Inco Limited sulphur dioxide emissions 2(1) Inco Limited shall not emit sulphur dioxide into the atmosphere in excess of 31 kilotonnes per calendar month and 300 kilotonnes per calendar year. 2(2) After January 1, 1994, Inco Limited shall not emit sulphur dioxide into the atmosphere in excess of 23 kilotonnes per calendar month and 220 kiltonnes per calendar year. Inco Limited particulate emissions 3 Inco Limited shall not emit particulate matter into the atmosphere in excess of 310 tonnes per calendar month and 3,000 tonnes per calendar year. Hudson Bay Mining and Smelting Co., Limited sulphur dioxide emissions 4(1) Hudson Bay Mining and Smelting Co., Limited shall not emit sulphur dioxide into the atmosphere in excess of 30 kilotonnes per calendar month and 293 kilotonnes per calendar year. 4(2) After January 1, 1994, Hudson Bay Mining and Smelting Co., Limited shall not emit sulphur dioxide into the atmosphere in excess of 23 kilotonnes per calendar month and 220 kilotonnes per calendar year. Hudson Bay Mining and Smelting Co., Limited particulate emissions 5(1) Hudson Bay Mining and Smelting Co., Limited shall not emit particulate matter into the atmosphere in excess of 517 tonnes per calendar month and 5,000 tonnes per calendar year. 5(2) After January 1, 1994, Hudson Bay Mining and Smelting Co., Limited shall not emit particulate matter into the atmosphere in excess of 258 tonnes per calendar month and 2,500 tonnes per calendar year. Ambient air monitoring, etc. 6 Inco Limited and Hudson Bay Mining and Smelting Co., Limited shall (a) operate an ambient air monitoring program for sulphur dioxide in a manner and at locations approved by the director; (b) within 15 days of the end of every month submit a report to the director of the preceding month's ambient sulphur dioxide levels, based on the results obtained under clause (a); and (c) on a daily basis, record sulphur dioxide emissions based on a mass balance calculation approved by the director, and within 15 days of the end of every month submit to the director a summary of the preceding month's emissions. Stack sampling 7(1) Once every three years, or more frequently if requested to do so by the director, Inco Limited and Hudson Bay Mining and Smelting Co., Limited shall conduct detailed stack sampling in the main smelter stack, in accordance with methods specified by the director, to determine the following: (a) the quantity of all particulate matter; (b) the identity and quantity of each major component, specified by the director, of the particulate matter; and (c) the quantity of sulphur dioxide being emitted into the atmosphere. 7(2) The results of the sampling referred to in subsection (1) shall be submitted to the director within 60 days of completion of the sampling. 7(3) The first sampling results referred to in subsection (1) shall be submitted to the director prior to December 1, 1988. Particulate emission monitoring and measurement 8(1) Inco Limited shall (a) install and operate a continuous particulate emission monitor approved by the director to measure particulate matter emissions from the main smelter stack; and (b) within 15 days of the end of every month submit a report to the director of the preceding month's particulate matter emissions, based on the measurements obtained under clause (a). 8(2) Hudson Bay Mining and Smelting Co., Limited shall (a) measure the emissions of particulate matter by a method and at a frequency satisfactory to the director; and (b) within 15 days of the end of every month submit a report to the director of the preceding month's particulate matter emissions, based on the results obtained under clause (a). 8(3) After October 1, 1989, Hudson Bay Mining and Smelting Co., Limited shall (a) install and operate a continuous particulate emission monitor, which has been approved by the director, to measure particulate matter emissions from the main smelter stack; and (b) within 15 days of the end of every month submit to the director a report of the preceding month's particulate matter emissions, based on the results obtained under clause (a). Studies 9(1) Inco Limited and Hudson Bay Mining and Smelting Co., Limited shall conduct studies into methods to further reduce sulphur dioxide and particulate emission levels from those levels specified in this regulation to take effect on January 1, 1994. 9(2) The studies referred to in subsection (1) shall be submitted to the minister on or before January 1, 1990 and shall contain the following information: (a) identification of the amount of possible further reduction of emissions of sulphur dioxide and particulate matter; (b) the costs required to achieve the reduction; and (c) the time frame required for implementation of the reduction. Review 10 Upon receipt of the studies referred to in section 9, the minister shall carry out a review of the studies to determine (a) whether the emission levels specified in subsections 2(2), 4(2) or 5(2) should be lowered; or (b) where the studies show that the levels specified in subsections 2(2), 4(2) or 5(2) are unreasonably restrictive, whether the levels should be raised; and the minister shall recommend appropriate amendments to this regulation to the Lieutenant Governor in Council no later than June 30, 1990.
