Definitions 2 In these regulations: “Act” means The Provincial Health Authority Act; “emergency surgical procedure” means a surgical procedure of an unexpected or unplanned nature that must be performed immediately on a patient as a result of a condition that is life threatening, limb threatening or organ threatening; “health services number” means a unique number assigned to an individual who: (a) is or was registered as a beneficiary to receive insured services within the meaning of The Saskatchewan Medical Care Insurance Act; (b) pursuant to the legislation of another province or territory of Canada, is or was entitled to receive services similar to the insured services mentioned in clause (a); or (c) is or was entitled to receive services similar to the insured services mentioned in clause (a) that are paid for by the Government of Canada; “operator” means the provincial health authority, a health care organization or a surgical services entity, as the case may be, that operates a surgical facility; “patient” means a person who is the subject of a surgical procedure; “planned surgical procedure” means a surgical procedure other than an emergency surgical procedure; “Saskatchewan Provincial Diagnosis Code List” means the Saskatchewan Provincial Diagnosis Code List published by the ministry, as amended from time to time; “Saskatchewan Surgical Registry Policies and Procedures manual” means the Saskatchewan Surgical Registry Policies and Procedures manual published by the ministry, as amended from time to time; “Saskatchewan Surgical Registry Procedure List” means the Saskatchewan Surgical Registry Procedure List published by the ministry, as amended from time to time; “surgical facility” means a facility at which a surgical procedure is provided; 4 P-30.3 REG 3 SURGICAL REGISTRY “surgical procedure” means a surgical procedure listed in the Saskatchewan Surgical Registry Procedure List that is performed on a patient; “surgical services entity” means a person or entity, other than a health care organization, that receives funding from the provincial health authority to provide a surgical procedure. 3 May 2024 cP-30.2 Reg 3 s2. Application of regulations 3(1) Subject to subsection (2), these regulations apply to all surgical procedures performed at a surgical facility that is operated by: (a) the provincial health authority; (b) a health care organization; or (c) a surgical services entity. (2) These regulations do not apply to a surgical procedure that is not funded by the provincial health authority. 3 May 2024 cP-30.2 Reg 3 s3. Submission of information generally 4 All information required to be submitted to the surgical registry pursuant to these regulations must be submitted in a format acceptable to the minister and in accordance with the Saskatchewan Surgical Registry Policies and Procedures manual. 3 May 2024 cP-30.2 Reg 3 s4. Information before planned surgical procedure 5(1) If an operator receives information respecting a planned surgical procedure that is to be performed at a surgical facility that it operates, the operator shall submit the following information to the surgical registry with respect to the planned surgical procedure: (a) the surgical procedure to be performed, as that procedure is listed in the Saskatchewan Surgical Registry Procedure List; (b) whether the surgical procedure will be performed on an in-patient or out-patient basis; (c) the name of the surgical facility at which the surgical procedure is to be performed; (d) the name of: (i) the patient’s family physician; and (ii) the physician, surgeon or dentist who is to perform the surgical procedure; 5 SURGICAL REGISTRY, 2024 P-30.3 REG 3 (e) the date on which the patient was referred to the physician, surgeon or dentist for the surgical procedure and the date of the patient’s initial visit with that physician, surgeon or dentist; (f) the assessment by the physician, surgeon or dentist of the patient’s diagnosis, using the Saskatchewan Provincial Diagnosis Code List; (g) the name, address, telephone number, date of birth, sex and health services number of the patient; (h) a list of any dates on which the patient is not available for surgery and the reason for the unavailability; (i) all additional surgical data that is required to be submitted pursuant to the Saskatchewan Surgical Registry Policies and Procedures manual. (2) The operator must submit the information mentioned in subsection (1) to the surgical registry within 7 days after receiving the information and, in any event, before the planned surgical procedure takes place. (3) If the operator receives any change to the information submitted to the surgical registry pursuant to subsection (2) with respect to a planned surgical procedure, the operator must, within 5 days after receiving the change of information, submit the change of information to the surgical registry. 3 May 2024 cP-30.2 Reg 3 s5. Clinical priority 6 The clinical priority of a planned surgical procedure to be performed in a surgical facility shall be based on the information submitted by the operator to the surgical registry pursuant to clause 5(1)(f). 3 May 2024 cP-30.2 Reg 3 s6. Information after planned surgical procedure 7 Within 7 days after a planned surgical procedure is performed, the operator of the surgical facility at which the planned surgical procedure was performed must submit the following information to the surgical registry: (a) the surgical procedure that was performed, as that procedure is listed in the Saskatchewan Surgical Registry Procedure List; (b) whether the surgical procedure was performed on an in-patient or out-patient basis; (c) the name of the surgical facility at which the surgical procedure was performed; (d) the name of the physician, surgeon or dentist who performed the surgical procedure; (e) the date on which the surgical procedure was performed; (f) the type of anaesthesia that was used; (g) the date on which the patient was discharged from the surgical facility and the circumstances of discharge. 3 May 2024 cP-30.2 Reg 3 s7. 6 P-30.3 REG 3 SURGICAL REGISTRY Information after emergency surgical procedure 8 Within 7 days after the day on which an emergency surgical procedure is performed, the operator of the surgical facility at which the emergency surgical procedure was performed must submit to the surgical registry the information mentioned in clause 5(1)(h) and section 7 with respect to the emergency surgical procedure. 3 May 2024 cP-30.2 Reg 3 s8. Information sharing 9(1) For the purposes of subsection 2-11(4) of the Act, a physician, surgeon or dentist who provides health services to a patient is prescribed as a person to whom the minister may disclose information from the surgical registry with respect to that patient. (2) The minister may, pursuant to subsection 2-11(4) of the Act, disclose information from the surgical registry with respect to a patient only to the following: (a) the provincial health authority; (b) a health care organization; (c) a surgical services entity. (3) Information from the surgical registry that is being disclosed pursuant to subsection 2-11(4) of the Act may be provided electronically or in writing. 3 May 2024 cP-30.2 Reg 3 s9.
