"electrologist" means a person who, to the standard indicated in the occupational analysis of the trade, performs a task of the trade set out in section 4. (« électrolyste ») "general regulation" means the Apprenticeship and Certification — General Regulation , Manitoba Regulation 154/2001. (« règlement général ») "journeyperson" means a person who holds a certificate of qualification. (« compagnon ») "practise in the trade" means to perform a task set out in section 4. (« exercer le métier ») "prescribed fee" means a fee prescribed in the Apprenticeship and Certification Fees Regulation, 2019 , Manitoba Regulation 92/2019. (« droits réglementaires ») "trade" means the trade of electrologist. (« métier ») M.R. 163/2020 General regulation applies 2 The provisions of the general regulation, including the definitions, apply to the trade, unless they are inconsistent with a provision of this regulation. Designation of trade 3 The trade of electrologist is designated a compulsory certification trade. Tasks of the trade 4 The tasks of the trade are performing (a) pre-epilation treatments; (b) electrolysis using galvanic or short-wave current, or a combination of both; and (c) post-epilation treatments; for the purpose of permanently removing unwanted hair. Who may practise in the trade 5 No person may practise in the trade unless the person (a) holds a valid certificate of qualification; (b) holds a temporary permit; (c) is performing the tasks of the trade, incidental to their enrollment in a training program; or (d) is authorized by another designated trade regulation to perform a task of the trade to the standard indicated in the occupational analysis for the trade of electrologist. M.R. 163/2020 Transition — valid authorization deemed certificate 5.1 A person who holds a valid authorization to practice in the trade on the day before this section comes into force is deemed to hold a valid certificate of qualification. M.R. 163/2020 Exclusions 6 A person is deemed not to be practising in the trade when the person performs a task of the trade (a) while participating in a training program in the trade provided by a training provider; (b) while demonstrating equipment or a product used in the trade for the purpose of selling it; or (c) which they are authorized to perform under another enactment. M.R. 163/2020 Eligibility requirements for apprenticeship 7(1) The executive director may register an apprenticeship agreement in the trade only if the person who wishes to become an apprentice has completed, or is enrolled in, a training program in the trade provided by a training provider that consists of at least 500 hours. 7(2) To become a senior years apprentice in the trade, a person must be concurrently enrolled in an accredited technician training program in the trade at a senior years school. M.R. 163/2020 Term of apprenticeship 8 Apprenticeship in the trade is one level, consisting of a period of at least 12 months during which the apprentice must complete 1,000 hours of practical experience and technical training. Credit for prior learning 9(1) Before granting credit for prior learning to a prospective apprentice under section 18 of the general regulation, the executive director may require the person to provide documentation, in a form acceptable to the executive director, of the technical training that the person has completed and for which credit is requested. 9(2) No credit for prior learning granted under section 18 of the general regulation may shorten the term of apprenticeship in the trade. M.R. 163/2020 10 [Repealed] M.R. 163/2020 Certification examinations 11 The certification examination for the trade consists of a written provincial examination and a provincial practical examination. The executive director may establish when an apprentice is to take each examination. M.R. 163/2020 Appointment of examiners 12(1) For the purpose of administering practical examinations, the executive director may appoint as an examiner a person who is a journeyperson and, in the opinion of the executive director, is knowledgeable about the apprenticeship system. 12(2) A person's term of appointment as an examiner may not exceed two years, but the person may be reappointed. 12(3) The executive director may revoke the appointment of an examiner at any time. M.R. 163/2020 Requirement for certificate of qualification 13 Before issuing a certificate of qualification in the trade to a person, the executive director must be satisfied the person has (a) completed and attained a satisfactory grade in all aspects of a training program described in section 7; and (b) met the requirements of section 21 of the general regulation. M.R. 163/2020 14 to 16 [Repealed] M.R. 163/2020 Temporary permits 17(1) The executive director may issue a temporary permit to a person who (a) is awaiting the opportunity to take a prescribed examination; or (b) is awaiting a decision of the executive director or an appeal board; (c) [repealed] M.R. 163/2020 . 17(2) In order to be issued a temporary permit, a person must file an application with the executive director and pay the prescribed fee. 17(3) A temporary permit may not be issued for a period exceeding six months. 17(4) A person holding a temporary permit may apply to have it renewed by filing an application for renewal with the executive director at least 30 days before the existing permit expires. M.R. 163/2020 Certificates and permits must be available on request 18 A person who is practising in the trade must provide a valid certificate of qualification, temporary permit, or proof of apprentice status for inspection upon request. M.R. 163/2020 Cancellation or suspension of certificate, etc. 19 The executive director may cancel or suspend a person's certificate or temporary permit if the executive director is of the opinion that the person is practising in the trade in contravention of the Act or any regulation made under the Act. M.R. 163/2020 20 [Repealed] M.R. 163/2020 Repeal 21 The Trade of Electrologist Regulation , Manitoba Regulation 36/2002, is repealed.
