"refrigeration and air-conditioning mechanic" means a person who performs the following tasks of the trade to the standard indicated in the occupational analysis: (a) installs, maintains and services residential, commercial, industrial and institutional heating, ventilation, air conditioning and refrigeration units and systems; (b) lays out reference points for installation, assembles and installs components, installs wiring to connect components to an electric power supply and calibrates related controls; (c) measures, cuts, bends, threads and connects pipe to functional components and utilities; (d) maintains and services systems by testing components, brazing or soldering parts to repair defective joints, adjusting and replacing worn or defective components and reassembling repaired components and systems. (« mécanicien en réfrigération et en climatisation ») "refrigeration and air-conditioning mechanic (residential)" means a person who, to the standard indicated in the provincial occupational analysis for the trade, plans, installs and maintains residential heating, ventilation and air-conditioning systems, hydronic radiant floor heating systems, geothermal heating systems, solid fuel appliances and potable water heaters, other than (a) equipment that utilizes single phase electrical energy exceeding 240 volts, 6 gauge wire or 60 amps, including the installation of electrical heating equipment exceeding 103,000 Btu/hr (30 kW), excluding the electrical connection to the main panel for electric heating only; (b) equipment that utilizes fossil fuels with inputs exceeding 400,000 Btu/hr (118 kW); (c) cooling equipment exceeding 65,000 Btu/hr (19 kW) in rated capacity; or (d) ventilating equipment exceeding 1,200 cfm (566 l/s). (« mécanicien en réfrigération et en climatisation résidentielles ») "sub-component trade" means the sub-component trade of refrigeration and air-conditioning mechanic (residential). (« sous-catégorie du métier ») "trade" means the trade of refrigeration and air-conditioning mechanic. (« métier ») M.R. 160/2020 General regulation applies 2 The provisions, including the definitions, of the Apprenticeship and Certification — General Regulation , Manitoba Regulation 154/2001, apply to the trade unless inconsistent with a provision of this regulation. Designation of trade as compulsory continued 3(1) As provided for in subsection 48(9) of The Apprenticeship and Certification Act , the trade of refrigeration and air-conditioning mechanic, which includes the sub-component trade of refrigeration and air-conditioning mechanic (residential), is continued as a compulsory certification trade. Tasks excluded from scope of compulsory trade 3(2) The tasks of planning, installing and maintaining the following are part of the apprenticeship program for the sub-component trade but, for the purpose of subsection (1) and section 26 of the Act, a person who performs such tasks is not considered to be working in a compulsory certification trade: (a) hydronic radiant floor heating systems; (b) geothermal heating systems; (c) solid fuel appliances; (d) potable water heaters. M.R. 115/2025 3(3) For the purpose of subsection (1) and section 26 of the Act, a person performing the tasks listed in subsection (2) with respect to refrigeration specific equipment is considered to be working in a compulsory certification trade if these tasks involve (a) hydronic radiant floor heating systems; or (b) geothermal heating systems. 3(4) In this section, "refrigeration specific equipment" means any equipment or portion of the equipment that pertains to the closed-loop refrigeration system. M.R. 160/2020 Term of apprenticeship 4 The term of apprenticeship in (a) the trade is four levels, with each level consisting of a period of at least 12 months during which the apprentice must complete 1,800 hours of technical training and practical experience; and (b) the sub-component trade is three levels, with each level consisting of a period of at least 12 months during which the apprentice must complete 1,800 hours of technical training and practical experience. M.R. 160/2020 Apprentice wage rates 5(1) Unless otherwise prescribed by a payment agreement or enactment that is more favourable to the apprentice, the wage rate for an apprentice shall not be less than (a) 50% of the reference wage rate during the first level; (b) 60% of the reference wage rate during the second level; (c) 70% of the reference wage rate during the third level; and (d) 80% of the reference wage rate during the fourth level; (e) [repealed] M.R. 160/2020 . Definition of "reference wage rate" 5(2) In subsection (1), "reference wage rate" means (a) the hourly minimum wage rate prescribed for a journeyperson refrigeration and air-conditioning mechanic under the Construction Industry Minimum Wage Regulation , Manitoba Regulation 119/2006; or (b) the prevailing wage rate per hour paid to a journeyperson who is employed on the same contract or job as the apprentice, where the wage rate of the journeyperson is not prescribed under The Construction Industry Wages Act . M.R. 160/2020 Certification examination 6 The certification examination for (a) the trade consists of a written interprovincial examination; and (b) the sub-component trade consists of a written provincial examination. 7 to 9 [Repealed] M.R. 160/2020 Transition: change in number of levels for trade 9.1(1) On the day that this section comes into force, an apprentice who is enrolled in the first, second or third level of the apprenticeship program for the trade is eligible to obtain a certificate of qualification upon successfully completing (a) the four levels of technical training and practical experience required under clause 4(a); and (b) any other relevant criteria under section 21 of the Apprenticeship and Certification — General Regulation . 9.1(2) On the day that this section comes into force, an apprentice who is enrolled in the fourth level of the apprenticeship program for the trade is eligible to write the certification examination upon successfully completing the technical training prescribed for that level. 9.1(3) On the day that this section comes into force, an apprentice who is enrolled in the fifth level of the apprenticeship program for the trade must immediately be issued their certificate of qualification provided that they have (a) successfully completed the four levels of technical training and practical experience required under clause 4(a); (b) attained a satisfactory grade on the certification examination; and (c) fulfilled any other relevant criteria required under section 21 of the Apprenticeship and Certification — General Regulation . 9.1(4) On the day that this section comes into force, an apprentice who is enrolled in the fifth level of the apprenticeship program for the trade has the option to withdraw from that level or to continue in that level. 9.1(5) If an apprentice chooses to continue in the fifth level, the apprentice will be (a) granted advanced standing equivalent to the technical training and practical experience required under clause 4(a) of the Trade of Gasfitter Regulation , Manitoba Regulation 37/2011; and (b) eligible to write the certification examination for the subcomponent trade of domestic gasfitter upon successfully completing that level. M.R. 160/2020 Transition: change in number of levels for subcomponent trade 9.2(1) On the day that this section comes into force, an apprentice who is enrolled in the first or second level of the apprenticeship program for the subcomponent trade is eligible to obtain a certificate of qualification upon successfully completing (a) the three levels of technical training and practical experience required under clause 4(b); and (b) any other relevant criteria under section 21 of the Apprenticeship and Certification — General Regulation . 9.2(2) On the day that this section comes into force, an apprentice who is enrolled in the third level of the apprenticeship program for the subcomponent trade is eligible to write the certification examination upon successfully completing the technical training prescribed for that level . 9.2(3) On the day that this section comes into force, an apprentice who is enrolled in the fourth level of the apprenticeship program for the subcomponent trade must immediately be issued their certificate of qualification provided that they have (a) successfully completed the three levels of technical training and practical experience required under clause 4(b); (b) attained a satisfactory grade on the certification examination; and (c) fulfilled any other relevant criteria required under section 21 of the Apprenticeship and Certification — General Regulation . 9.2(4) On the day that this section comes into force, an apprentice who is enrolled in the fourth level of the apprenticeship program for the subcomponent trade has the option to withdraw from that level or to continue in that level. 9.2(5) If an apprentice chooses to continue in the fourth level, the apprentice will be (a) granted advanced standing equivalent to the technical training and practical experience required under clause 4(a) of the Trade of Gasfitter Regulation ; and (b) eligible to write the certification examination for the subcomponent trade of domestic gasfitter upon successfully completing that level. M.R. 160/2020 Repeal 10 The Trade of Refrigeration and Air-Conditioning Mechanic Regulation , Manitoba Regulation 229/97, is repealed. Coming into force 11 This regulation comes into force on August 3, 2012, or on the day it is registered under The Regulations Act , whichever is later.
