Definitions 2 In these regulations: “Act” means The Health Administration Act; “arthroplasty” is an orthopedic surgical procedure to replace the joint of the hip, knee or shoulder, performed to manage pain and improve mobility for persons suffering from advanced arthritis or other conditions; “clinical criteria” means the criteria established by an out-of-province surgical facility, and approved by the minister, that the facility considers necessary to ensure that persons selected for arthroplasty are physically fit and can safely receive the surgery in the facility and be discharged within 24 hours after surgery; “long‑waiting patient” means a beneficiary who, as at April 1, 2023, has been on the Saskatchewan Surgical Registry wait list for arthroplasty for 12 months or more; “out‑of‑province surgical facility” means a health care facility in Canada but outside Saskatchewan that has entered into an agreement with the minister for the purpose of providing arthroplasty to persons designated pursuant to section 3. 19 May 2023 c H-0.0001 Reg 1 s2. Designation of eligible persons 3(1) Persons who meet the criteria set out in subsection (2) are designated pursuant to clause 6.1(a) of the Act as persons for whom the minister may pay part or the whole of the cost of the arthroplasty provided to those persons at out-of-province surgical facilities. (2) For the purposes of subsection (1), the person must: (a) reside in Saskatchewan; (b) be a long-waiting patient; (c) meet the clinical criteria for the out-of-province surgical facility that will provide the arthroplasty; 4 RELIEF FOR LONG-WAITING H-0.0001 REG 1 JOINT REPLACEMENT PATIENTS (d) be selected, assessed and recommended to the minister by the Saskatchewan Health Authority as being eligible for arthroplasty at an out-of-province surgical facility; and (e) be accepted by the minister as being a person for whom part or the whole of the cost of the arthroplasty provided to that person at an out-of-province surgical facility will be paid by the minister. 19 May 2023 c H-0.0001 Reg 1 s3. Agreements 4 The minister may enter into agreements with out-of-province surgical facilities for the provision of arthroplasty pursuant to these regulations. 19 May 2023 c H-0.0001 Reg 1 s4. Payments 5(1) Subject to subsection (2), the minister may make payment for arthroplasty provided to persons described in section 3 at out-of-province surgical facilities between April 1, 2023 and September 30, 2024. (2) The total amount paid by the minister to all out-of-province surgical facilities for arthroplasty pursuant to these regulations shall not exceed $10,000,000. 19 May 2023 c H-0.0001 Reg 1 s5.
