"AFUE" means annual fuel utilization efficiency, which is a measure expressed as a percentage of the amount of fuel converted to space heat in proportion to the amount of fuel entering a gas-fired furnace or boiler. (« rendement énergétique annuel ») "CSA standard" means the Canadian Standards Association standard CAN/CSA-P.2-07, Testing Method for Measuring the Annual Fuel Utilization Efficiency of Residential Gas-Fired Furnaces and Boilers , as amended from time to time. (« norme de la CSA ») "gas boiler" means a gas-fired boiler that (a) uses natural gas or propane; (b) is intended for application in a low pressure steam or hot water central heating system; and (c) has an input rating not exceeding 88 kW (300,000 Btu/h). (« chaudière à gaz ») "gas furnace" means a gas-fired central forced air furnace that (a) uses natural gas or propane; (b) has an input rating not exceeding 65.92 kW (225,000 Btu/h); and (c) uses single-phase electric current. (« générateur d'air chaud à gaz ») "label" means a printed decal, stamped plate or other permanent marking. (« étiquette ») Gas furnaces and small boilers are prescribed 2 The following are prescribed as energy-using products: (a) gas furnaces; (b) gas boilers. Designation of testing and certification bodies 3 A testing agency or other organization accredited by the Standards Council of Canada as a certification body for verifying the energy efficiency of gas-fired appliances and equipment is designated for the purpose of testing and certifying or verifying the AFUE of a gas furnace or a gas boiler. Energy efficiency standards for gas furnaces and small boilers sold or leased in Manitoba 4 After December 30, 2009, no person shall sell, offer for sale, lease or offer for lease the following in Manitoba: (a) a gas furnace, unless the gas furnace has an AFUE rating that is equal to or greater than 92%; (b) a gas boiler that is intended for application in a hot water central heating system, unless the gas boiler has (i) an AFUE rating that is equal to or greater than 82%, and (ii) no continuously burning pilot light; (c) a gas boiler that is intended for application in a low pressure steam central heating system, unless the gas boiler has (i) an AFUE rating that is equal to or greater than 80%, and (ii) no continuously burning pilot light. Testing, certification and labelling 5 After December 30, 2009, a gas furnace or a gas boiler sold, offered for sale, leased or offered for lease in Manitoba must (a) have its AFUE rating tested and certified or verified in accordance with the methods set out in the CSA standard by a testing agency or other body designated under section 3; and (b) display a label, located in close proximity to the manufacturer's label so that it is easily and readily seen without the need to remove any covering, containing the registered trademark or symbol of the testing agency or organization that certified or verified the AFUE rating of the gas furnace or gas boiler. Exemptions 6 This regulation does not apply to (a) a gas furnace or a gas boiler unless it is intended to replace an existing furnace, boiler or other heating appliance or equipment; (b) a gas furnace that is intended for installation in a mobile home or a recreational vehicle; (c) a through-the-wall gas furnace that is intended for installation in an opening in an exterior wall fitted with a weatherized sleeve; (d) an outdoor gas furnace; (e) a gas furnace or a gas boiler that is manufactured in Manitoba for export from Manitoba; or (f) a product that incorporates into it a gas furnace or a gas boiler, if the product is manufactured for export from Manitoba. Coming into force 7 This regulation comes into force on December 1, 2009, or the day it is registered under The Regulations Act , whichever is later.
