(«  Loi ») "call centre" means a business operating at a physical location from which the business uses telephone communications, which may include computer technology, to facilitate communication between a provider of goods or services and a former, current or potential consumer of the goods or services, but does not include a business selling its own goods or services to consumers. (« centre d'appel ») "direct sale" means a retail sale or retail hire-purchase of goods or services or both entered into by a buyer elsewhere than at the vendor's usual place of business and that results from an offer, solicitation, proposal or approach made by or on behalf of the vendor (a) without any prior request by the buyer; or (b) in response to a request made by the buyer if the request was itself solicited by or on behalf of the vendor. (« démarchage ») Oral statement of cancellation rights required 2(1) A direct seller must provide an oral statement of cancellation rights to a buyer in respect of a direct sale for $100. or more made from a call centre on behalf of the vendor. Statement wording 2(2) The statement of cancellation rights must contain (a) the wording specified in the Schedule to this regulation; or (b) other wording satisfactory to the director that provides the same information as set out in the Schedule. Information to be provided in clear and understandable manner 2(3) The direct seller must ensure that the information described in subsection (2) was provided to the buyer in a clear and understandable manner. Recording information 2(4) The direct seller must, in a form that can be reproduced, (a) record that the information described in subsection (2) was provided to the buyer and by whom; and (b) record the name of the buyer and the date and time when the statement was given. Coming into force 3 This regulation comes into force on April 1, 2008. SCHEDULE (Subsection 2(2)) BUYER'S RIGHT TO CANCEL You may cancel this contract from the day you enter the contract until 10 days after you receive this oral statement of cancellation rights. You do not need a reason to cancel. You may cancel this contract within one year of the contract date, if you do not receive the goods or services within 30 days after the delivery date stated in the contract or, if no delivery date is stated, within 30 days after the date you entered the contract. You lose the right to cancel if you accept delivery after the 30 days. There are other grounds for extended cancellation.
