F47 Regulation 238/87 R Registered June 22, 1987 bilingual version (HTML) 1 In this regulation, "eggs" means any variety, grade or class of eggs of the domestic hen; (« œufs ») "extra-provincial board" means the Canadian Egg Marketing Agency constituted under the Farm Products Marketing Agencies Act (Canada). (« conseil extra-provincial ») 2 The Lieutenant Governor in Council hereby authorizes the extra-provincial board (a) to promote, regulate and control the marketing of eggs locally within Manitoba, and, for such purpose, to exercise all or any powers like the powers exercisable by it with respect to the marketing of eggs in inter provincial or export trade under clauses 23(1)⁠(a) and (d) of the Farm Products Marketing Agencies Act (Canada); and (b) in relation to the marketing of eggs locally within Manitoba, to conduct programs to equalize or adjust returns received by producers of eggs from the marketing of eggs by conducting surplus removal programs, and to use any levies imposed by it for the payment of expenses and losses resulting from the sale or disposal of any eggs and for the creation of reserves. 3(1) The Lieutenant Governor in Council hereby vests in the extra provincial board, in relation to the marketing of eggs locally within Manitoba, the power to make regulations (a) imposing levies payable to it, or on its behalf, on persons engaged in the production of eggs; and (b) providing for the collection as its agent of such levies and the remission thereof to it, by any person engaged in marketing eggs. 3(2) No regulation made under subsection (1) shall become effective until approved by The Manitoba Egg Producers' Marketing Board. 4 The extra-provincial board shall, at any time during normal office hours, make available to such auditor as the Minister of Agriculture may designate, all books of account, records and documents relating to the receipt of funds pursuant to this regulation and expenditures made by the extra-provincial board of monies derived in whole or in part from funds received by the extra-provincial board pursuant to this regulation. 5 This regulation does not apply to eggs produced and sold by the producer of such eggs for hatching purposes. 6 Any person who is exempt from registering with The Manitoba Egg Producers' Marketing Board under subsection 28(3) of the Manitoba Egg and Pullet Producers' Marketing Plan Regulation during the whole of a calendar year and from whom levies have been collected and paid to the extra provincial board during such calendar year may apply in writing, in the manner and in the form prescribed by the extra provincial board, for a refund of such levies paid by him and upon proof of such payment, such money shall be refunded to him. Application for a refund of any such levies paid during a calendar year may be made at any time after the end of such calendar year but the right to apply for such refund shall expire four months after the end of such calendar year.
