M225 Regulation 189/98 Registered October 30, 1998 bilingual version (HTML) Definitions 1 In this regulation, "Act" means The Municipal Act ; ( » Loi  ») "auction" means a public auction held under section 365 of the Act. (« vente aux enchères ») Advertisement of auction 2(1) In order for a sale to be conducted in a fair and open manner, a municipality must advertise an auction by (a) publishing a notice of auction on two occasions, the first at least 21 days and the second at least 14 days before the auction, in a newspaper or other publication having general circulation in the municipality; and (b) posting a notice of auction, at least 30 days before the auction, on the affected property and at two other public places in the municipality. 2(2) The notice of auction must state (a) the date, time and location of the auction; and (b) a description of each parcel of land to be offered for sale. Conflict of interest of auctioneer and employees 3 Unless acting as an agent of a municipality in a purchase by a municipality under section 374 of the Act, the following persons must not bid for, buy, or act as an agent in buying a parcel of land offered for sale at an auction: (a) the auctioneer or a member of his or her immediate family; (b) an employee of the municipality in which the land is located or a member of his or her immediate family.
