"general regulation" means the Apprenticeship and Certification — General Regulation , Manitoba Regulation 154/2001. (« règlement général ») "hair" means human hair of all textures. (« cheveux ») "hairstylist" means a person who performs the following tasks of the trade to the standard indicated in the occupational analysis for the trade: (a) hair and scalp care; (b) cuts hair; (c) styles hair; (d) chemical services on hair, including altering hair colour and texture; (e) specialized hair services, including services for hair extensions, wigs and hairpieces; (f) basic barbering, including colouring and shaping facial hair and side burns; (g) sanitation procedures on the tools and equipment used in the trade. (« coiffeur-styliste ») "temporary permit" means a temporary permit issued under subsection 16(1). (« permis temporaire ») "trade" means the trade of hairstylist. (« métier ») M.R. 161/2020 ; 98/2024 General regulation applies 2 The provisions of the general regulation, including the definitions, apply to the trade unless they are inconsistent with a provision of this regulation. Designation of trade 3 The trade of hairstylist is designated a compulsory certification trade. Ancillary activities 4 When working in the trade, the following activities come within the trade: (a) performing a manicure on natural nails; (b) removing superfluous facial hair above the neck using depilatory methods; (c) performing treatments on a person's scalp, face and neck, including shaping eyebrows and applying make-up; (d) using personal protective equipment appropriate to the risks associated with handling chemicals used in the trade; (e) caring for tools and equipment used in the trade. M.R. 98/2024 Who may work in the trade 5 A person must not work in the trade unless the person (a) holds a valid certificate of qualification or a temporary permit; or (b) is engaged in an apprenticeship program. M.R. 161/2020 Transition — valid authorization deemed certificate 5.1 A person who holds a valid authorization to practice in the trade on the day before this section comes into force is deemed to hold a valid certificate of qualification. M.R. 161/2020 Exclusions 6 A person is deemed not to be working in the trade when the person (a) performs braiding and weaving techniques on a person's hair or on hair extensions without the use of any chemicals or cutting tools; (b) services wigs, hairpieces and hair extensions without cutting or colouring a person's natural hair; or (c) performs a task of the trade (i) while participating in a training program in the trade provided by a training provider, (ii) while demonstrating a hair product for the purpose of selling the product, or (iii) that the person is authorized to perform under another enactment. M.R. 98/2024 Eligibility requirements for apprenticeship 7(1) The executive director may register an apprenticeship agreement in the trade only if the person who wishes to become an apprentice (a) meets the requirements of section 3 of the general regulation; and (b) has completed, or is enrolled in, a training program in the trade provided by a training provider that consists of at least 1,400 hours. 7(2) To become a high school apprentice in the trade, a person must meet the requirements of section 3 of the general regulation and be concurrently enrolled in an accredited hairstylist training program at a high school. Term of apprenticeship 8(1) Apprenticeship in the trade is two levels, with (a) a first level consisting of at least 12 months during which the apprentice must complete 1,800 hours of practical experience and technical training; and (b) a second level consisting of at least 12 months during which the apprentice must complete 1,800 hours of practical experience. 8(2) Despite subsection (1), section 8 as it read immediately before the coming into force of section 5 of the Trade of Hairstylist Regulation, amendment , continues to apply to a person who is a party to an apprenticeship agreement registered under subsection 7(1) before October 30, 2024. M.R. 98/2024 Credit for prior learning 9(1) Before granting credit for prior learning to a prospective apprentice under section 18 of the general regulation, the executive director may require the person to provide documentation, in a form acceptable to the executive director, of the practical experience and technical training that the person has completed and for which he or she requests credit. 9(2) No credit for prior learning granted under section 18 of the general regulation may shorten the term of apprenticeship in the trade. 10 [Repealed] M.R. 161/2020 Certification examinations 11 The certification examination for the trade consists of a written interprovincial examination and a provincial practical examination. The executive director may establish when an apprentice is to take each examination. Requirement for certificate of qualification 12 Before issuing a certificate of qualification in the trade to a person, the executive director must be satisfied the person has (a) completed and attained a satisfactory grade in all aspects of a training program described in subsection 7(1); and (b) met the requirements of section 21 of the general regulation. 13 to 15 [Repealed] M.R. 161/2020 Temporary permits 16(1) The executive director may issue a temporary permit to a person who is (a) awaiting the opportunity to take a prescribed examination; or (b) awaiting a decision of the executive director or an appeal board; (c) [repealed] M.R. 161/2020 . 16(2) To be issued a temporary permit, a person must file an application with the executive director. 16(3) A temporary permit may not be issued for a period exceeding six months. 16(4) A person holding a temporary permit may apply to have it renewed by filing an application for renewal with the executive director at least 30 days before his or her existing permit expires. M.R. 161/2020 ; 98/2024 Certificates and permits must be available on request 17 A person who is working in the trade must provide their valid certificate of qualification, temporary permit, or proof of apprentice status for inspection upon request. M.R. 161/2020 Cancellation or suspension of certificate, etc. 18 The executive director may cancel or suspend a person's certificate of qualification or temporary permit if the executive director is of the opinion that the person is working in the trade in contravention of The Apprenticeship and Certification Act or any regulation made under that Act. M.R. 161/2020 ; 98/2024 Repeal 19 The Trade of Hairstylist Regulation , Manitoba Regulation 104/2006, is repealed. Coming into force 20 This regulation comes into force 60 days after it is registered under The Statutes and Regulations Act .
