A80 Regulation 309/88 R Registered August 29, 1988 bilingual version (HTML) Table of Contents Section 1 Duty of authorized person 2-3 Duties of inspector 4 Property of deceased 5 Report of inspector 6 Duties of sub-inspector 7 Authorized persons 8 Burial of bodies not required 9-10 Religious service 11 Fees 12 Burial permits Duty of authorized person 1 Each authorized person to whom the body of a deceased person is delivered shall keep a register and enter in it, so far as known to him or her, the following particulars: (a) the full name, age, sex, racial origin and religion of the deceased, and any obvious marks of identification; (b) the date, place, and cause, of death of the deceased; (c) the date of the receipt of the body by the authorized person; (d) the name of the inspector or sub-inspector from whom the body was received; (e) the date upon which the body was first used for anatomical or other scientific requirement; (f) the date and place of interment of the remains. 1(2) The inspector or any sub-inspector may inspect the register at any reasonable time. Duties of inspector 2(1) The inspector shall keep a general record for the province and enter in it, so far as known to the inspector, respecting each deceased person whose body comes under his or her control, the following particulars: (a) name in full; (b) age; (c) sex; (d) birth place; (e) nationality; (f) religion; (g) date and place of death; (h) cause of death; (i) name of hospital or institution, if any, in which the deceased died; (j) name of the physician, if any, attending the deceased at the time of death; (k) the period the body was held before delivery thereof; (l) the name of the authorized person or other person, corporation, association, or institution, to whom the body was delivered; (m) the date and place of the delivery of the body; and (n) a general description of the clothing and effects of the deceased that come into possession or under the control of the inspector. 2(2) The inspector shall provide and maintain an up-to-date alphabetical index to the record. 3 The inspector shall, in respect of any division or section that is under his or her immediate supervision, perform the duties charged upon a sub-inspector under section 6. Property of deceased 4 Where the body of a deceased person comes under the control of an inspector or sub-inspector, and any money, personal effects, documents, papers, or other personal estate of the deceased comes into the possession or under the control of the inspector or sub-inspector, he or she shall forthwith send a written statement of the facts to the chief constable, or other officer in command of the police force of the municipality, district, or place in which the deceased died, and shall, as soon as possible, deliver or cause to be delivered to the chief constable or officer in command the money, personal effects, documents, papers, or other personal estate, or the custody or control thereof. Report of inspector 5 The inspector shall, on or before December 31 in each year, make to the minister a general report on his or her operations since the date of the last preceding report. Duties of sub-inspector 6(1) Each sub-inspector shall (a) make a record in duplicate of the like particulars, so far as they are known to him or her, to those set out in subsection 2(1), in respect of each deceased person whose body comes under his or her control; (b) deliver to the inspector one of the duplicate originals of the record referred to in clause (a); (c) keep a record of the name of every authorized person of whom he or she has notice; (d) periodically, and not less than once in each year, inspect every building, premises, or place, within his or her division or section in which any body or part of a body is being used for the purposes of anatomical or other scientific instruction or requirements; (e) furnish to the inspector, on demand, a copy of any record in the sub-inspector's possession relating to his or her duties under the Act, and any information relating to those duties that the inspector may require; and (f) forthwith upon appointment, give written notice of that appointment, stating his or her address, to every authorized person of whom the sub-inspector has notice, and to every superintendent or other head of a hospital or institution in his or her division or section, and to every other person who is required under section 16 of the Act to give notice to the sub-inspector. 6(2) At any reasonable time, the inspector may inspect any records in the custody or control of any sub-inspector, and any medical examiner having authority in the division or section of a sub-inspector may inspect any records in the custody or control of that sub-inspector. Authorized persons 7(1) Any institution or duly qualified medical practitioner desiring to be authorized to receive delivery of the bodies of dead persons for the purposes of anatomical or other scientific instructions or requirements, may apply to the minister in writing for the purpose and the minister, if satisfied that it is desirable that the authorization should be granted, may by an order in writing grant it. 7(2) An institution or person to whom authorization is granted under subsection (1) shall use every body delivered to it, him or her solely for the purpose of anatomical or other scientific instruction or requirements, and in accordance with the Act and this regulation. 7(3) The minister may, at any time, by an order in writing, revoke an authorization granted under subsection (1) with or without assigning cause for the revocation. 7(4) The minister shall cause every order granting or revoking an authorization under this section to be published in one issue of The Manitoba Gazette and shall send a copy of it to the inspector, who shall send a copy to each sub-inspector. Burial of bodies not required 8(1) Where the body of a dead person that is under the control of an inspector or sub-inspector is not required by any authorized person, the inspector or sub-inspector shall cause the body to be properly interred. 8(2) The cost of an interment made under this section, if no other arrangements therefor are made, may be charged to The Department of Health but any such cost may be recovered by the minister from any person legally liable to pay it, as a debt due to the minister by that person. Religious service 9 Subject to section 10, where, under the Act or this regulation, a body is required to be properly interred, the interment shall include a religious service and, where the authorized person or the inspector, sub-inspector, or person responsible for the interment, knows or can readily ascertain the religion of the person whose body is to be interred, the interment shall be conducted by a minister, clergyman, priest, or other officer or person authorized to conduct burial services, according to the rites of that religion. 10 Where, under the Act, a waiver or renunciation of claim has been given in respect of a body, and the waiver or renunciation of claim includes a statement to the effect that a religious service is not required or desired in connection with the burial or interment of the body, section 9 does not apply. Fees 11(1) The fees payable under the Act are as follows: (a) to the inspector or sub-inspector in respect of each body that comes under his or her control, on the release or delivery of that body to any person: $10.; (b) to the inspector on the delivery of a bodyto an authorized person, in addition to the fee payable under clause (a): $2.50. 11(2) Where a fee is payable under clause (1)⁠(b) in respect of a body delivered to an authorized person other than The University of Manitoba, any fee paid to a sub-inspector shall be sent to the inspector. 11(3) Where fees are payable to a sub-inspector by The University of Manitoba, the sub-inspector, instead of collecting the fees on delivery of the body, shall notify the inspector of the amount so payable. 11(4) The inspector shall each month send to The University of Manitoba a statement of any fees that are due and payable to the inspector or to any sub-inspector by the University. Burial permits 12(1) Where a body comes under the control of an inspector or sub-inspector, he or she shall forthwith obtain the burial permit from the person registering the death of the deceased. 12(2) Where the body is delivered to any person claiming it or to an authorized person, the inspector or sub-inspector shall, at the same time, deliver the burial permit to that person, who shall retain it until the remains are interred. 12(3) An inspector or sub-inspector who causes a body to be interred, shall deliver the burial permit, or cause it to be delivered, to the sexton or other person in charge of the place of burial as required by The Vital Statistics Act .
