DIV.); WHEREAS The Northern Affairs Act , being Chapter N100, of the C.C.S.M. provides in part, as follows: 5(1) . . . the Minister has the powers, rights, privileges and duties that a municipality has within its boundaries and the Minister shall exercise and perform these powers, rights, privileges and duties; 5(5) . . . where the exercise or performance of the powers, rights, privileges or duties referred to . . . requires the passing of a by-law . . . the Minister may make the by-law . . . for or on behalf of the residents of Northern Manitoba, a community or an incorporated community; 5(6) The by-law . . . may be made to apply to the whole or any part of Northern Manitoba; AND WHEREAS The Municipal Act , being Chapter M225 of the C.C.S.M. provides in part, as follows: 209(1) Subject to subsections (2) and (3), the council of a municipality may pass bylaws (a) . . . . .; (b) . . . . .; and (c) for closing any highway, . . . .; AND WHEREAS, The Planning Act , being Chapter P80 of the C.C.S.M. provides as follows: " 76(3) Lands designated as public reserves, whether in the name of the municipality or the Crown, may be closed by by-law of the municipality, subject to its approval by the Minister; 99 The Minister responsible for this Part and for those sections of this Act that apply in Northern Manitoba shall be the Minister responsible for The Northern Affairs Act ; 101(1) The following provisions of the Act apply, mutatis mutandis, to Northern Manitoba: . . . (l) Sections 75 to 79 inclusive . . ." AND WHEREAS it is deemed advisable and in the best interests of the Community of Sherridon to close certain public lands as shown outlined in bold on "Schedule A" attached to and forming part of this by-law for land planning purposes; NOW THEREFORE, the Minister of Northern Affairs enacts as follows: 1 This by-law shall provide for the closing of Public Roads, Public Lanes and Parks, Plan No. 573 PLTO (N. DIV.), legally described as follows: "All of Burgess Street, Charles Street, Dudley Street, Duncan Street, St. James Street, Raymond Street, and all those Public Lanes, Parks and portions of Jowsey Avenue and Melburn Avenue lying to the south and east of former south and east banks of Sherlett Lake on Plan 573 PLTO (N. DIV.) in 71-24 WPM." 2 This by-law shall come into effect upon filing: FIRST READING by the Community Council of Sherridon by Resolution No. 46.
