By-law No. 3/91: Community of Dauphin River, Closure of Part of Public Reserve, M.R. 142/91 The Northern Affairs Act , C.C.S.M. c. N100 Regulation 142/91 Registered June 25, 1991 bilingual version (HTML) WHEREAS The Northern Affairs Act , C.C.S.M. c. N100, provides as follows: 5(1) Subject to . . . other provisions of the Act . . . the minister has the powers, rights, privileges and duties that a municipality has within its boundaries . . . ; 5(5) . . . where the exercise or performance of the powers, rights, privileges or duties referred to . . . require the passing of a by-law . . . the minister may make the by-law . . . for or on behalf of the residents of Northern Manitoba, a community or an incorporated community; 5(6) The by-law . . . may be made to apply to the whole or any part of Northern Manitoba . . . ; AND WHEREAS The Planning Act , C.C.S.M. c. P80, provides as follows: 73(3) Land designated as a public reserve . . . may be closed by by-law of the municipality . . . ; 94 The minister responsible for this Part and for those sections of this Act that apply in Northern Manitoba shall be the minister responsible for The Northern Affairs Act ; AND WHEREAS it is considered advisable and in the best interest of the Community of Dauphin River to close the portion of the public reserve shown hatched on the Schedule to this by-law; NOW THEREFORE the Minister of Northern Affairs, on behalf of the Community of Dauphin River, enacts as follows: Closure of public reserve, plan 13885, WLTO 1 This by-law closes all that portion of the public reserve described as follows: All that portion of Public Reserve, Plan 13885, WLTO in Frac. 26 and 27 - 34 - 5 WPM, and Government Road Allowance, now closed, lying to the North-east of the straight production south-easterly of the North-eastern limit of Henry Avenue, of said plan; Excepting thereout Zettergres Avenue, Plan 17334, WLTO.
