The definitions "Act" and "Minister" and "regional office" in section 1.1 are repealed. 2. A reference to "employee" or "employees" shall be read as a reference to "worker" or "workers", as the case may be, and a reference to "an employee" shall be read as a reference to "a worker". 3. The reference in the following provisions to "province" shall be read as a reference to "province or territory": (a) the definition "first aid attendant" in section 1.1"; (b) subparagraphs (c)(i) and (ii) of the definition "medic" in section 1.1"; (c) the definition "inspector" in section 6.1; (d) paragraph 11.46(a). 4. Section 1.2 is repealed. 5. Section 1.3 is repealed and the following substituted: 1.3. These regulations apply in respect of workers engaged on or in connection with exploration or drilling for or the production, conservation, processing or transportation of oil or gas which is governed by the Oil and Gas Operations Act. 6. The reference in section 1.4 to "referred to in section 125 or 125.1 of the Act" shall be read as a reference to "under the Act". 7. Part II is repealed. 8. The reference in the following provisions to "the safety and health committee or the safety and health representative, if either exists" shall be read as a reference to "the Joint Work Site and Safety Committee": (a) section 1.4; (b) paragraph 11.3(1)(b); (c) that portion of section 11.4 preceding paragraph (a); (d) subsection 11.19(1); (e) that portion of subsection 11.36(1) preceding paragraph (a); (f) that portion of subsection 11.36(2) preceding paragraph (a); (g) paragraph 11.36(2)(b); (h) paragraph 16.3(1)(c); (i) subsection 16.3(3); (j) that portion of subsection 16.4(1) preceding paragraph (a); (k) paragraph 16.4(2)(b). 9. The reference in the following provisions to "regional safety officer" shall be read as a reference to "Chief Safety Officer": (a) section 6.7; (b) paragraph 8.2(3)(a); (c) paragraph 16.4(2)(a); (d) section 16.5; (e) subsection 16.8(1). 2 ANNEXE (article 1) 1. The reference in that portion of subsection 11.9(3) preceding paragraph (a) to "the safety and health committee or the safety and health representative, if any" shall be read as a reference to "the Joint Work Site and Safety Committee". 15. The reference in subsection 11.28(1) to "the Bureau of Radiation and Medical Devices of the Department of National Heath and Welfare" shall be read as a reference to "the appropriate branch or division of the federal Department of Health". 16. The reference in the following provisions to "the Hazardous Products Act" shall be read as references to "the Hazardous Products Act (Canada)": (a) the definitions "supplier label" and "supplier material safety data sheet" in section 11.31; (b) subparagraph 11.33(c)(v). 17. The reference in subparagraph 11.33(c)(i) to "the Explosives Act" shall be read as a reference to "the Explosives Act (Canada)". 18. The reference in subparagraph 11.33(c)(ii) to "the Food and Drugs Act" shall be read as a reference to "the Food and Drugs Act (Canada)". 19. Subsection 11.35(1) is repealed and the following is substituted: 11.35. (1) Subject to section 11.44, where an employer produces a controlled product, other than a fugitive emission, in a work place or imports into Canada a controlled product and brings it into a work place, the employer shall prepare a work place material safety data sheet that discloses, with respect to the controlled product, (a) the following information: (i) if the controlled product is a pure substance, its chemical identity, and if it is not a pure substance, the chemical identity of any ingredient of it that is a controlled product and the concentration of that ingredient, (ii) if the controlled product contains an ingredient that is included in the Ingredient Disclosure List and the ingredient is in a concentration that is equal to or greater than the concentration specified in the Ingredient Disclosure List for that ingredient, the chemical identity and concentration of that ingredient, (iii) the chemical identity of any ingredient of the controlled product that the employer believes on reasonable grounds may be harmful to a worker and the concentration of that ingredient, (iv) the chemical identity of any ingredient of the controlled product the toxicological properties of which are not known to the employer and the concentration of that ingredient, (v) any other information with respect to the controlled product that may be prescribed; and (b) the information required to be disclosed by the Controlled Products Regulations, SOR/88-66, made under the Hazardous Products Act (Canada). 22. Subparagraph 11.35(3)(b)(i) is repealed and the following is substituted: (i) subparagraphs 11.35(1)(a)(i) to (v), and 23. Paragraph 11.36(2)(c) is repealed and the following is substituted: (c) on the request of a worker or the Joint Work Site and Safety Committee, makes the material safety data sheet readily available to the worker or the Joint Work Site and Safety Committee. 24. The references in the following provisions to "the Hazardous Materials Information Review Act" shall be read as references to "the Hazardous Materials Information Review Act (Canada)": (a) that portion of subsection 11.44(1) preceding paragraph (a); (b) paragraph 11.44(1)(a). 25. Section 11.46 and the subheading "Information Required in a Medical Emergency" preceding section 11.46 are repealed. 6 21. Le paragraphe 11.35(1) est abrogé et remplacé par ce qui suit : 11.35. (1) Sous réserve de l’article 11.44, l’employeur qui fabrique dans le lieu de travail un produit contrôlé autre qu’une émission fugitive ou qui importe au Canada un produit contrôlé et l’apporte au lieu de travail doit préparer pour ce produit une fiche signalétique du lieu de travail qui divulgue, en rapport avec ce produit contrôlé, a) les renseignements suivants, selon le cas : (i) si le produit contrôlé est une substance pure, sa dénomination chimique et, dans le cas contraire, la dénomination chimique et la concentration de tout ingrédient qui est lui-même un produit contrôlé, (ii) la dénomination chimique et la concentration d’un ingrédient de produit contrôlé inscrit sur la liste de divulgation des ingrédients, si cette concentration est égale ou supérieure à celle qui est inscrite sur cette liste pour cet ingrédient, (iii) la dénomination chimique et la concentration d’un ingrédient que le fournisseur croit, en se fondant sur des motifs raisonnables, nocif pour les personnes physiques; (iv) la dénomination chimique et la concentration d’un ingrédient dont les propriétés toxicologiques ne sont pas connues du fournisseur, (v) les autres renseignements, prévus par règlement, relatifs au produit contrôlé; b) les renseignements exigés en vertu du Règlement sur les produits contrôlés DORS/88-66, pris en application de la Loi sur les produits dangereux (Canada). 22. Le sous-alinéa 11.35(3)b)(i) est abrogé et remplacé par ce qui suit : (i) ceux exigés aux sous-alinéas 11.35(1)a)(i) à (v), 23. L’alinéa 11.36(2)c) est abrogé et remplacé par ce qui suit : c) sur demande d’un employé ou du Comité mixte d’hygiène et de sécurité au travail, il rend la fiche signalétique facilement accessible à cet employé ou à ce comité. 24. Le renvoi à «Loi sur le contrôle des renseignements relatifs aux matières dangereuses» vaut renvoi à «Loi sur le contrôle des renseignements relatifs aux matières dangereuses (Canada)» dans les dispositions suivantes : a) dans la partie introductive du paragraphe 11.44(1); b) à l’alinéa 11.44(1)a). 25. L’article 11.46 et l’intertitre «Renseignements requis en cas d’urgence médicale» situé immédiatement avant l’article 11.46 sont abrogés. 7 26. Sections 18.16 and 18.17 are repealed and the following is substituted: 18.16. (1) In this section, "impaired" means a deteriorated or weakened state of judgment, physical abilities, or both, as a result of fatigue, illness, alcohol or drugs, that causes a departure from the normal abilities required to safely complete a worker’s duties. (2) No worker shall enter or remain in a work site if the worker is impaired. (3) No employer shall permit a worker to enter or remain in a work site if the worker is impaired. (4) All workers must inform the employer if they are impaired. (5) An employer shall, in consultation with the Committee or representative, or, if no Committee or representative is available, the workers, develop, maintain and make readily available to workers, a written policy regarding impairment that includes (a) the duties of workers with respect to identification and reporting of impairment; (b) the duties of employers with respect to identification of impairment, worker protection and corrective action respecting workers in breach of the policy; (c) a policy implementation plan; (d) a hazard identification and assessment methodology; (e) preventive measures to be undertaken by employers and workers; (f) worker education programs; and (g) a policy evaluation mechanism. (5) L’employeur, en consultation avec le comité ou un représentant ou, si le comité ou un représentant n’est pas disponible, avec les travailleurs, élabore, maintient et rend facilement accessible aux travailleurs une politique écrite concernant les facultés affaiblies qui comprend les éléments suivants : a) les obligations des travailleurs en ce qui concerne l’identification de facultés affaiblies et l’obligation de les signaler; b) les obligations des employeurs en ce qui concerne l’identification de facultés affaiblies, la protection des employés et les mesures correctives à l’égard des travailleurs qui agissent en violation de la politique; c) un plan en ce qui concerne la mise en oeuvre de la politique; d) une méthodologie en ce qui concerne l’identification et l’évaluation des risques; e) les mesures préventives devant être entreprises par les employeurs et les travailleurs; f) les programmes de formation des travailleurs; g) un mécanisme d’évaluation de la politique.
