical gas, (iv) water or steam, (v) fluidized solids, (vi) slurry, (vii) hydraulic fluids, (viii) refrigerants, and (ix) cryogenic fluids (liquid gases); but does not include piping equipment, tubing, fittings, supports and accessories used for sprinkler and fixed fire protection systems or for residential central-vacuum systems. (« tuyauterie ») "steamfitter-pipefitter" means a person who lays out, fabricates, assembles, installs, maintains and repairs piping systems by performing the following tasks of the trade to the standard indicated in the current occupational analysis: (a) identifies and selects piping and components; (b) fabricates, lays out, assembles and joins fittings, spools and supports; (c) uses drawings and specifications to determine location of piping and equipment; (d) plans lifts, sets up rigging equipment and hoists loads; (e) installs piping systems; (f) installs piping system equipment, including process equipment, boiler system equipment, refrigeration system equipment, system controls and ancillary devices; (g) tests and commissions systems and completes associated documentation; (h) performs maintenance and repair on piping systems. (« monteur d'appareils de chauffage ») "trade" means the trade of steamfitter-pipefitter. (« métier ») 1(2) The provisions, including the definitions, of the general regulation apply to the trade unless inconsistent with a provision of this regulation. M.R. 159/2020 Interpretation: journeyperson 2(1) A journeyperson in the trade is a person who holds a certificate of qualification in the trade issued under (a) this regulation or a former regulation; or (b) section 23 (certificate through grandparenting) of the general regulation, provided the certificate was issued to the person during the period January 28, 2004 to January 1, 2006. 2(2) In subsection (1), "former regulation" includes the Trade of Steamfitter-Pipefitter Regulation , Manitoba Regulation 13/2004, the Trade of Steamfitter Regulation , Manitoba Regulation 90/87 R, the Steamfitter Trade , Manitoba Regulation 297/74 and the Apprenticeship and Building Construction Regulation , Manitoba Regulation 29/62. Trade is a compulsory certification trade 3 The trade of steamfitter-pipefitter is designated a compulsory certification trade in Manitoba. Limitation on scope of trade 4 Despite section 3, a person is not practising in the trade when he or she performs the following tasks in the course of his or her employment: (a) disconnects or connects piping and hosing assemblies and equipment that is (i) designed to provide temporary or intermittent service and is not intended to be a permanent extension of a piping system, or (ii) attached to a piping system at a coupling point that is designed and dedicated for that purpose; (b) disconnects and reconnects existing pipe joints for cleaning, flushing and routine maintenance purposes; (c) relocates existing tailings piping on a piping system that contains, either under pressure or vacuum, lubricants, air, water, fluidized solids, slurry or hydraulic fluids; (d) performs a task of the trade that he or she is authorized to perform by another enactment. Term of apprenticeship 5 The term of apprenticeship in the trade is four levels, with each level consisting of a period of at least 12 months during which the apprentice must complete 1,800 hours of technical training and practical experience. M.R. 145/2011 ; 159/2020 Minimum wage rates 6(1) Subject to subsection (3), unless otherwise provided in a payment agreement or enactment that is more favourable to the apprentice, the hourly wage rate for an apprentice while undertaking practical experience must not be less than (a) 50% of the reference wage rate during the first level; (b) 60% of the reference wage rate during the second level; (c) 70% of the reference wage rate during the third level; and (d) 80% of the reference wage rate during the fourth level. 6(2) In subsection (1), "reference wage rate" means (a) the applicable minimum wage rate payable to a steamfitter-pipefitter under the Construction Industry Minimum Wage Regulation , Manitoba Regulation 119/2006; or (b) the prevailing wage rate per hour paid to a journeyperson who is employed on the same contract or job as the apprentice, where the wage rate of the journeyperson is not prescribed under The Construction Industry Wages Act . 6(3) For certainty, no apprentice may be paid a wage rate that is less than (a) 110% of the minimum wage during the first level; (b) 120% of the minimum wage during the second level; (c) 130% of the minimum wage during the third level; and (d) 140% of the minimum wage during the fourth level; (e) [repealed] M.R. 159/2020 . M.R. 159/2020 Certification examination 7 The certification examination for the trade consists of a written interprovincial examination. 8 [Repealed] M.R. 24/2009 ; 145/2011 Transition: change in number of levels 8.1(1) On the day that this section comes into force, an apprentice who is enrolled in the first, second or third level of the apprenticeship program for the trade is eligible to obtain a certificate of qualification upon successfully completing (a) the four levels of technical training and practical experience required under section 5; (b) any other relevant criteria under section 21 of the Apprenticeship and Certification — General Regulation . 8.1(2) On the day that this section comes into force, an apprentice who is enrolled in the fourth level of the apprenticeship program for the trade is eligible to write the certification examination upon successfully completing the technical training prescribed for that level. 8.1(3) On the day that this section comes into force, an apprentice who is enrolled in the fifth level of the apprenticeship program for the trade must immediately be issued their certificate of qualification provided that they have (a) successfully completed the four levels of technical training and practical experience required under section 5; (b) attained a satisfactory grade on the certification examination; and (c) fulfilled any other relevant criteria required under section 21 of the Apprenticeship and Certification — General Regulation . 8.1(4) On the day that this section comes into force, an apprentice who is enrolled in the fifth level of the apprenticeship program for the trade has the option to withdraw from that level or to continue in that level. 8.1(5) If an apprentice chooses to continue in the fifth level, the apprentice will be (a) granted advanced standing equivalent to the technical training and practical experience required under clause 4(a) of the Trade of Gasfitter Regulation, Manitoba Regulation 37/2011; and (b) eligible to write the certification examination for the subcomponent trade of domestic gasfitter upon successfully completing that level. M.R. 159/2020 Repeal 9 The Trade of Steamfitter-Pipefitter Regulation , Manitoba Regulation 13/2004, is repealed.
