If you find any errors or omissions in this consolidation, please contact: Legislative Counsel Office Tel: (902) 368-4292 Email: legislation@gov.pe.ca Highway Traffic Act Farm Truck Registration Regulations Section 1 c HIGHWAY TRAFFIC ACT Chapter H-5 FARM TRUCK REGISTRATION REGULATIONS Made by the Lieutenant Governor in Council under the Highway Traffic Act R.S.P.E.I. 1988, Cap. H-5. 1. Definition In these regulations “farm truck” means a truck (a) that is owned by a bona fide farmer as defined in the Real Property Assessment Act R.S.P.E.I. 1988, Cap. R-4; (b) that is used only for transporting the farmer, the farmer’s family and (i) other persons the farmer chooses to transport or cause to be transported without charging a fee, (ii) tools, machinery, equipment and materials that are used on the truck owner’s farm in agricultural production, (iii) animals and animal products, poultry and poultry products, plants and plant products, or products of the forest that are grown or produced on the truck owner’s farm; (c) that has a manufacturer’s weight rating of at least 4,500 kg, but that does not have more than two axles, and includes (d) a military surplus three-axle vehicle used exclusively for farm purposes; (e) a tandem rear three-axle commercial motor vehicle used exclusively for farm purposes; and (f) a tractor-trailer combination used exclusively for farm purposes. Farm trucks separate class Farm trucks are hereby established as a class of vehicles separate and apart from all other vehicles for the purpose of the registration of farm trucks. (EC356/74) 3. Application for registration (1) Every person who owns a farm truck shall make application to the Registrar for the registration of each farm truck owned by the person. c t Current to: August 8, 2020 Page 3 Section 4 Highway Traffic Act Farm Truck Registration Regulations Form (2) The application referred to in subsection (1) shall be on such form and shall set forth such information as may be necessary to complete the form as prescribed by the Registrar. Registration (1) Where the Registrar is satisfied that the vehicle is a farm truck, and after receiving an affidavit from the owner stating that the vehicle is a farm truck, the Registrar shall register the vehicle as a farm truck, but only after the Registrar receives payment in full of the registration fee. Fee (2) Revoked by EC32/90. Operation on highway (3) Where any person purchases a farm truck and intends to operate it on a highway, the person shall before operating it on a highway, register the farm truck under these regulations. License plates Upon registration of a farm truck the truck will be issued a license plate and the owner of the farm truck shall, upon issuance of the license plate affix it to the farm truck in the manner prescribed by the Registrar. Notice of sale or disposition Where a farm truck is sold, leased, transferred or disposed of, the person in whose name the farm truck was registered or the person’s authorized representative shall notify the Registrar of the sale, lease, transfer or disposition and shall return the license plates to the Registrar unless the Registrar otherwise directs. Name and address displayed (1) The owner of a farm truck shall, for the purpose of enabling enforcement of these regulations, paint on the truck or affix the owner’s name and address in permanent lettering at least 100 mm in height in contrasting colours on the left side of the truck body. Offences and penalties (2) Any person who makes a false statement in an application or affidavit made pursuant to these regulations, or who fails to comply with these regulations, is guilty of an offence and is liable on summary conviction to a fine of not less than $500 and not more than $1,000 and in default of payment is liable to imprisonment for a term of not more than 30 days, or to both.
