M225 Regulation 121/98 Registered July 20, 1998 bilingual version (HTML) PART 1 DEFINITIONS Definitions 1 In this regulation, "new municipality" means The Rural Municipality of Shellmouth-Boulton established under section 2; (« nouvelle municipalité ») "old councils" means the council of The Rural Municipality of Shellmouth and the council of The Rural Municipality of Boulton; (« anciens conseils ») "old municipalities" means The Rural Municipality of Shellmouth and The Rural Municipality of Boulton. (« anciennes municipalités ») PART 2 ESTABLISHMENT OF NEW MUNICIPALITY New municipality established 2 On January 1, 1999, The Rural Municipality of Shellmouth and The Rural Municipality of Boulton are amalgamated to establish The Rural Municipality of Shellmouth-Boulton. Boundaries 3 The new municipality consists of the following area: Townships 22, 23 and 24 - 26 to 29 WPM. Status of new municipality 4 The new municipality has the status of a rural municipality. Composition of first council 5 The first council of the new municipality is to be composed of a head of council and six councillors. Election of councillors on basis of wards 6(1) The councillors of the new municipality are to be elected on the basis of wards, with one councillor elected in each ward. Description of wards 6(2) The wards of the new municipality are established as follows: Ward One All Township 22 - 26 WPM; All Township 22 - 27 WPM; and Sections 1, 12, 13, 24, 25 and 36 - 22 - 28 WPM Ward Two Sections 2 to 11, 14 to 23 and 26 to 35 - 22 - 28 WPM; and All Township 22 - 29 WPM Ward Three All Townships 23 and 24 - 29 WPM Ward Four Sections 6, 7, 18, 19 and 30 - 23 - 26 WPM; Sections 1 to 30 - 23 - 27 WPM; and Sections 1 to 30 - 23 - 28 WPM Ward Five Sections 31, 32 and 33 - 23 - 27 WPM; Sections 4 to 9, 16 to 21 and 28 to 33 - 24 - 27 WPM; Sections 31 to 36 - 23 - 28 WPM; and All Township 24 - 28 WPM Ward Six Sections 1 to 5, 8 to 17, 20 to 29 and 31 to 36 - 23 - 26 WPM; All Township 24 - 26 WPM; Sections 34, 35 and 36 - 23 - 27 WPM; and Sections 1, 2, 3, 10 to 15, 22 to 27, 34, 35 and 36 - 24 -27 WPM. PART 3 TRANSITIONAL PROVISIONS Extension of term of office of councils of old municipalities 7 The terms of office of the members of the old councils are extended to noon on January 1, 1999, without those members being re-elected at the general election on October 28, 1998. Dissolution of old councils 8(1) The councils of the old municipalities are dissolved at noon on January 1, 1999. Limitation on powers of old councils 8(2) During the period commencing at noon on October 29, 1998 and ending at noon on January 1, 1999, the old councils may not spend money except as authorized in their respective 1998 financial plans, unless the expenditure is approved in writing in advance by the minister or minister's delegate. Term of first council of new municipality 9(1) The terms of office of the members of the first council of the new municipality commence at noon on January 1, 1999 and end at noon on the day following the next general election. First meeting of first council 9(2) The first meeting of the first council is to take place on January 5, 1999, commencing at 10:00 a.m. at the municipal office located at 118 Main Street in the Local Urban District of Inglis. Appointment of CAO 10 Raymond Bomback is appointed as chief administrative officer of the new municipality for the period commencing on the date this regulation comes into force, and ending on the date the first council appoints a chief administrative officer. Employees continued 11 Effective January 1, 1999, the employees of the old municipality are continued as employees of the new municipality. Application of by-laws and resolutions of the old municipalities 12 Effective January 1, 1999, the by-laws and resolutions of the old municipalities are continued as by-laws of the Rural Municipality of Shellmouth-Boulton, and in the case of a conflict between the by-laws of the old municipalities or between the resolutions of the old municipalities, the most recent by-law or resolution applies. PART 4 FIRST ELECTION First election of new municipality 13(1) This section applies to the first election in the new municipality. Appointment of first election officials 13(2) Each of the following persons is designated to hold the office set out opposite his or her name during the period commencing on the date this regulation comes into force and ending at noon on January 1, 1999: (a) Raymond Bomback – returning officer; (b) Dianne Ungarian – enumerator; (c) Marion Werschler – revising officer. Voting list of new municipality 13(3) The preparation and revision of the first list of electors of the new municipality must be completed on or before September 2, 1998. Place for nominations 13(4) The nomination of candidates for the head of council and councillors of the new municipality must be filed with the returning officer at the municipal office located at 118 Main Street in the Local Urban District of Inglis between the hours of 8:30 a.m. and 4:30 p.m. on September 30 or October 1, 2, 5, or 6, 1998. E ligibility for office by member of old council 13(5) A member of an old council is eligible for nomination for and election to the first council of the new municipality. Date of election of first council 13(6) The election of members of the first council of the new municipality is to take place on October 28, 1998. PART 5 REVIEW AND COMING INTO FORCE Review and recommendation 14 Not later than December 31, 2000, the minister shall (a) review the effectiveness of the operation of this regulation including consulting with such persons affected by it as the minister considers appropriate; and (b) recommend to the Lieutenant Governor in Council that the regulation be amended, continued or repealed. Coming into force 15 This regulation comes into force on August 15, 1998.
