E60 Regulation 97/87 R Registered March 2, 1987 bilingual version (HTML) Table of Contents Section 1 Definitions 2-3 Design, construction and installation 4 Fee for approval of drawings and specifications 5 Fee for permit for new, altered elevator 6 Fees for renewal of permit 7 Additional inspection charge 8 Permit to be posted 9 Inspection required 10-17 Rules respecting existing elevator installations Schedule PART I DEFINITIONS 1 In this regulation, "Act" means The Elevator Act ; («  Loi  ») "approved" means, unless otherwise stated, approved by the chief inspector; (« approuvé ») "code" means (a) the Canadian Standards Association B44 Safety Code for Elevators, Dumbwaiters, and Escalators , as amended from time to time, (b) the Canadian Standards Association Z185 Safety Code for Workmen's Hoists , as amended from time to time, (c) the Canadian Standards Association CSA B355, Lifts for Persons with Physical Disabilities , as amended from time to time, or (d) the National Standards of Canada, CAN3-Z98-N78, Passenger Ropeways , as amended from time to time, as the context and the circumstances require; (« code ») "dumbwaiter" means an elevator used exclusively for carrying freight, with hoisting and lowering mechanism, that moves in guides in a substantially vertical direction, and that has (a) a floor area not exceeding nine square feet, (b) a compartment height not exceeding four feet, and (c) a capacity not exceeding 500 pounds; (« monte-plats ») "elevating device for person with physical disability" means an elevator that (a) is for the specific use of persons with a physical disability, (b) travels between fixed points in a building or structure, and (c) is installed or reinstalled in the following building: (i) a building that is subject to Part 3 of Division B of the Manitoba Building Code , Manitoba Regulation 31/2011, (ii) a building that is open to the public and is subject to Part 9 of Division B of Manitoba Building Code , Manitoba Regulation 31/2011, (iii) a building that is a residential care occupancy, as defined in the Manitoba Building Code , Manitoba Regulation 31/2011; (« appareil élévateur pour personne handicapée ») "escalator" means an elevator that is a power-driven, inclined, and continuous stairway or runway affixed to a building or structure, and that is used for lifting or lowering persons; (« escalier roulant ») "freight elevator" means an elevator used for carrying freight, and on which only the operator and the persons necessary for loading and unloading the freight are permitted to ride; (« ascenseur pour marchandises ») "inspector" means an inspector of The Department of Labour; (« inspecteur ») "installation" means a new installation as set forth in this regulation, and includes all pertinent equipment and the hoistway; (« installation ») "manlift" means a mechanism affixed to a building or structure, and that has platforms or footholds that move in guides, and is used to lift or lower a person or persons, and serves two or more floors or permanent levels of a building or structure; and includes its hoistway enclosure; (« monte-personnes ») "major alteration" means one or more of the changes or alterations specified in section 10.1.1 of the code carried out to an existing installation; (« modification substantielle ») "passenger elevator" means an elevator that is designed to carry persons; (« ascenseur pour passagers ») "re-installation" means the relocation of an elevator in a new location. (« réinstallation ») M.R. 106/2012 ; 219/2015 PART II DESIGN, CONSTRUCTION AND INSTALLATION 2(1) Subject to subsection (2), the standards set forth in the code are adopted as the minimum standards for the design, construction, installation, re-installation, or major alteration of every elevator. 2(2) Where the standards set forth in the code vary from standards set forth in this regulation, the latter prevail. 3 No person shall start a new installation, re-installation, or major alteration, of an elevator without first forwarding to the chief inspector (a) drawings, in duplicate; (b) specifications; and (c) the prescribed fee. Fee for approval of drawings and specifications 4(1) Subject to subsection (2), the fee payable for the approval of drawings and specifications relating to the installation or re-installation of an elevator or elevating device is as follows: (a) passenger elevator 4(2) Where drawings and specifications include more than one elevator of a similar type to be installed in the same building, one-half of the relevant approval fee specified in subsection (1) is payable for each additional elevator after the first elevator. 4(3) Where major alterations are to be carried out to an existing installation, the fee payable for the approval of drawings and specifications is one-half of the relevant fee specified in subsection (1). M.R. 139/97; 100/2005 ; 106/2012 Fee for permit for new, altered elevator or device 5(1) The fee payable for a permit to operate an elevator or elevating device that is a new installation or a re-installation, or after a major alteration, is as follows: (a) passenger elevator 5(2) Where a permit to operate an elevator or elevating device is issued and the fee therefor has been paid in accordance with subsection (1), the permit shall remain valid for a period of 12 months after the date of issue. M.R. 139/97; 100/2005 ; 106/2012 Fees for renewal of permit 6(1) Subject to subsection (2), the fees payable for the renewal or issue of a permit to operate an elevator or elevating device, other than a new installation, re-installation or major alteration, shall be as set out in the Schedule. 6(2) Where a permit for a period of 24 or 36 months is renewed or issued, the minister may authorize the payment of fees on a yearly installment basis and, in such case (a) the annual fee payable shall be the 12 month permit fee specified in subsection (1); and (b) the permit shall be valid only for that portion of the applicable permit period in respect of which payment has been made. 6(3) Subject to subsection (4), the minister may fix or determine, in respect of each elevator or elevating device, the period for which a permit shall be issued or renewed, and, except as otherwise provided herein, the permit shall be valid for the period shown on the permit. 6(4) For the purpose of fixing or determining the period for which a permit to operate an elevator or elevating device shall be issued or renewed, the minister shall take into account and give consideration to (a) the adequacy of the owner's maintenance program for the elevator or elevating device; (b) the age, condition and design complexity of the elevator or elevating device; and (c) such other matters or circumstances as the minister deems relevant. 6(5) Where a permit has been lost, destroyed or defaced, a duplicate may be issued on payment of a fee of $40. 6(6) Notwithstanding any other provision of the regulations, a permit ceases to be valid where the chief inspector closes an elevator by placing a seal on it pursuant to section 11 of the Act. M.R. 100/2005 ; 106/2012 Additional inspection charge 7 Where a special inspection is requested or where an additional inspection is necessitated by reason of material, or quality of work, found to be unsatisfactory, there shall be payable a charge of $85. per hour, or fraction thereof, plus travelling expenses, and such charge shall be in addition to any permit fee payable pursuant to subsection 5(1) or subsection 6(1). M.R. 100/2005 ; 106/2012 Permit to be posted 8(1) Where a permit to operate an elevator or elevating device has been issued or renewed, the owner or contractor, as the case may be, shall post or display the permit, (a) in the case of a passenger elevator, in the car of the elevator; (b) in the case of a freight elevator, in the car of the elevator or in a conspicuous place near the elevator; or (c) in the case of any other elevator or elevating device, as directed by an inspector. 8(2) No unauthorized person shall remove, alter or deface any permit posted or displayed pursuant to the Act or the regulations. 8(3) A permit issued or renewed authorizing the operation of an elevator or an elevating device applies only to the particular elevator or elevating device for which it is issued or renewed, and is not transferable. Inspection required 9 Before a permit to operate an elevator or an elevating device is issued or renewed, the minister shall have an inspection of the elevator made by an inspector and shall also (a) require the owner or elevator contractor to test all safety apparatus in the presence of an inspector; or (b) accept, on the recommendation of the chief inspector, an affidavit of the owner or elevator contractor that the tests mentioned in clause (a) have been made and that the safety apparatus is in good working order. PART III RULES RESPECTING EXISTING ELEVATOR INSTALLATIONS 10 Every hoistway opening of a freight elevator shall be guarded by an approved wood or metal door or gate. 11(1) A landing gate in the closed position shall extend downward from a height of not less than 66 inches to the landing sill. 11(2) The minimum head-room clearance of a hoistway gate or hoistway door shall be six feet, six inches. 11(3) Where insufficient head-room or a structural condition makes the minimum standards in subsections (1) and (2) impractical, the chief inspector may approve other types of doors or gates. 12 No opening in a landing door or gate shall allow passage of a ball two inches or more in diameter, except that one hand-rope opening may be provided not more than five inches wide, or more than 36 inches high, and with its bottom approximately 30 inches above the landing floor. 13 Every freight elevator hoistway landing door or gate shall be provided with an approved device, consisting of a mechanical lock and electric contact, which shall effectively prevent the car from moving until the door or gate is closed; and which shall prevent the door or gate from being opened from the landing side unless the car is in a position, in relation to the door or gate, to permit the safe movement of persons or freight onto or off the platform of the elevator. 14 An electric contact shall not be a part of a shaftway door interlocking device on a hand-rope operated power elevator, unless the elevator is equipped with approved electrical brakes. 15 Where the car travel is over 15 feet, car safeties shall be operated by an approved over-speed governor. 16 Every power elevator shall have an approved final limit stopping device that will prevent the car from over-running its safe limits of travel at the top and the bottom of the hoistway. 17 Where an accident involving any elevator causes injury or death, the owner of the elevator shall immediately notify the chief inspector.
