Definitions 2 In these regulations: “Act” means The Health Administration Act; “clinical criteria” means the criteria established by an out-of-province facility, and approved by the minister, that the facility considers necessary to ensure that persons selected for procedures are physically fit and can safely receive the procedure in the facility and be discharged within 24 hours after the procedure; “eligible patient” means a beneficiary: (a) who is on a wait list in Saskatchewan for a procedure urgently required for the diagnosis or treatment of breast cancer; and (b) who, because of that wait list: (i) has waited for longer than the clinically-prescribed time for the procedure; or (ii) will wait for longer than the clinically-prescribed time for the procedure if the procedure is to be performed in Saskatchewan; “out‑of‑province facility” means a health care facility in Canada but outside Saskatchewan that has entered into an agreement with the minister for the purpose of providing procedures to persons designated pursuant to section 3; “procedure” means a diagnostic or surgical procedure related to breast health that may include diagnostic mammography, image-guided biopsy or other surgical or diagnostic modalities. 2 Feb 2024 c H-0.0001 Reg 2 s2. Designation of eligible persons 3(1) Persons who meet the criteria set out in subsection (2) are designated pursuant to clause 6.1(a) of the Act as persons for whom the minister may pay part or the whole of the cost of the procedures provided to those persons at out-of-province facilities. (2) For the purposes of subsection (1), the person must: (a) reside in Saskatchewan; (b) be selected and recommended to the minister by the Saskatchewan Health Authority as an eligible patient; (c) meet the clinical criteria for the out-of-province facility that will provide the procedure; and 4 URGENT ACTION ON BREAST CANCER H-0.0001 REG 2 DIAGNOSIS AND TREATMENT (d) be accepted by the minister as being a person for whom part or the whole of the cost of the procedure provided to that person at an out-of-province facility will be paid by the minister. 2 Feb 2024 c H-0.0001 Reg 2 s3. Agreements 4 The minister may enter into agreements with out-of-province facilities for the provision of procedures pursuant to these regulations. 2 Feb 2024 c H-0.0001 Reg 2 s4. Payments 5(1) Subject to subsection (2), the minister may make payment for procedures provided to persons described in section 3 at out-of-province facilities between December 1, 2023 and March 31, 2027.
