"Act" means The Public Health Act , C.C.S.M. c. P210, and includes the regulations made under that Act. («  Loi  ») "government agency" , "government department" , "information" and "person" have the same meanings as under section 77 of the Act. (« ministère », « organisme gouvernemental », « personne » et « renseignements ») "health officer (food)" means a health officer described in section 10 of the Public Health Personnel Regulation . (« agent hygiéniste spécialisé en alimentation ») "Indian band" means a band as defined in the Indian Act (Canada). (« bande indienne ») Information sharing: director, medical officer, inspector, public health nurse 2(1) For the purpose of administering or determining compliance with the Act, or a municipal by-law pursuant to an agreement under subsection 21(1) of the Act, a director, medical officer, public health inspector or public health nurse may disclose information to any of the following persons: (a) the chief public health officer; (b) a director, medical officer, public health inspector, public health nurse or health officer; (c) a health professional; (d) a health care body as defined under The Freedom of Information and Protection of Privacy Act ; (e) a person who carries out responsibilities or functions similar to those carried out by any of the persons described in clause (b) for or on behalf of (i) an Indian band, (ii) the Government of Canada or an agency of the Government of Canada, (iii) the government of a province or territory of Canada, or an agency of such a government, (iv) the government of a country or state outside Canada, or an agency of such a government; (f) a government department or government agency; (g) a local government body as defined under The Freedom of Information and Protection of Privacy Act . 2(2) A director, medical officer, public health inspector or public health nurse may also disclose information to any of the following persons: (a) an educational body as defined under The Freedom of Information and Protection of Privacy Act , or the operator of an independent school as defined under The Education Administration Act , if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to the health of students or staff of the educational body or independent school, or to the health of any other person; (b) an employer, if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to the health of the employer's staff or patrons, or to the health of any other person; (c) the operator of a daycare, if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to the health of children cared for in the daycare, their parents or guardians, staff of the daycare, or to the health of any other person; (d) any other person, if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to public health. M.R. 115/2025 Information sharing: health officer (food) 3(1) For the purpose of administering or determining compliance with the Act, or a municipal by-law pursuant to an agreement under subsection 21(1) of the Act, in relation to food, food handling establishments or the transportation of food (a) a health officer (food) has the same authority to disclose information that a public health inspector has under subsection 2(1); and (b) all references to "public health inspector" in subsection 2(1) are deemed to include a health officer (food). 3(2) If a health officer (food) is of the opinion that disclosure of information is necessary to prevent, lessen or deal with a threat to public health that relates to food, a food handling establishment or the transportation of food, (a) the health officer (food) has the same authority to disclose information that a public health inspector has under subsection 2(2); and (b) all references to "public health inspector" in subsection 2(2) are deemed to include a health officer (food). Limit on information disclosed 4 Information disclosed under this regulation must be limited to the minimum amount necessary to accomplish the purpose for which it is disclosed. Coming into force 5 This regulation comes into force on the same day that The Public Health Act , S.M. 2006, c. 14, comes into force.
