NEWFOUNDLAND AND LABRADOR REGULATION 85/18 Presence and Prohibited Proportion of Drugs Regulations under the Highway Traffic Act (O.C. 2018-200) (Filed October 4, 2018) Under the authority of section 186 of the Highway Traffic Act, the Lieutenant-Governor in Council makes the following regulations. Commencement Short title 1. These regulations may be cited as the Presence and Prohibited Proportion of Drugs Regulations . 85/18 s1 Back to Top Definitions 2. In these regulations, "Act" means the Highway Traffic Act . 85/18 s2 Back to Top Presence 3. Any detectable level of the following drugs constitutes the presence of that drug for the purpose of sections 60.002, 60.003 and 60.5 of the Act and section 6.1 of the Vehicle Seizure and Impoundment Regulations, 2012 : (a) c ocaine; and (b) tetrahydrocannabinol, also known as THC. 85/18 s3 Back to Top Proportions prohibited 4. The following proportions of drugs and combinations of drugs and alcohol are prescribed for the purpose of sections 60.004 and 60.5 of the Act: (a) 5 milligrams of g ammahydroxybutyrate, also known as GHB, per litre of blood; (b) 5 nanograms of tetrahydrocannabinol, also known as THC, per millilitre of blood; (c) 2.5 nanograms of tetrahydrocannabinol, also known as THC, per millilitre of blood and 50 milligrams or more of alcohol per 100 millilitres of blood; and (d) any detectable level in the body or blood of (i) c ocaine, (ii) k etamine, (iii) lysergic acid diethylamide, also known as LSD, (iv) m ethamphetamine, (v) p hencyclidine, also known as PCP, (vi) p silocin, (vii) p silocybin, or (viii) 6–monoacetylmorphine. 85/18 s4 Back to Top Commencement 5.
