1 SEAT BELT EXEMPTION T-18.1 REG 14 The Seat Belt Exemption Regulations, 2014 being Chapter T-18.1 Reg 14 (effective June 27, 2014) as amended by Saskatchewan Regulations 129/2020. NOTE: This consolidation is not official. Interpretation 2 In these regulations: (a) “Act” means The Traffic Safety Act; (b) “Class”, with respect to a motor vehicle, means a Class established pursuant to The Vehicle Classification and Registration Regulations. 4 Jly 2014 cT-18.1 Reg 14 s2. Exemptions re seat‑belt assembly for certain drivers 3 The following persons are exempt from the requirements set out in subsection 248(1) of the Act: (a) the driver of a motor vehicle when travelling at less than 40 kilometres per hour and making intermittent stops at intervals of 100 metres or less if the motor vehicle is being used for: (i) transporting and clearing garbage from a municipality; (ii) door-to-door delivery of dairy products; (iii) transporting items for a municipality for recycling; or (iv) mail delivery; (b) the driver of a motor vehicle registered in Class PT while transporting passengers for hire; (c) a police officer while the police officer is transporting prisoners or other persons who, in the opinion of the police officer, represent a danger to the personal safety of the police officer, except where provision has been made for the safety of the police officer. 4 Jly 2014 cT-18.1 Reg 14 s3. Exemptions re certain drivers of Class PC motor vehicle 4 The driver of a motor vehicle that is registered in Class PC is exempt from subsection 248(1) of the Act if: (a) the driver is operating the motor vehicle on a regularly scheduled route and the motor vehicle is travelling at less than 40 kilometres per hour; or (b) the driver has reason to believe that his or her safety may be compromised. 4 Jly 2014 cT-18.1 Reg 14 s4. 4 T-18.1 REG 14 SEAT BELT EXEMPTION Exemption re seat‑belt assembly for certain passengers 5 Subsection 248(2) of the Act does not apply to a passenger riding in a motor vehicle if: (a) the motor vehicle is a school bus registered in Class PB; (b) the motor vehicle is registered in the following Classes: (i) Class PC; (ii) Class PS; or (c) the passenger is under lawful arrest or has been committed to, or is currently being held or detained in, a correctional facility, jail, remand centre, penitentiary, detention centre or other custodial centre. 4 Jly 2014 cT-18.1 Reg 14 s5. Exemptions for drivers of certain motor vehicles re passengers under 16 years 6 Subsection 248(4) of the Act does not apply to the driver of a motor vehicle if the motor vehicle: (a) is registered in: (i) Class PC or PS; (ii) Class PT and is transporting passengers for hire; (iii) Class PB and is a school bus or is transporting passengers for hire; or (iv) Class LV and is transporting passengers for hire as part of a vehicle-for-hire service as defined in The Vehicles for Hire Act; or (b) is used to transport passengers who occupy a stretcher and the following requirements are met: (i) the motor vehicle complies with section 3 of The Vehicle Equipment Regulations, 1987; and (ii) the stretcher is: (A) approved by the stretcher manufacturer for the transportation of passengers in a motor vehicle; (B) equipped with a restraint system that is authorized by the stretcher manufacturer and that restraint system is used in accordance with the manufacturer’s specifications; and (C) installed and secured in the motor vehicle in accordance with the manufacturer’s specifications. 24 Dec 2020 SR 129/2020 s2. 5 SEAT BELT EXEMPTION T-18.1 REG 14 Motor vehicles manufactured before 1993 7 Clause 248(4)(b) of the Act does not apply to passengers riding in a motor vehicle that was manufactured before 1993 and that does not contain a lap-shoulder seat-belt assembly. 4 Jly 2014 cT-18.1 Reg 14 s7. R.R.S. c.H‑3.1 Reg 21 repealed 8 The Seat‑belt Exemption Regulations, 2002 are repealed. 4 Jly 2014 cT-18.1 Reg 14 s8. Coming into force 9(1) Subject to subsection (2), these regulations come into force on the day on which section 24 of The Traffic Safety Amendment Act, 2014 comes into force.
