"Act" means The Manitoba Public Insurance Corporation Act . ( « Loi  ») "employment" , in respect of determined employment and self-employment, means an occupational classification that is set out in Schedule C. (« emploi ») "employment determined for him or her" means an employment determined for the victim as required by subsections 84(1) or 86(1) or sections 107 or 108 of the Act, and "determined employment" has the same meaning. (« emploi déterminé ») "gross yearly employment income" has the same meaning that "gross income" has in Part 2 of the Act. (« revenu d'emploi annuel brut ») "major occupational group" means an occupational group defined by the National Occupational Classification that is assigned a two character code in the column headed "NOC-S CODE" in (a) Table B of Schedule C; and (b) the Table in Schedule E. (« groupe professionnel principal ») "National Occupational Classification" means the National Occupational Classification established by Statistics Canada, as amended from time to time, and the abbreviation "NOC" has the same meaning. (« Classification nationale des professions ») "NOC-S" means the National Occupational Classification for Statistics established by Statistics Canada and based on the 2001 Canadian census, as amended from time to time, or as replaced by a more recent National Occupational Classification for Statistics, established by Statistics Canada and based on a more recent Canadian census. (« CNP-S ») M.R. 38/2006 GYEI not derived from self-employment 2 Subject to this regulation, a victim's gross yearly employment income not derived from self-employment at the time of the accident is the sum of the following amounts: (a) in the case of a full-time earner, the salary or wages received or receivable for the pay period in which the accident occurred, divided by the number of weeks in the pay period and then multiplied by 52; (b) in the case of a temporary earner or part-time earner, the salary or wages that are received or receivable with respect to employment that the temporary earner or part-time earner held or would have held, if the accident had not occurred, and that are the greater of (i) the salary or wages received or receivable for the pay period in which the accident occurred, divided by the number of weeks in the pay period and then multiplied by 52, and (ii) the salary or wages receivable during the first 180 days following the date of the accident divided by 180 and then multiplied by 365; (c) in the case of a non-earner, the salary or wages from an employment that the non-earner would have held, if the accident had not occurred, during the first 180 days following the date of the accident divided by the number of days the employment would have been held, and then multiplied by 365; (d) any of the following benefits, to the extent that the benefit is not received as a result of the accident (i) a bonus received or earned in the 52 weeks before the date of the accident, (ii) tips, in the amount that is the greater of (A) the amount reported in the victim's personal income tax return for the calendar year before the year in which the accident occurred, and (B) the amount reported in the victim's personal income tax return for the calendar year in which the accident occurred; (iii) remuneration for overtime hours that is not included in clause (a) and that is received or earned in the 52 weeks before the date of the accident, (iv) the cash value from a profit-sharing plan allocation received or earned in the 52 weeks before the date of accident, (v) the value of the personal use of a motor vehicle provided by an employer at the time of the accident, in the amount reported in the victim's personal income tax return for the calendar year before the year in which the accident occurred or, where no such amount was reported, in an amount calculated under clause 6(1)⁠(a) (income from employment) of the Income Tax Act (Canada) as an annualized benefit, (vi) the value of the employer's contribution to the victim's pension plan, if lost because of the accident, (vii) the cash value of any other benefit that the victim received, or was entitled receive, in the 52 weeks before the date of the accident; (e) the commissions that the victim had earned, or to which he or she was entitled, (i) in the 52 weeks before the date of the accident, (ii) in the calendar year before the date of the accident, or (iii) in the three calendar years before the date of the accident, divided by three, whichever amount is the greatest. M.R. 93/95 GYEI derived from self-employment or a Canadian-controlled private corporation 3(1) In this section, "business income" means the income derived from self-employment or a Canadian-controlled private corporation, by way of proprietorship, partnership interest, or significant influence shareholder interest, less any expense that relates to the income and is allowed under the Income Tax Act (Canada) and The Income Tax Act of Manitoba but not including the following: (a) any capital cost allowance or allowance on eligible capital property; (b) any capital gain or loss; (c) any loss deductible under section 111 (losses from other years) of the Income Tax Act (Canada). M.R. 35/2003 GYEI from self-employment 3(2) Subject to section 5, a victim's gross yearly employment income derived from self-employment that was carried on at the time of the accident is the greatest amount of business income that the victim received or to which the victim was entitled within the following periods of time: (a) for the 52 weeks before the date of the accident; (b) for the 52 weeks before the fiscal year end immediately preceding the date of the accident; (c) where the victim has operated the business for not less than two fiscal years before the date of the accident, for the 104 weeks before the fiscal year end immediately preceding the date of the accident divided by two; (d) where the victim has operated the business for not less than three fiscal years before the date of the accident, for the 156 weeks before the fiscal year end immediately preceding the date of the accident divided by three; (e) the business income derived by a significant-influence shareholder in a Canadian-controlled private corporation that was declared for income tax purposes in the calendar year prior to the accident; or according to Schedule C. M.R. 93/95; 35/2003 Definitions 3(3) For the purposes of this section, "Canadian-controlled private corporation" means a Canadian-controlled private corporation as defined in subsection 125(7) of the Income Tax Act (Canada); (« société privée sous contrôle canadien ») "significant influence shareholder" means a shareholder in a Canadian-controlled private corporation who (a) holds 20% or more of the voting rights in the corporation, and (b) can demonstrate an active, authoritative influence over the day to day financial and administrative operations of the corporation. (« actionnaire exerçant une influence considérable ») M.R. 35/2003 GYEI of full-time earner under section 82 of Act 4 The gross yearly employment income of a full-time earner referred to in section 82 (more remunerative employment) of the Act is determined under sections 6 and 7, without adjustment under Schedule A. GYEI of a temporary or part-time earner for first 180 days 5(1) The gross yearly employment income of a temporary earner or part-time earner for the first 180 days after the date of accident is the amount calculated under sections 2 and 3. M.R. 93/95 GYEI of temporary earner or part-time earner after 180th day 5(2) The gross yearly employment income for a temporary earner or part-time earner after the 180th day following the date of the accident is the greatest of the amounts determined under subsection (1) and sections 6 and 7. GYEI of victim holding employment corresponding to determined employment for five years and at time of accident 6 The gross yearly employment income of a victim who, at the time of the accident, held employment corresponding to employment determined for him or her by the corporation and who, in the five calendar years preceding the date of the accident, held such employment, is the greatest gross yearly employment income earned by the victim from the employment in any of those calendar years as determined under sections 2 and 3, indexed under Schedule B and then adjusted under Schedule A. GYEI of victim holding employment corresponding to determined employment for five years but not at time of accident 7(1) The gross yearly employment income of a victim who, at the time of the accident, does not hold the employment determined for him or her by the corporation but who, in the five calendar years preceding the date of the accident, held such employment, is the greatest gross yearly employment income earned by the victim from the employment in any of those calendar years as determined under section 2 or 3, indexed under Schedule B and then adjusted under Schedule A to a maximum adjustment of 50%. M.R. 35/2003 GYEI of victim who never held employment corresponding to determined employment 7(2) The gross yearly employment income of a victim who, at the time of the accident, does not hold employment corresponding to employment determined for him or her by the corporation and who, in the five calendar years preceding the date of the accident, never held such employment is the gross yearly employment income set out in Schedule C for the employment determined by the corporation and adjusted under Schedule A to a maximum adjustment of 50%. M.R. 35/2003 GYEI of non-earner after 180th day 7(3) The gross yearly employment income of a non-earner after the 180th day following the date of the accident is the greater of the amounts determined under subsections (1) and (2). GYEI for classes of employment 8 The classes of employment and the corresponding gross yearly employment incomes set out in Schedule C apply in respect of the following provisions of the Act: (a) subclause 81(2)⁠(a)⁠(ii) (full-time earner); (b) subclause 83(2)⁠(a)⁠(ii) (temporary earner or part-time earner); (c) subclause 89(2)⁠(a)⁠(ii) (student); (d) subclause 95(2)⁠(a)⁠(ii) (minor); (e) section 106 (factors for determining employment); (f) section 107 (determination of employment after second anniversary of accident). GYEI for part-time determined employment 9 Notwithstanding sections 5 to 8, where the corporation determines that a victim can hold only part-time employment, the gross yearly employment income of the victim is reduced in accordance with Schedule D. COMPUTATION OF NET INCOME Net income is GYEI less certain deductions 10(1) For the purpose of this regulation, the net income of a victim is the gross yearly employment income of the victim determined under this regulation, less the following: (a) the income tax payable by the victim, as determined under subsection (3); (b) the premiums payable by the victim in respect of unemployment insurance, as determined under subsection (5); (c) the contributions payable by the victim in respect of the Canada Pension Plan, as determined under subsection (6); except in the case of a victim who is claiming a loss of unemployment insurance benefits, where the only deduction shall be the income tax payable as determined under subsection (3). M.R. 93/95 Taxable income is GYEI less deductions 10(2) For the purpose of this regulation, a victim's taxable income is the gross yearly employment income of the victim determined under this regulation less the following: (a) any amount allowable to the victim under clauses 60(b), (c) and (c.2) (maintenance) of the Income Tax Act (Canada), in the calendar year before the year for which the taxable income is calculated; and (b) any amount of the gross yearly employment income that would have been exempt from the victim's income tax under clause 81(1)⁠(a) (statutory exemptions) of the Income Tax Act (Canada) as that clause was at the time of the accident. Income tax is tax on taxable income less credits 10(3) For the purpose of this regulation, the income tax payable by a victim is the tax payable upon the taxable income of the victim calculated in accordance with the Income Tax Act (Canada) and The Income Tax Act of Manitoba, and allowing only the following credits: (a) the credit allowed under section 118.7 of the Income Tax Act (Canada), where "B" in the formula set out in that section is the total of (i) the premiums payable for unemployment insurance, as determined under subsection (5) of this section, and (ii) the contributions payable in respect of the Canada Pension Plan, as determined under subsection (6) of this section; (b) the credits allowed in subsections 118(1) (personal credits) and (2) (age credit) of the Income Tax Act (Canada), without any reduction in the credits in respect of the income of a dependant referred to in section 113 of The Manitoba Public Insurance Corporation Act ; (c) any credit or deduction from tax allowed under The Income Tax Act of Manitoba, except under subsection 5(5) (deductions for property taxes) of that Act, without any reduction in the credit or deduction in respect of the income of a dependant referred to in section 113 of The Manitoba Public Insurance Corporation Act . GYEI is pensionable and insurable earnings 10(4) For the purpose of subsections (5) and (6), the gross yearly employment income of a victim, as determined under this regulation, are the pensionable earnings of the victim for the purpose of the Canada Pension Plan, and the insurable earnings of the victim for the purpose of the Unemployment Insurance Act (Canada), not derived from self employment. Premiums payable under Unemployment Insurance Act 10(5) For the purpose of this regulation, the premiums payable under the Unemployment Insurance Act (Canada) are the amounts payable by the victim as an employee's premium for the year under that Act in respect of the victim's insurable earnings, not exceeding the maximum amount payable by him or her for the year under that Act. Contributions payable under Canada Pension Plan 10(6) For the purpose of this regulation, the contributions payable under the Canada Pension Plan are the amounts payable by the victim as an employee's contribution for the year under the Canada Pension Plan in respect of the victim's pensionable earnings, not exceeding the maximum amount by him or her for the year under the plan. Coming into force 11 This regulation comes into force on March 1, 1994. SCHEDULE A (Sections 5 to 7) INCOME ADJUSTMENT Reference period 1 In this schedule, "reference period" means a maximum of the 60 months preceding the date of the accident. Adjustment under sections 5 to 7 of regulation 2 Subject to sections 3 and 6 of this schedule, the adjustment referred to in sections 5 to 7 of the regulation is based on the victim's ratio of presence at work during the reference period and is the greatest of the following: (a) the number of months the victim held employment in the 12 month period preceding the date of the accident divided by 12; (b) the number of months the victim held employment in the 60 month period preceding the date of the accident divided by 60; (c) the sum of the number of months that the victim held employment in each consecutive 12 month period preceding the date of the accident in which the victim held employment, to a maximum of five such periods, divided by the product resulting from multiplying the number of such periods by 12. Periods of months to be reduced for minor, student, person not capable of employment 3 The divisors in clauses 2(a) to (c) of this schedule shall be reduced by the number of months in those periods in which the victim was a minor or student or not capable of holding employment. Calculation of months 4 For the purpose of calculating a victim's ratio of presence at work, a month in which a period of employment begins or ends is deemed to be a complete month of presence at work. Adjustment of GYEI under sections 5 to 7 of regulation 5 For the purpose of sections 5 to 7 of the regulation, the gross yearly employment income of a victim referred to in those sections is the greater of the following: (a) the amount determined by the formula A x B = GYEI In this formula, A is the gross yearly employment income determined under section 5, 6 or 7 of the regulation and indexing as applicable under Schedule B before any adjustment under this schedule; B is the ratio determined under section 2 of this schedule; GYEI is the adjusted gross yearly employment income; (b) the minimum wage established under Part 2 of The Employment Standards Act determined, except in the case of a part-time employment, on the basis of the standard hours of work set out in subsection 32(1) of that Act as it is on the day on which it is applied. Adjustment re unemployment, temporary, part-time employment 6 For the purpose of sections 5 to 7 of the regulation, no adjustment is made under this schedule when the victim, at the time of the accident, had been unemployed for less than 12 consecutive months or had held a temporary or part-time employment for less than 12 consecutive months, and held full-time employment for the balance of the period used as a divisor in clause 2(b) of this schedule less 12. SCHEDULE B (Section 6 and subsection 7(1)) INDEXATION The indexation referred to in section 6 and subsection 7(1) of the regulation is computed in accordance with the following formula: C x D = Unadjusted Gross Yearly Employment Income In this formula, C is the gross yearly employment income as determined under section 6 or subsection 7(1) of the regulation before indexation under this schedule and adjustment under Schedule A; D is the ratio of the industrial average wage, as defined in subsection 70(2) of the Act, for the year of the accident to the industrial average wage for the terminating year of the employment determined under section 84 of the Act. SCHEDULE C (Subsection 7(2) and section 8) CLASSES OF EMPLOYMENT Determination of level of experience 1 For the purpose of the following Tables, the corporation shall determine the level of experience that the victim has in the class of employment determined for the victim, in accordance with the following: (a) "Level 1" means less than 36 months of experience; (b) "Level 2" means 36 months or more but less than 120 months of experience; (c) "Level 3" means 120 months or more of experience. M.R. 38/2006 Calculation of months 2 For the purpose of calculating the number of months of experience under section 1 of this schedule, a month in which an employment begins or ends is deemed to be a complete month of experience. Application: Table A or Table B 2.1(1) For the purpose of this regulation, (a) Table A applies if the accident occurred before March 1, 2006; and (b) Table B applies if the accident occurs on or after March 1, 2006. M.R. 38/2006 2.1(2) Despite clause (1)⁠(a), Table B shall be used for any determination of employment (a) under subsections 84(1) or 86(1) of the Act, where the 181st day following the accident falls on a date on or after March 1, 2006; and (b) under sections 107 or 108 of the Act, on or after March 1, 2006. M.R. 38/2006 Indexation of gross incomes: Table A 3 Subject to section 3.1, the gross incomes appearing in Table A shall be adjusted on March 1 of each year, commencing on March 1, 1995, by the amount obtained by multiplying each gross income by an indexing factor obtained as follows: indexing factor = (IAW of the new year) ÷ (IAW of the previous year) In this formula, IAW is the industrial average wage, as defined in subsection 70(2) of the Act; IAW of the new year is the sum of the IAW for each of the 12 months before July 1 of the year preceding the year for which the indexing factor is computed; IAW of the previous year is the sum of the IAW for each of the 12 months before July 1 of the second year preceding the year for which the indexing factor is computed. M.R. 38/2006 End of indexation of gross incomes 3.1 The gross incomes appearing in Table A shall not be adjusted on or after March 1, 2006. M.R. 38/2006 Table A 4 In Table A, (a) "n.e.c." means not elsewhere classified; (b) the dollar figures are for full time work for a full year; (c) the annual minimum income calculated on the basis of the minimum wage of $5. per hour and a 40 hour week is $10,400.; when an income level in Table A is less than the minimum income of $10,400., the annual minimum income is to be used. M.R. 38/2006 Indexing formula: Table B 5 The gross income of each of the employments comprising each major occupational group appearing in Table B shall be adjusted on April 1 of each year by an amount obtained by multiplying the gross income of each employment by an indexing factor obtained as follows: index factor = (average AWW of the current 5 year period) ÷ (average AWW of the previous 5 year period) In this formula, AWW is the average weekly wages of the major occupational group to which the determined employment belongs, as given in the Labour Force Survey for Manitoba published by Statistics Canada each year; current 5 year period is the most recent five calendar years completed before April 1 of the year for which the indexing factor is computed; previous 5 year period is the next to last five year period, where the fifth year is the calendar year completed before April 1 of the year for which the indexing factor is computed, minus one year. M.R. 38/2006 ; 113/2021 Where labour force survey data unavailable 6 In a year in which Statistics Canada fails to publish a new Labour Force Survey for Manitoba, the corporation may revise and adjust the AWW levels set out in Table B in accordance with any statistical index or other publication that the corporation, in its discretion, judges to provide information similar to, or comparable with, that provided by the Labour Force Survey. M.R. 38/2006 Where employment not listed in Table B 7 Where an employment is not listed in Table B, or where Table B does not give an income for the employment, the corporation may determine an income for that employment using the National Occupational Classification and Table B as a guide. 21,465 29,948 SCHEDULE D (Section 9) REDUCTION OF GROSS YEARLY EMPLOYMENT INCOME The reduction of gross yearly employment income referred to in section 9 is computed in accordance with the following formula: GYEI × (AHW − N)/ AHW In this formula, GYEI is the gross yearly employment income of the determined employment calculated in accordance with sections 5, 6 or 7 or clauses 8(e) or (f); AHW is the average full-time weekly hours worked in the determined employment, as established in Schedule E; N is the number of hours the victim can work in the determined employment on a weekly basis. M.R. 38/2006 SCHEDULE E AVERAGE HOURS WORKED Definition: "AHW" 1 In this Schedule, "AHW" means the average full-time weekly hours worked by each of the major occupational groups listed in the Table in this Schedule.
