If you find any errors or omissions in this consolidation, please contact: Legislative Counsel Office Tel: (902) 368-4292 Email: legislation@gov.pe.ca Reserved Activities Regulations Section 1 c REGULATED HEALTH PROFESSIONS ACT Chapter R-10.1 RESERVED ACTIVITIES REGULATIONS Pursuant to subsection 96(1) of the Regulated Health Professions Act R.S.P.E.I. 1988, Cap. R-10.1, Council made the following regulations: 1. “Act” defined In these regulations, “Act” means the Regulated Health Professions Act R.S.P.E.I. 1988, Cap. R-10.1. (EC536/15; 446/19) 2. Designation of reserved activity In addition to the reserved activities set out in section 86 of the Act, each of the following done with respect to a person is designated as a reserved activity: (a) administering a substance by (i) enteral or parenteral instillation or transfusion, or (ii) respiratory instillation; (b) administering a drug or vaccine by any means; (b.1) putting an instrument, hand or finger beyond the pharynx; (c) removing a superficial foreign body from the human eye or its adnexa; (d) ordering or compounding a therapeutic diet that is to be administered by enteral or parenteral instillation; (e) ordering and interpreting screening and diagnostic tests that do not use prescribed forms of energy; (f) performing a psychosocial intervention with an expectation of modifying a substantial disorder of thought, mood, perception, orientation or memory that grossly impairs judgment, behaviour, the capacity to recognize reality or the ability to meet the ordinary demands of life. Forms of energy For the purpose of clause 86(1)(g) of the Act, the following are prescribed forms of energy: (a) electrical; (b) electromagnetic; (c) sound. Exemption, instrument in nasal passages For the purpose of subsections 86(3) and (4) of the Act, health professionals employed or contracted by the Government or Health PEI are exempted in respect of, in the course of their employment or contract, putting an instrument beyond the point in the nasal passages where they normally narrow for the purpose of performing a diagnostic test for the coronavirus causing the disease known as COVID-19. Exemption, tissue below dermis For the purpose of subsections 86(3) and (4) of the Act, the following persons are exempted in respect of performing, in the course of their employment, a procedure on tissue below the dermis by skin pricking to obtain a blood sample or venipuncture to obtain a blood sample or blood donation: (a) persons employed by Health PEI in a health care facility or program managed or operated by Health PEI; (b) persons employed by Canadian Blood Services in a blood donation facility or program managed or operated by Canadian Blood Services; or (c) persons employed by and working under the supervision of a medical practitioner or nurse practitioner who is physically present. Exemption, electrical and sound energy For the purpose of subsections 86(3) and (4) of the Act, persons employed by Health PEI in a community hospital as combined technicians are exempted in respect of applying, in the course of their employment, electrical and sound energy in the form of ionizing or non- ionizing radiation. Exemption, administering vaccine For the purpose of subsections 86(3) and (4) of the Act, persons who have completed at least three years of a four-year bachelor’s degree program in nursing are exempted in respect of administering a vaccine for the coronavirus causing the disease known as COVID-19, in the course of employment or a contract with the Government or Health PEI and under the supervision of a registered nurse who is physically present. Exemption, assisting optometrist For the purpose of subsections 86(3) and (4) of the Act, persons employed to assist an optometrist are exempted in respect of performing the following reserved activities in the course of their employment and under the supervision of an optometrist who is physically present: (a) applying sound energy using ultrasonic pachymetry to measure corneal thickness; (b) administering topical diagnostic drugs to the human eye in preparation for an eye examination. Exemption, assisting physiotherapist For the purpose of subsections 86(3) and (4) of the Act, persons employed to assist a physiotherapist are exempted in respect of applying electrical and sound energy in the provision of treatment in the course of their employment and under the supervision of a physiotherapist who is physically present.
