This bylaw may be cited as the "Land Administration Bylaw". INTERPRETATION 2. In this bylaw: (a) "Community Government" means the Community Government of Wekweètì which is represented by the Senior Administrative Officer or his or her designate, except when decisions of Council are required; (gouvernement communautaire) (b) "Council" means the Council of the Community Government; (conseil) (c) "development" means the construction or placing of the necessary municipal infrastructure on or about lands to allow improvements to be built or installed thereon; (aménagement) (d) "development costs" means the costs directly incurred by the Community Government in developing land, including, but not limited to, the costs of (i) planning and engineering design, (ii) geomatics, (iii) project management, (iv) road construction, (v) land fill, (vi) open spaces, (vii) piped water and sewage lines, (viii) electrical distribution lines (and poles), (ix) legal surveys, (x) land acquisition and disposal costs, and (xi) financing charges, including interest, for any loans incurred in developing the land; (coûts d’aménagement) (e) "disposal" means the sale, lease, or other disposition of land; (aliénation) (f) "land use plan" means the land use plan adopted by resolution of the Council; (plan d’aménagement du territoire) (g) "lot" means a parcel of land for which development costs have been incurred; (parcelle) (h) "lot price" means the value of the lot as determined by the Community Government; (prix de la parcelle) (i) "Minister" means the Minister of Municipal and Community Affairs; (ministre) (j) "new lots" means vacant lots which are developed after the date of this bylaw; (nouvelle parcelle) (k) "off-site levy" means a surcharge made (at the time of lease execution) by the Community Government to the lessee of community lands to assist in the payment of all or part of the capital costs of new or expanded infrastructure, including land, such infrastructure being located outside the lands being leased, but of direct, though not exclusive, benefit to the lessee; (droits sur les infrastructures annexes) (l) "property taxes" includes interest and penalties; (impôt foncier) (m) "replacement cost" means the estimated development costs for a parcel of land, updated to the current year, representing the costs to develop a similar lot and incorporating site-specific factors; (coût de remplacement) 2 ANNEXE (article 1) RÈGLEMENT MUNICIPAL SUR L’ADMINISTRATION DE BIENS-FONDS DE WEKWEÈTÌ TITRE ABRÉGÉ 1. Titre abrégé : Règlement municipal sur l’administration de biens-fonds. DÉFINITIONS 2. Dans le présent règlement municipal : a) «Accord tåîchô» Désigne l’Accord sur les revendications territoriales et l’autonomie gouvernementale conclu entre le peuple tåîchô, le gouvernement des Territoires du Nord-Ouest et le gouvernement du Canada et signé le 25 août 2003; (Tåîchô Agreement) b) «aliénation» S’entend du fait d’aliéner un bien-fonds, notamment en le vendant ou en le cédant à bail; (disposal) c) «aménagement» S’entend de la construction ou de la mise en place sur des biens-fonds ou près de ceux-ci, des infrastructures municipales nécessaires à la construction ou à l’installation d’améliorations sur ces biens-fonds; (development) d) «conseil» S’entend du conseil du gouvernement communautaire; (Council) e) «coûts d’aménagement» S’entend des frais directement engagés par le gouvernement communautaire pour l’aménagement de biens-fonds, notamment ceux ayant trait : (i) à la planification et à l’ingénierie, (ii) aux travaux géomatiques, (iii) à la gestion de projet, (iv) à la construction routière, (v) aux lieux de décharge, (vi) aux espaces ouverts, (vii) aux conduites d’eau et aux canalisations d’égouts, (viii) aux lignes (et poteaux) de distribution électrique, (ix) à l’arpentage légal, (x) aux frais d’acquisition et d’aliénation de biens-fonds, (xi) aux frais de financement relatifs aux prêts contractés au titre de l’aménagement de bien-fonds, notamment aux intérêts sur ces prêts; (development costs) f) «coût de remplacement» S’entend des coûts estimatifs d’aménagement d’une parcelle, mis à jour pour l’année en cours, censés représenter ce qu’il en coûterait pour aménager une parcelle similaire et tenant compte de facteurs particuliers au site; (replacement cost) g) «droits sur les infrastructures annexes» S’entend de la surcharge imposée par le gouvernement communautaire au preneur à bail de terres communautaires au moment de la passation du bail en vue du paiement de tout ou partie des coûts d’immobilisation liés à la construction ou à l’agrandissement d’infrastructures – y compris le coût des bien-fonds – situées à l’extérieur des terres visées par le bail mais dont le preneur à bail tire un avantage direct, quoique non exclusif; (off-site levy) h) «facteurs particuliers au site» S’entend des facteurs pouvant servir, s’il y a lieu, à ajouter ou à soustraire jusqu’à 25 % des coûts d’aménagement de nouvelles parcelles ou du coût de remplacement de parcelles aménagées, et pouvant notamment comprendre : (i) la taille de la parcelle, (ii) l’état du site, (iii) l’intérêt de l’emplacement, (iv) l’usage actuel des biens-fonds adjacents, (v) l’utilisation projetée du bien-fonds, (vi) le zonage. 3 (n) "site-specific factors" mean factors which may be used, where applicable, in adding or subtracting up to 25% of the development costs of new lots or the replacement costs for existing developed lots, and which may be composed of (i) size of land parcel, (ii) site conditions, (iii) desirability of location, (iv) existing adjacent land uses, (v) proposed land use, and (vi) zoning. (facteurs particuliers au site) The addition of site-specific factors for new lots shall not exceed development cost for the entire subdivision; (o) "Tåîchô Agreement" means the Land Claims and Self-Government Agreement among the Tåîchô and the Government of the Northwest Territories and the Government of Canada, signed on August 25, 2003; (Accord tåîchô) (p) "Tåîchô community lands" means, in relation to the Community Government, the lands in that community other than any parcel to which the Community Government does not hold the fee simple interest; (terres communautaires tåîchôs) (q) "zoning bylaw" means the zoning bylaw as adopted by Council. (règlement municipal de zonage) APPLICATION OF THE BYLAW 3. This bylaw shall apply to all acquisitions, leases or other dispositions of lands by the Community Government. 4. In accordance with section 9.3.6(b) of the Tåîchô Agreement, no sale of Tåîchô community lands can be made before August 4, 2025. EXISTING LEASES 5. The Community Government shall assume the landlord’s interest in any lease of the Tåîchô community lands issued before August 4, 2005 by either the Government of the Northwest Territories or the Government of Canada or by the Dogrib Treaty 11 Council to the Government of the Northwest Territories under section 9.1.3 of the Tåîchô Agreement, and shall have the benefit of and be subject to the terms and conditions of each such lease. 6. A holder of a lease referred to in section 5 may apply for a new lease under this bylaw and voluntarily cede the existing lease as assumed by the Community Government. PRECONDITIONS TO ACQUISITION AND DISPOSAL OF LAND 7. Neither the Community Government nor any authorized representative of the Community Government shall make or enter into any offer, agreement or other arrangement for the acquisition, sale, lease or other disposition of lands except by Council resolution, and each such Council resolution shall contain (a) a complete legal description of the lands to be acquired, sold, leased or otherwise disposed of or, in the absence of an available legal description, an acceptable sketch of the lands on an approved community map; and (b) the terms and conditions, if any, upon which the lands shall be acquired, sold, leased or otherwise disposed of. 4 Étant entendu que dans le cas des nouvelles parcelles, l’ajout de facteurs particuliers au site ne peut dépasser le coût d’aménagement du terrain loti; (site-specific factors) i) «gouvernement communautaire» S’entend du gouvernement communautaire de Wekweètì représenté – sauf dans les cas où une décision du conseil est requise – par le directeur général ou son délégué; (Community Government) j) «impôt foncier» S’entend également des intérêts et des pénalités; (property taxes) k) «ministre» Désigne le ministre des Affaires municipales et communautaires; (Minister) l) «nouvelle parcelle» S’entend d’une parcelle non bâtie dont l’aménagement a lieu après la date d’entrée en vigueur du présent règlement municipal; (new lots) m) «parcelle» S’entend d’une parcelle de terrain à l’égard de laquelle des coûts d’aménagement ont été engagés; (lot) n) «plan d’aménagement du territoire» S’entend d’un plan d’aménagement du territoire adopté par résolution du conseil; (land use plan) o) «prix de la parcelle» S’entend de la valeur déterminée par le gouvernement communautaire pour une parcelle; (lot price) p) «règlement municipal de zonage» Désigne le règlement municipal de zonage pris par le conseil; (zoning bylaw) q) «terres communautaires tåîchôs» S’entend, relativement au gouvernement communautaire, des terres de la collectivité, à l’exclusion de celles à l’égard desquelles le gouvernement communautaire ne détient pas d’intérêt en fief simple. (tåîchôs community lands) CHAMP D’APPLICATION 3. Le présent règlement municipal s’applique à toute acquisition et à toute disposition de biens-fonds – notamment la cession à bail – faites par le gouvernement communautaire. 4. Conformément à l’alinéa 9.3.6b) de l’Accord tåîchô, les terres communautaires tåîchôs ne peuvent être vendues avant le 4 août 2025. BAUX EXISTANTS 5. Est dévolu au gouvernement communautaire l’intérêt du bailleur dans tous les baux visant des terres communautaires tåîchôs consentis avant le 4 août 2005 par le gouvernement des Territoires du Nord-Ouest ou le gouvernement du Canada ou encore, par le conseil des Dogrib visés par le traité no 11 en faveur du gouvernement des Territoires du Nord-Ouest aux termes de l’article 9.1.3 de l’Accord tåîchô. Le gouvernement communautaire profite de ces baux et est assujetti à leurs conditions et modalités. 6. Le titulaire d’un bail visé à l’article 5 peut demander à ce qu’un nouveau bail lui soit consenti sous le régime du présent règlement municipal et céder volontairement le bail existant assumé par le gouvernement communautaire. CONDITIONS PRÉALABLES À L’ACQUISITION OU À L’ALIÉNATION DE BIENS-FONDS 7. Ni le gouvernement communautaire ni son représentant autorisé ne peut présenter une offre ou conclure une entente ou une autre forme d’arrangement visant l’acquisition, la vente, la cession à bail ou toute autre disposition d’un bien- fonds, sauf par résolution du conseil, laquelle doit contenir les éléments suivants : a) une description officielle complète du bien-fonds devant faire l’objet de l’acquisition, de la vente, de la cession à bail ou de la disposition ou, si aucune description officielle n’est disponible, un croquis acceptable du bien-fonds tracé sur une carte de la collectivité approuvée; b) les conditions d’acquisition, de vente, de cession à bail ou de disposition du bien-fonds, s’il en existe. 5 8. No Council resolution for the acquisition, sale, lease or other disposition of land, shall be made until (a) it has been established through a search at the appropriate Land Registry Office, that the Community Government may lawfully acquire, sell, lease or otherwise dispose of the lands; (b) an inspection of the lands has been conducted to determine (i) if the lands are occupied, (ii) if there are any improvements situate on the lands, (iii) if there are any easements affecting the lands, (iv) such other information as Council may, in its discretion, consider to be relevant; and (c) the Senior Administrative Officer has advised Council as to the value of the lands and any improvements situated thereon, and has confirmed that the proposed use of the lands complies with the zoning bylaw or land use plan in effect in the Community Government. LAND INVENTORY 9. The Community Government shall, on or before August 4, 2006, keep an inventory of all Tåîchô community lands containing (a) a description of the Tåîchô community lands, including a full legal description if available; (b) the location of the tåîchô community lands within the community; (c) the terms and conditions upon which the Tåîchô community lands may be leased or otherwise disposed of, including the means of disposal; and (d) an indication of whether the Tåîchô community lands have been leased or otherwise disposed of, or whether there is a pending lease or other disposition of the lands. 10. The inventory kept pursuant to section 9 of this bylaw shall be open to inspection by the public at the Community Government office during normal business hours. PUBLIC NOTICE OF LAND DISPOSAL AND ACQUISITION 11. A sale of Community Government land may only be made in accordance with section 9.3 of the Tåîchô Agreement. 12. The Community Government shall not acquire, sell, lease or otherwise dispose of lands until it has published a notice of such proposed sale, lease or other disposition by notice posted in three prominent places in the community for a period of two weeks in advance of the application being presented to Council for consideration. Each advertisement or notice must contain (a) a sketch, drawn to scale, identifying the size and location of the lands to be sold, leased or otherwise disposed of; (b) the consideration for which the lands may be sold, leased or otherwise disposed of; and (c) an indication as to the method to be employed in selling, leasing or otherwise disposing of lands. 6 8. Aucune résolution du conseil visant l’acquisition, la vente, la cession à bail ou toute autre disposition d’un bien- fonds ne peut être prise avant l’accomplissement des actes suivants : a) il est établi, au moyen d’une recherche effectuée au bureau d’enregistrement des titres de biens-fonds approprié, que le gouvernement communautaire peut légalement acquérir, vendre ou céder à bail le bien- fonds, ou en disposer autrement; b) le bien-fonds a été inspecté afin de déterminer : (i) s’il est occupé, (ii) si des améliorations s’y trouvent, (iii) si des servitudes le grèvent, (iv) tout autre renseignement que le conseil estime, à sa discrétion, indiqué; c) le directeur général a informé le conseil quant à la valeur du bien-fonds et des améliorations qui s’y trouvent et a confirmé que l’utilisation projetée du bien-fonds est conforme au règlement municipal sur le zonage ou au plan d’aménagement du territoire en vigueur pour le gouvernement communautaire. INVENTAIRE DES BIENS-FONDS 9. Au plus tard le 4 août 2006, le gouvernement communautaire dresse et tient à jour un inventaire de toutes les terres communautaires tåîchôs comportant les renseignements suivants : a) la description des terres communautaires tåîchôs, y compris la description légale complète, si celle-ci est disponible; b) l’emplacement de ces terres dans la collectivité; c) les modalités et les conditions applicables à la cession à bail de ces terres ou à leur disposition, y compris le mode de disposition; d) s’il y a lieu, une mention selon laquelle les terres ont été cédées à bail ou ont fait l’objet d’une autre disposition ou selon laquelle la cession à bail ou la disposition des terres est en cours de négociation. 10. L’inventaire tenu suivant l’article 9 du présent règlement municipal peut être consulté par les membres du public durant les heures normales de bureau. AVIS PUBLIC DE L’ACQUISITION OU DE L’ALIÉNATION DE BIENS-FONDS 11. La vente d’une terre du gouvernement communautaire ne peut se faire qu’en conformité avec l’article 9.3 de l’Accord tåîchô. 12. Le gouvernement communautaire ne peut procéder à l’acquisition, à la vente, à la cession à bail ou à toute autre disposition de biens-fonds avant d’avoir affiché un avis public à cet effet à trois endroits bien en vue de la collectivité pendant une période de deux semaines précédant la présentation de la demande au conseil. Chaque avis public doit comporter les éléments suivants : a) un croquis à l’échelle indiquant la taille et l’emplacement du bien-fonds devant faire l’objet de la vente, de la cession à bail ou de la disposition; b) une mention de la contrepartie qui sera reçue au titre de la vente, de la cession à bail ou de la disposition du bien-fonds; c) une mention de la méthode de vente, de cession à bail ou de disposition à laquelle on aura recours. 7 APPLICATIONS FOR LAND 13. The Community Government shall only accept a written application for Tåîchô community land. This application must contain, but is not limited to (a) the legal name of the applicant or applicants; (b) the legal description of the land or an acceptable sketch; (c) the purpose for which the land is to be used; (d) a request, if applicable, for joint tenancy or tenancy-in-common; (e) the signature of the applicant or applicants; (f) an application fee of $50; (g) declaration of residency, if required; and (h) declaration of any monies owing to the Community Government. 14. Council shall set, by resolution, an application administration fee that will recover all of the Community Government’s costs related to the processing of the application. 15. The Community Government shall, within 60 days after the receipt of a complete application, notify the applicant by registered mail whether the application is approved or rejected. 16. Where the application is approved, the application fee minus the application administration fee will be applied to the first year’s payment. 17. The successful applicant has 21 days after the mailing of approval notification to sign the lease and pay the remainder of all required fees. If the applicant fails to comply, the application is rejected, and the application fee minus the application administration fee will be refunded to the applicant. No lease documents will be completed until all of the required fees are received. 18. Where the application is rejected, the application fee minus the application administration fee will be refunded to the applicant. TERMS AND CONDITIONS OF LAND DISPOSALS 19. The standard term of all Tåîchô community land leases is 30 years. Council may, in its discretion, enter into a lease of Tåîchô community lands for a term shorter or longer than 30 years, based on the nature and value of the improvements to be constructed on such land. The Community Government shall not grant an interest in Tåîchô community lands for a term exceeding 99 years or an interest arising 99 years or more after the grant, except with the approval of the voters pursuant to section 53 of the Tåîchô Community Government Act and section 9.3.6 of the Tåîchô Agreement. 20. The Community Government shall, in leasing or otherwise disposing of land for residential purposes, ensure that prospective private home owners have preference over land applicants who wish to acquire more than one lot at a time, except when lots are required by (a) the Federal, Territorial or Tåîchô Government or the Tåîchô Community Services Agency; or (b) the Northwest Territories Housing Corporation. 8 DEMANDES VISANT DES BIENS-FONDS 13. Le conseil fixe, par résolution, le montant des frais administratifs applicables lors de la présentation d’une demande de façon à permettre le recouvrement des frais supportés par le gouvernement communautaire pour traiter la demande. 15. Dans les 60 jours suivant la réception d’une demande complète, le gouvernement communautaire avise le demandeur par courrier recommandé du refus ou de l’acceptation de sa demande. 16. Si la demande est acceptée, la différence entre les droits exigés au titre de la demande et les frais administratifs est imputée au loyer exigible pour la première année. 17. Celui dont la demande est acceptée dispose de 21 jours suivant l’expédition postale de l’avis d’acceptation pour signer le bail et payer le solde de tous les droits requis. S’il omet de se conformer à ces exigences, la demande est rejetée et la différence entre les droits exigés au titre de la demande et les frais administratifs est remise au demandeur. Aucun document constatant une cession à bail ne sera finalisé avant réception de tous les droits requis. 18. Si la demande est rejetée, la différence entre les droits exigés au titre de la demande et les frais administratifs est remise au demandeur. CONDITIONS ET MODALITÉS D’ALIÉNATION DES BIENS-FONDS 19. Par défaut, la durée de tous les baux visant des terres communautaires tåîchôs est de 30 ans. Toutefois, le conseil peut, à sa discrétion, céder à bail des terres communautaires tåîchôs pour une période inférieure ou supérieure à 30 ans, selon la nature et la valeur des améliorations qui seront construites sur ces terres. Le gouvernement communautaire ne peut accorder un intérêt sur des terres communautaires tåîchôs pour une période dépassant 99 ans, ni un intérêt prenant naissance au moins 99 ans après qu’il ait été accordé, sauf avec l’approbation des personnes habiles à voter, en application de l’article 53 de la Loi sur le gouvernement communautaire tåîchô et de l’article 9.3.6 de l’Accord tåîchô. 20. En ce qui a trait aux cessions à bail et aux autres dispositions de biens-fonds à des fins résidentielles, le gouvernement communautaire s’assure de donner la préférence aux propriétaires de maisons privées plutôt qu’aux demandeurs de biens-fonds qui souhaitent acquérir plus d’une parcelle à la fois, sauf si ces parcelles sont requises : a) par le gouvernement fédéral, territorial ou tåîchô ou par l’Agence des services communautaires tåîchô; b) par la Société d’habitation des Territoires du Nord-Ouest. 9 21. A disposal of land must be in writing and leases must be executed in accordance with the Land Titles Act. 22. The Community Government, in leasing or otherwise disposing of new lots, shall require that all improvements proposed in the application must begin within 12 months and must be completed within 24 months after the effective date of the lease. Subject to section 23, if construction is not undertaken as outlined in this section, the lease may be cancelled. 23. The Community Government may allow a maximum extension of 12 months to either term provided for in section 22. The following may be required before an extension is considered by Council: (a) written explanation for the delay in construction; (b) written plan to complete construction within the extension period, including a Development Permit application or Building Permit, if applicable; (c) proof of approved financing; (d) no outstanding debts to the Community Government. 24. The Community Government shall dispose of Tåîchô community lands by one or more of the following means: (a) ballot draw; (b) development proposal call; (c) first-come-first-served basis. The means for land disposal must be decided by a resolution of Council. 25. Prior to disposing of Tåîchô community lands through means of a ballot draw, Council shall, by resolution, establish guidelines for such a process, and which guidelines must be in accordance with section 21. 26. The Community Government shall, by resolution, determine whether and under what circumstances formal development proposals or bids will be required of applicants. PRICING OF NEW LOTS 27. The lot price for new lots must be determined by development cost, including any allowance for site-specific factors on a cost per square meter basis. Council shall, by resolution, made annually, establish the minimum square meter price(s) based on the costs for serviced and unserviced lots. 28. Subject to section 29, the Community Government shall recover all development costs in the valuation of lands for disposal. 29. The Community Government may, when it is unable to lease or otherwise dispose of a lot, reduce the price of the lot below its development cost (a) when the lot has not been developed through financing from the Government of the Northwest Territories, the Tåîchô Government or a financial institution; or (b) when the lot has been developed through financing from the Government of the Northwest Territories, the Tåîchô Government or a financial institution and the government or financial institution approves the reduced price. 10 21. Avant d’envisager une telle prolongation, le conseil peut exiger : a) que les raisons du retard lui soient expliquées par écrit; b) qu’on lui remette par écrit un plan pour l’achèvement des travaux de construction à l’intérieur de la période de prolongation, accompagné, s’il y a lieu, d’une demande de permis d’aménagement ou d’un permis de construire; c) qu’on lui fournisse une preuve de financement; d) que toute somme due au gouvernement communautaire lui soit remboursée. 24. Lorsqu’il dispose de terres communautaires tåîchôs, le gouvernement communautaire peut utiliser un ou plusieurs des modes suivants : a) le tirage au sort; b) l’appel de propositions d’aménagement; c) le traitement des demandes selon l’ordre de leur présentation. Les modes de disposition des terres doivent être décidés par résolution du conseil. 25. Avant de disposer de terres communautaires tåîchôs par tirage au sort, le conseil établit, par résolution, des lignes directrices pour la tenue du tirage. Ces lignes directrices doivent être conformes à l’article 21. 26. Le gouvernement communautaire décide, par résolution, s’il y a lieu d’exiger, de la part des demandeurs, que les propositions d’aménagement ou les offres soient présentées en bonne et due forme; le cas échéant, il précise les circonstances où cette exigence s’appliquera. ÉTABLISSEMENT DU PRIX DES NOUVELLES PARCELLES 27. Dans le cas des nouvelles parcelles, le prix de la parcelle est établi en fonction des coûts d’aménagement, lesquels tiennent compte des facteurs particuliers au site, et ce prix est exprimé en termes de coût par mètre carré. Chaque année, le conseil établit, par résolution, le prix minimum, par mètre carré, des parcelles aménagées et des parcelles non aménagées. 28. Sous réserve de l’article 29, lorsqu’il évalue le prix de la disposition d’un bien-fonds, le gouvernement communautaire doit s’assurer de recouvrer tous les coûts d’aménagement. 29. Lorsqu’il est incapable de disposer d’une parcelle, notamment en la cédant à bail, le gouvernement peut en réduire le prix en deçà des coûts d’aménagement dans l’un ou l’autre des cas suivants : a) l’aménagement de la parcelle n’a pas été financé par le gouvernement des Territoires du Nord-Ouest, le gouvernement tåîchô ou une institution financière; b) l’aménagement de la parcelle a été financé par le gouvernement des Territoires du Nord-Ouest, le gouvernement tåîchô ou une institution financière, mais ce gouvernement ou cette institution financière approuve la réduction de prix. 11 PRICING OF EXISTING LOTS 30. In leasing existing developed lands, the Community Government shall determine lot price by replacement cost. LEASE RATES 31. Lease rates will be based on a standard lease or an equity lease at the discretion of the lessee. For new leases involving (a) a standard lease, the annual payments must be 10% of the lot price plus the annual lease administration fee; and (b) an equity lease (i) the initial payment must be 10% of the lot price, and payment of the remainder plus an annual interest charge of 3% per year (being an inflation factor) plus the annual lease administration fee must be made in equal payments, over a period not to exceed 10 years from the commencement date of the equity lease agreement, after which the annual payment for the lease must be the annual lease administration fee, and (ii) notwithstanding subparagraph (i), payment of the balance of the lot price may be made at any time without penalty and with no further interest due. 32. The terms and conditions for amending existing leases shall be the same as for new leases except for the determination of the lot price. The lot price used for amending existing leases shall be determined by application of section 31 and then by (a) applying a discount factor of 3% per year (being an inflation factor), back to the year in which the lot was constructed; (b) applying any site specific factors; and (c) deducting all previous lease payments made. Where the existing lease payments more than triple after renewal or amendment and the new lease amount is greater than the minimum lease payment, a phase-in of the new payment may be over two years. MINIMUM LEASE PAYMENT 33. The minimum lease payment excluding the lease administration fee must be $600 per year. ANNUAL LEASE ADMINISTRATION FEE 34. The Council shall, by resolution, set an administration fee to be applied to all leases. LATE PAYMENT FEES 35. Where any portion of the lease payment is unpaid for more than 90 days, the lessee shall pay a late payment fee on the arrears as determined by the Community Government. 12 ÉTABLISSEMENT DU PRIX DES PARCELLES EXISTANTES 30. S’agissant d’un nouveau bail qui est : a) un bail ordinaire, le loyer annuel est égal à 10 % du prix de la parcelle, plus les frais annuels d’administration du bail; b) un bail en equity : (i) le paiement initial est égal à 10 % du prix de la parcelle, et le solde du prix de la parcelle, les intérêts sur le solde, calculés au taux annuel de 3 % (représentant le facteur d’inflation) ainsi que les frais annuels d’administration du bail sont payables par versements égaux sur une période maximale de 10 ans à compter de la date de prise d’effet du contrat de bail et, à l’expiration de cette période, le paiement exigé pour le bail est celui des frais annuels d’administration du bail, (ii) malgré le sous-alinéa (i), le paiement du solde du prix de la parcelle peut être fait à tout moment sans pénalité et sans autres intérêts exigibles que ceux échus à la date du paiement. 32. Les conditions et modalités applicables à la modification des baux existants sont les mêmes que celles auxquelles sont assujettis les nouveaux baux, sauf en ce qui a trait à l’établissement du prix de la parcelle. Aux fins de la modification des nouveaux baux, le prix de la parcelle est établi en appliquant les dispositions de l’article 31, puis : a) en appliquant un facteur de réduction de 3 % par année (représentant un facteur d’inflation), à compter de l’année où la parcelle a été bâtie; b) en appliquant les facteurs particuliers au site, le cas échéant; c) en soustrayant du produit obtenu le montant de tous les loyers payés antérieurement. Lorsque le loyer exigible aux termes d’un bail existant est multiplié par un facteur supérieur à trois après le renouvellement ou la modification du bail et que le nouveau loyer est plus élevé que le loyer minimum, le nouveau loyer peut être appliqué progressivement sur deux ans. LOYER MINIMUM 33. Le loyer minimum, à l’exclusion des frais d’administration du bail, est de 600 $ par année. FRAIS ANNUELS D’ADMINISTRATION DU BAIL 34. Le conseil fixe, par résolution, le montant des frais d’administration applicable à tous les baux. FRAIS POUR PAIEMENT EN SOUFFRANCE 35. Lorsque le loyer échu demeure impayé, en tout ou en partie, pendant plus de 90 jours, le preneur à bail est tenu de payer des frais pour paiement en souffrance; ces frais sont calculés sur l’arriéré du loyer et sont déterminés par le gouvernement communautaire. 13 OFF-SITE LEVIES 36. When disposing of land, the Community Government may levy a surcharge to the lessee of lands to help pay for all or part of the Community Government’s capital cost for all or any of the following: (a) new or expanded facilities for the storage, transmission, treatment, or supply of water; (b) new or expanded facilities for the storage, treatment, movement or disposal of sewage; (c) new or expanded storm sewer drainage facilities; (d) new or expanded roadways and sidewalks; (e) land required for, or in connection with, any of the facilities described in paragraphs (a), (b), (c), and (d). 37. The Community Government shall not include, as part of an off-site levy, any costs paid for by grants or contributions received from the Government of the Northwest Territories or the Tåîchô Government. 38. The Community Government shall clearly identify to the public that any off-site levy is a separate surcharge above the lease price that is collected at the time of the lease execution. 39. The Community Government shall place all off-site levy revenues in a separate account, to be used for the purposes set out in section 36. PRIVATE SECTOR DEVELOPMENT OF LANDS 40. The Community Government may allow the private development of lands if (a) the Community Government has prepared a cost estimate of the project as if it were to develop the land; and (b) the private sector can develop the land such that the lot price is the same as, or less than, the Community Government would charge under its estimate in paragraph (a). 41. If, in the opinion of Community Government, a private developer could be cost-effective as outlined in section 40, the Community Government shall call for proposals. 42. The Community Government may dispose of vacant Tåîchô community lands to a private developer by way of a lease and a development agreement. EASEMENTS AND OTHER DISPOSITIONS 43. The Community Government may, in the public interest, establish easements through, under or over any portion of the land for any public utility purpose, but the easement shall not unreasonably interfere with the rights granted to the lessee or any improvements made by the lessee on the Tåîchô community lands. 44. Licenses of occupation and other dispositions of land that do not convey exclusive possession to the land, such as easement agreements and right-of-way agreements, shall be valued at the minimum rate of $250 per year, $15 per year per kilometre, or 5% per year of the lot price, whichever is greater. 14 DROITS SUR LES INFRASTRUCTURES ANNEXES 36. Le gouvernement communautaire ne peut inclure dans le montant des droits sur les infrastructures annexes la partie des coûts financée par le gouvernement des Territoires du Nord-Ouest ou le gouvernement tåîchô par le biais de subventions ou de contributions. 38. Le gouvernement communautaire doit signifier clairement au public que les droits sur les infrastructures annexes constituent une surcharge distincte du loyer, perçue au moment de la passation du bail. 39. Les droits sur les infrastructures annexes perçus par le gouvernement communautaire sont déposés dans un compte distinct en vue de leur utilisation pour les objets énoncés à l’article 36. AMÉNAGEMENT DE BIENS-FONDS PAR LE SECTEUR PRIVÉ 40. Le gouvernement communautaire peut permettre l’aménagement de biens-fonds par le secteur privé si les conditions suivantes sont réunies : a) le gouvernement communautaire a préparé un devis estimatif pour le projet comme s’il procédait lui-même à l’aménagement des biens-fonds; b) le secteur privé peut aménager les biens-fonds de manière à ce que le prix de la parcelle soit identique ou inférieur à celui qu’exige le gouvernement communautaire aux termes du devis visé à l’alinéa a). 41. S’il est d’avis que le recours à un entrepreneur privé peut s’avérer rentable, selon ce qui est indiqué à l’article 40, le gouvernement communautaire lance un appel de propositions. 42. Le gouvernement communautaire peut aliéner des terres communautaires tåîchôs inoccupées à un entrepreneur privé par le biais d’un bail assorti d’une entente d’aménagement. SERVITUDES ET AUTRES DISPOSITIONS 43. Le gouvernement communautaire peut, dans l’intérêt général, créer des servitudes sur toute partie d’un bien-fonds à des fins d’utilité publique, mais nulle servitude ne doit constituer une atteinte déraisonnable aux droits accordés au preneur à bail ou aux améliorations faites par celui-ci sur les terres communautaires tåîchôs. 44. Les permis d’occupation et autres dispositions touchant un bien-fonds qui ne confèrent pas la possession exclusive du bien-fonds, comme les conventions de servitudes ou de droits de passage, sont évalués au taux minimum de 250 $ par an, 15 $ par an par kilomètre ou 5 % du prix de la parcelle par an, selon le montant le plus élevé. 15 LEASE ASSIGNMENTS/TRANSFERS 45. An assignment or transfer of a lease may be considered by the Senior Administrative Officer or his or her delegate and consented to subject to the following: (a) annual lease rent owing to the Community Government must be paid in full; (b) any property taxes relating to the property and owing to the Government of the Northwest Territories or the Community Government must be paid in full; (c) satisfactory completion of improvements; (d) provision of the duplicate original lease if available or completion of a statutory declaration of loss form; (e) payment of a reasonable sum for any expenses incurred by the Community Government. CONSENT 46. The Senior Administrative Officer or his or her delegate is authorized to execute, on behalf of the Community Government, "Consent to Mortgage of Lease" documents with respect to land leased by the Community Government. LEASE SURRENDERS 47. Surrender of a lease may be granted subject to the following: (a) the lease rent owing to the Community Government must be paid in full; (b) any property taxes relating to the property and owing with respect to that property to the Government of the Northwest Territories or the Community Government must be paid in full; (c) the lessee must deliver up to the Community Government the duplicate original lease if one exists. CANCELLATION OF LEASE 48. The Community Government may cancel a lease due to non-compliance with any terms and conditions of the lease. QUARRIES 49. The Community Government may, upon receipt of a quarry application, issue quarry permits for the temporary use of a quarry site. Prior to the issuance of a quarry permit, the Community Government shall, by Council resolution, establish quarry fees and any exemptions to such fees. Fees established under this section shall reflect the cost of development, operation, maintenance, administration and restoration of quarries. LAND USE PERMITS 50. The Community Government may issue land use permits for the temporary use of land. Any environmental impacts of the proposed use must be addressed by the applicant to the satisfaction of the Community Government prior to the issuance of a permit, and such approvals will be subject to the review and approval of other regulatory authorities, if applicable. 16 CESSIONS ET TRANSFERTS DE BAUX 45. Le directeur général ou son délégué peut examiner une demande de cession ou de transfert d’un bail et y consentir aux conditions suivantes : a) le loyer annuel dû au gouvernement communautaire doit être payé en entier; b) l’impôt foncier relatif aux biens et dû au gouvernement des Territoires du Nord-Ouest ou au gouvernement communautaire doit être payé en entier; c) les travaux relatifs aux améliorations doivent être exécutés de manière satisfaisante; d) le double original du bail doit être remis ou, à défaut, une formule de déclaration solennelle relative à la perte du bail doit être remplie; e) une somme raisonnable doit être versée pour couvrir toute dépense engagée par le gouvernement communautaire. CONSENTEMENT 46. Le directeur général ou son délégué est autorisé à consentir par écrit, au nom du gouvernement communautaire, à la constitution d’une hypothèque sur un bien-fonds cédé à bail par le gouvernement communautaire. RÉSIGNATION DU BAIL 47. La résignation d’un bail peut être accordée aux conditions suivantes : a) le loyer dû au gouvernement communautaire doit être payé en entier; b) l’impôt foncier relatif aux biens et dû au gouvernement des Territoires du Nord-Ouest ou au gouvernement communautaire doit être payé en entier; c) le double original du bail, s’il en existe un, doit être remis par le preneur à bail au gouvernement communautaire. ANNULATION DU BAIL 48. Le gouvernement communautaire peut annuler un bail en cas de manquement à ses conditions. EXPLOITATION D’UNE CARRIÉRE 49. Le gouvernement communautaire peut, sur demande en ce sens, délivrer un permis autorisant l’exploitation temporaire d’une carrière. Avant de délivrer un permis d’exploitation d’une carrière, le gouvernement communautaire fixe, par résolution, les droits d’exploitation d’une carrière et les critères de dispense du paiement de ces droits. Les droits fixés en vertu du présent article doivent tenir compte des coûts d’aménagement, de fonctionnement, d’entretien, d’administration et de restauration des carrières. PERMIS D’UTILISATION DE BIENS-FONDS 50. Le gouvernement communautaire peut délivrer des permis autorisant l’utilisation temporaire de biens-fonds. La question des répercussions environnementales possibles de l’utilisation projetée des biens-fonds doit être traitée, à la satisfaction du gouvernement communautaire, par le demandeur de permis avant sa délivrance. L’autorisation du gouvernement communautaire est par ailleurs assujettie, s’il y a lieu, à l’examen et à l’approbation d’autres organismes de contrôle. 17 BYLAW ADMINISTRATION 51. Council shall, on or before February 3, 2006, adopt standard forms of agreement to be attached to this bylaw. Council may, by resolution, adopt additional standard forms of agreement for the administration of land. The Community Government may, without amending this bylaw, make minor changes to the standard forms of agreement for administrative or technical reasons, so long as the changes do not affect the intent of the forms. The Community Government shall charge a fee, to be established by Council, that is based on staff time taken and Community Government materials and equipment used, for the issuing of Letters of Compliance to Community Government Bylaws, and the preparation of other related documents requiring research by Community Government staff. 18 ADMINISTRATION DU RÈGLEMENT MUNICIPAL 51. Au plus tard le 3 février 2006, le conseil adopte des modèles de conventions qui seront annexés au présent règlement municipal.

Sont perçus par le gouvernement communautaire, pour la délivrance de lettres de conformité aux règlements municipaux du gouvernement communautaire et la préparation de documents connexes pour lesquels le personnel du gouvernement communautaire doit effectuer des recherches, les droits que fixe le conseil en se basant sur le temps consacré par le personnel à cette fin et le matériel et l’équipement du gouvernement communautaire qui sont utilisés.
