1 PROVINCIAL COURT SUPERANNUATION SUPPLEMENTARY ALLOWANCE P-30.1 REG 1 The Provincial Court Superannuation Supplementary Allowance Regulations being Chapter P-30.1 Reg 1 as amended by Saskatchewan Regulations 129/1982, 112/1983, 75/1985, 71/1986, 22/1989 and 75/1991. NOTE: This consolidation is not official. Interpretation 2 In these regulations: (a) “Act” means The Provincial Court Act; (a.1) “annuity” means an annuity with respect to services as a provincial magistrate or as a judge of the magistrates’ courts; (b) “pension” means a pension in respect of service as a judge; (c) “service” means service as a provincial magistrate, as a judge of the magistrates’ courts and as a judge. 28 Aug 81 cP-30.1 Reg 1 s2; 12 May 89 SR 22/89 s3. Supplementary allowance effective January 1, 1979 3 Where an annuity or a pension: (a) commenced on or before January 1, 1979, with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1979; or (b) is being paid to the spouse, child or children of a deceased superannuated judge who died after January 1, 1979; a supplementary allowance is to be paid to the recipient of the annuity or pension, in addition to any supplementary allowance currently being paid, calculated from January 1, 1979, at the rate of: (c) $14 per year, where the recipient is a superannuated judge; (d) $7 per year, where the recipient is the spouse of a deceased superannuated judge; for each full year, and a prorated amount of that rate for a portion of a year, of service of the judge, to a maximum of 23 1/3 years. 28 Aug 81 cP-30.1 Reg 1 s3. 4 PROVINCIAL COURT SUPERANNUATION P-30.1 REG 1 SUPPLEMENTARY ALLOWANCE Supplementary allowance effective January 1, 1980 4 Where an annuity or a pension: (a) commenced on or before January 1, 1980, with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1980; or (b) is being paid to the spouse, child or children of a deceased superannuated judge who died after January 1, 1980; a supplementary allowance is to be paid to the recipient of the annuity or pension, in addition to any supplementary allowance currently being paid, calculated from January 1, 1980, at the rate of: (c) $14 per year, where the recipient is a superannuated judge; (d) $7 per year, where the recipient is the spouse of a deceased superannuated judge; for each full year, and a prorated amount of that rate for a portion of a year, of service of the judge, to a maximum of 23 1/3 years. 28 Aug 81 cP-30.1 Reg 1 s4. Supplementary allowance effective January 1, 1981 5 Where an annuity or a pension: (a) commenced on or before January 1, 1981, with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1981; or (b) is being paid to the spouse, child or children of a deceased superannuated judge who died after January 1, 1981; a supplementary allowance is to be paid to the recipient of the annuity or pension, in addition to any supplementary allowance currently being paid, calculated from January 1, 1981, at the rate of: (c) $16.50 per year, where the recipient is a superannuated judge; (d) $8.25 per year, where the recipient is the spouse of a deceased superannuated judge; for each full year, and a prorated amount of that rate for a portion of a year, of service of the judge, to a maximum of 23 1/3 years. 28 Aug 81 cP-30.1 Reg 1 s5. 5 PROVINCIAL COURT SUPERANNUATION SUPPLEMENTARY ALLOWANCE P-30.1 REG 1 Supplementary allowance effective January 1, 1982 5.1 Where an annuity or a pension: (a) commenced on or before January 1, 1982 with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1982; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1982 and who died after that day; a supplementary allowance is to be paid to the recipient of the annuity or pension, in addition to any supplementary allowance currently being paid, calculated from January 1, 1982, at the rate of: (c) $30 per year, where the recipient is a superannuated judge; (d) $18 per year, where the recipient is the spouse of a deceased judge or a deceased superannuated judge; for each full year, and a prorated amount of that rate for a portion of a year, of service of the judge, to a maximum of 23 1/3 years. 1 Oct 82 SR 129/82 s2. Supplementary allowance effective January 1, 1983 5.2 Where an annuity or a pension: (a) commenced on or before January 1, 1983 with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1983; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1983 and who died after that day; a supplementary allowance is to be paid to the recipient of the annuity or pension, in addition to any supplementary allowance currently being paid, calculated from January 1, 1983, at the rate of: (c) $28.80 per year, where the recipient is a superannuated judge; (d) $17.25 per year, where the recipient is the spouse of a deceased judge or a deceased superannuated judge; for each full year, and a prorated amount of that rate for a portion of a year of service of the judge, to a maximum of 23 1/3 years. 12 Aug 83 SR 112/83 s2. 6 PROVINCIAL COURT SUPERANNUATION P-30.1 REG 1 SUPPLEMENTARY ALLOWANCE Supplementary allowance effective January 1, 1984 5.3(1) Where an annuity or a pension: (a) commenced on or before January 1, 1984 with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1984; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1984 and who died after that day; a supplementary allowance is to be paid to the recipient of the annuity or pension, in addition to any supplementary allowance currently being paid, calculated from January 1, 1984, at the rate of: (c) $19.50 per year, where the recipient is a superannuated judge; (d) $9.75 per year, where the recipient is the spouse of a deceased judge or a deceased superannuated judge; (e) subject to subsection (2), $2.93 per year, where the recipient is the child of a deceased judge or a deceased superannuated judge; for each full year, and a prorated amount of that rate for a portion of a year of service of the judge, to a maximum of 23 1/3 years. (2) The maximum total amount of all increases paid to all children of a deceased judge or a deceased superannuated judge in accordance with clause (1)(e) is $11.72 per year and is to be divided equally among them. 16 Aug 85 SR 75/85 s2. Supplementary allowance effective January 1, 1985 5.4(1) In this section, “annuity or pension” includes any supplementary allowances payable pursuant to sections 3 to 5.3 or section 46 of the Act or described in section 52 of the Act. (2) On and from January 1, 1985, an annuity or pension that: (a) commenced on or before January 1, 1985 with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1985; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1985 and who died after that day; is to be increased by 2.37%. (3) On and from January 1, 1985, an annuity or pension that is being paid to: (a) a superannuated judge; or 7 PROVINCIAL COURT SUPERANNUATION SUPPLEMENTARY ALLOWANCE P-30.1 REG 1 (b) the spouse, child or children of a deceased judge or deceased superannuated judge; is, in addition to any increase that may be payable pursuant to subsection (2), to be increased by: (c) 0.4% if the allowance commenced in 1983; (d) 0.8% if the allowance commenced in 1982; (e) 1.2% if the allowance commenced in 1981; (f) 1.6% if the allowance commenced in 1980; (g) 2% if the allowance commenced in 1979; (h) 2.4% if the allowance commenced in 1978; (i) 2.8% if the allowance commenced in 1977; (j) 3.2% if the allowance commenced in 1976; (k) 3.6% if the allowance commenced in 1975; (l) 4% if the allowance commenced in 1974 or any earlier year. 16 Aug 85 SR 75/85 s2. Supplementary allowance effective January 1, 1986 5.5(1) In this section, “annuity or pension” includes any supplementary allowances payable pursuant to sections 3 to 5.4 of these regulations or section 46 of the Act or described in section 52 of the Act. (2) On and from January 1, 1986, an annuity or pension that: (a) commenced on or before January 1, 1986 with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or a deceased superannuated judge; and was being paid on January 1, 1986; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1986 and who died after that day; is to be increased by 2.16%. 11 Jly 86 SR 71/86 s2. Supplementary allowances re pensions 5.6(1) In this section, “annuity or pension” includes any supplementary allowances payable pursuant to sections 3 to 5.5 or section 46 of the Act or described in section 52 of the Act. (2) On and from January 1, 1988, an annuity or pension that: (a) commenced on or before January 1, 1988 with payment to: (i) a superannuated judge; or 8 PROVINCIAL COURT SUPERANNUATION P-30.1 REG 1 SUPPLEMENTARY ALLOWANCE (ii) the spouse, child or children of a deceased judge or deceased superannuated judge; and was being paid on January 1, 1988; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1988 and who died after that day; is to be increased by 2.94%. 12 May 89 SR 22/89 s4. Supplementary allowance effective January 1, 1989 5.7(1) In this section and section 5.8, “annuity or pension” includes any supplementary allowance that is: (a) payable pursuant to sections 3 to 5.6 of these regulations or section 46 of the Act; or (b) described in section 52 of the Act. (2) On and from January 1, 1989, an annuity or pension that: (a) commenced on or before January 1, 1989 with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or deceased superannuated judge; and was being paid on January 1, 1989; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1989 and who died after that day; is to be increased by 2.64%. 13 Sep 91 SR 75/91 s2. Supplementary allowance effective January 1, 1990 5.8 On and from January 1, 1990, an annuity or pension that: (a) commenced on or before January 1, 1990 with payment to: (i) a superannuated judge; or (ii) the spouse, child or children of a deceased judge or deceased superannuated judge; and was being paid on January 1, 1990; or (b) is being paid to the spouse, child or children of a deceased judge who superannuated on or before January 1, 1990 and who died after that day; is to be increased by 2.55%. 13 Sep 91 SR 75/91 s2. 9 PROVINCIAL COURT SUPERANNUATION SUPPLEMENTARY ALLOWANCE P-30.1 REG 1 Supplementary allowance to children 6 Where there is no spouse in receipt of an annuity or pension and an annuity or pension is being paid to a child or children, the child or children are entitled to be paid a supplementary allowance at the rate provided for a spouse, for the period for which he is or they are entitled to receive the annuity or pension and on the same terms and conditions that apply to the payment of that annuity or pension. 28 Aug 81 cP-30.1 Reg 1 s6.
