Interpretation 2(1) In these regulations: (a) “Act” means The Traffic Safety Act; (b) Repealed. 23 Dec 2016 SR 100/2016 s3. (c) “DWI course” means a Driving Without Impairment course of studies approved by the administrator; (d) “ignition interlock program” means a program that enables a driver to operate a motor vehicle with an ignition interlock device subject to the terms and conditions set out in The Driver Licensing and Suspension Regulations, 2006; (e) “passenger kilometre” means the transportation of one passenger one kilometre in Saskatchewan; (f) “perpetual trailer registration” means a certificate of registration for a trailer or semi-trailer that, subject to subsection 60(2), (3) or (4) of the Act, will not expire unless suspended or revoked by the administrator; (g) “Table” means a Table as set out in the Appendix; (h) “tonne kilometre” means one tonne gross weight moved a distance of one kilometre in Saskatchewan and, for the purposes of calculation, fractions of a tonne are to be calculated to the nearest tonne. (2) A reference in these regulations to a class of vehicles is to the class that is established pursuant to The Vehicle Classification and Registration Regulations. 7 Jly 2006 cT-18.1 Reg 3 s2; 23 Dec 2016 SR 100/2016 s3. 4 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES PART II Vehicle Registration Fees DIVISION 1 Fees by Class of Vehicle Definition 2.1 For the purposes of this Part, “rounded as necessary” means that any part of a calculation that is expressed in dollars is rounded to the nearest cent. 26 Apr 2024 SR 24/2024 s3. Class A 3 If a vehicle is to be registered with the administrator as a Class A vehicle and: (a) the applicant applies to be restricted from pickup in Saskatchewan for delivery in Saskatchewan and the vehicle is validly registered in a province or state that has a reciprocity agreement with Saskatchewan that has not been repealed, the registration fee is the fee provided in the reciprocity agreement; (b) Repealed. 23 Dec 2016 SR 100/2016 s4. Class PB 4 If a vehicle is to be registered with the administrator as a Class PB vehicle, the registration fee: (a) in the case of an applicant who applies for and is entitled to register the vehicle pursuant to the IRP, is the fee determined pursuant to the IRP; or (b) in the case of a vehicle other than one described in clause (a): (i) if the vehicle operates at a gross vehicle weight of less than 5 001 kilograms, is $105; or (ii) if the vehicle operates at a gross vehicle weight exceeding 5 000 kilograms, is the fee determined in accordance with Table 3. 7 Jly 2006 cT-18.1 Reg 3 s4. 5 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 Class PC 5 If a vehicle is to be registered with the administrator as a Class PC vehicle, the registration fee is $48. 7 Jly 2006 cT-18.1 Reg 3 s5. (c) the applicant applies and is entitled to register pursuant to the IRP, the registration fee is the fee determined pursuant to the IRP; (d) the applicant is an applicant other than one described in clause (a) or (c), the registration fee is one-half of the fee determined in accordance with Table 5, in the case of a vehicle: (i) that operates at a gross vehicle weight exceeding 5 000 kilograms; (ii) on which machinery or equipment is permanently mounted; and (iii) that is not used for the conveyance of goods, wares, merchandise or other commodities; or (e) the vehicle is a vehicle other than one described in clauses (a) to (d): (i) the registration fee, in the case of a vehicle that operates at a gross vehicle weight exceeding 5 000 kilograms, is the fee determined in accordance with Table 5; (ii) the registration fee, in the case of a vehicle other than one described in subclause (i), is $68. 7 Jly 2006 cT-18.1 Reg 3 s8; 23 Dec 2016 SR 100/2016 s5. 6 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES Class D 9 If a vehicle is to be registered with the administrator as a Class D vehicle and: (a) the applicant applies to be restricted from pickup in Saskatchewan for delivery in Saskatchewan and the vehicle is validly registered in a province or state that has a reciprocity agreement with Saskatchewan that has not been repealed, the registration fee is the fee provided in the reciprocity agreement; (b) Repealed. 23 Dec 2016 SR 100/2016 s6. Class TS 10(1) The fee to register a vehicle as a Class TS vehicle is: (a) $32 for an annual certificate of registration; or (b) $100 for a perpetual trailer registration. (2) A trailer or semi-trailer registered in Class TS is not eligible for a perpetual trailer registration unless that trailer or semi-trailer is towed by a power unit. (3) The fee to transfer a Class TS perpetual trailer registration from one trailer or semi-trailer to another trailer or semi-trailer registered in the name of the same owner is $20. 7 Jly 2006 cT-18.1 Reg 3 s10. Class F 11(1) Subject to subsection (2), if a vehicle is to be registered with the administrator as a Class F vehicle and: (a) the vehicle operates at a gross vehicle weight exceeding 5 000 kilograms: (i) the registration fee, in the case of a vehicle of a model year of 1965 or earlier, is $31; or (ii) the registration fee, in the case of a vehicle other than one described in subclause (i), is the fee determined in accordance with Table 2; or 7 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 (b) the vehicle is a vehicle other than one described in clause (a): (i) the registration fee, in the case of a vehicle of a model year of 1941 or earlier, is $5; or (ii) the registration fee, in the case of a vehicle other than one described in subclause (i), is $68. (2) If a vehicle is to be registered with the administrator as a Class F vehicle and the vehicle is a trailer or semitrailer, the registration fee is $32. (3) The fee to transfer a Class F perpetual trailer registration from one trailer or semi-trailer to another trailer or semi-trailer registered in the name of the same owner is $10. 7 Jly 2006 cT-18.1 Reg 3 s11. Class PV 12 If a vehicle is to be registered with the administrator as a Class PV vehicle, the registration fee: (a) in the case of a vehicle that operates at a gross vehicle weight exceeding 5 000 kilograms, is the fee determined in accordance with Table 4; (b) in the case of a vehicle other than one described in clause (a), is $68; or (c) in the case of any vehicle of a model year of 1941 or earlier, is $5. 7 Jly 2006 cT-18.1 Reg 3 s12. Class LV 13 If a vehicle is to be registered with the administrator as a Class LV vehicle, the registration fee: (a) in the case of a motorcycle: (i) with an engine capacity of 50 cubic centimetres or less, is $34; (ii) other than a motorcycle described in subclause (i), is $50; (b) in the case of an industrial tracked vehicle, is $50; (c) in the case of a vehicle of a model year of 1941 or earlier, is $5; (d) in the case of a vehicle that operates at a gross vehicle weight exceeding 5 000 kilograms, other than a vehicle described in clause (a), (b) or (c), is the fee determined in accordance with Table 6; or (e) in the case of a vehicle other than one described in clauses (a) to (d), is $68. 7 Jly 2006 cT-18.1 Reg 3 s13. Class T 14 If a vehicle is registered with the administrator as a Class T vehicle without a registered gross vehicle weight, the registration fee is $28. 7 Jly 2006 cT-18.1 Reg 3 s14. 8 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES Rebate of fees for certain green (fuel efficient or hybrid) vehicles 14.1(1) In this section and in section 14.2: (a) “co-owner” means any person who is the registered owner of a vehicle together with one or more individuals; (b) “eligible green vehicle” means an eligible vehicle as defined in Part III.2 of The Automobile Accident Insurance (General) Regulations, 2002; (c) “eligible period” means eligible period within the meaning of Part III.2 of The Automobile Accident Insurance (General) Regulations, 2002; (d) “green vehicle rebate” means a green vehicle rebate payable pursuant to Part III.2 of The Automobile Accident Insurance (General) Regulations, 2002; (e) “outstanding indebtedness” means, with respect to a person, an indebtedness of that person that: (i) is outstanding on the date that a rebate is payable to that person; and (ii) is owed: (A) to the insurer pursuant to The Automobile Accident Insurance Act or pursuant to any regulations made pursuant to that Act; (B) to the administrator pursuant to a deductible finance agreement and that person has defaulted on a payment pursuant to that deductible finance agreement; or (C) to the administrator for any fee or charge imposed on that person pursuant to the Act; (f) “owner’s certificate” means an owner’s certificate as defined in The Automobile Accident Insurance Act; (g) “rebate” means a rebate respecting registration fees in accordance with this section. (2) Subject to subsections (3) to (6) and to section 14.2, if a vehicle to be registered with the administrator in accordance with this Division is an eligible green vehicle and the person registering the eligible green vehicle is entitled to a green vehicle rebate for the eligible green vehicle, the administrator shall pay a rebate to the person who is eligible for the green vehicle rebate. (3) Repealed. 24 Apr 2009 SR 38/2009 s2. (4) The amount of a rebate payable to a person with respect to each eligible green vehicle registered in the person’s name during the eligible period is the amount PR calculated in accordance with the following formula: PR = RF x 20% where RF is the registration fee for each eligible green vehicle registered in the person’s name during the eligible period. 9 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 (5) If the person did not hold an owner’s certificate for an eligible green vehicle for every day in the eligible period: (a) the insurer shall prorate the amount of the rebate payable for the eligible vehicle based on the number of days the eligible insured held that owner’s certificate in the eligible period; and (b) the eligible insured is eligible to be paid only the prorated rebate with respect to that eligible vehicle. (6) A person is not entitled to the rebate in accordance with this section if the combined amount of the green vehicle rebate and the rebate in accordance with this section to which that person is otherwise eligible is less than $5. 18 Apr 2008 SR 26/2008 s2; 24 Apr 2009 SR 38/2009 s2. Set-off of rebates 14.2(1) Subject to subsection (3), if a person is, pursuant to section 14.1, eligible for a rebate and that person has an outstanding indebtedness, the insurer may: (a) if the indebtedness is equal to or greater than the amount of the rebate, apply all of the rebate towards satisfaction of the eligible insured’s outstanding indebtedness; or (b) if the indebtedness is less than the amount of the rebate, apply that portion of the rebate that is required to satisfy the person’s outstanding indebtedness, and pay any remainder of the rebate to the person. (2) Any set-off pursuant to subsection (1) shall reduce the person’s outstanding indebtedness by the amount of the rebate that is applied. (3) This section does not apply to a rebate owed to a person who is a co-owner unless all listed co-owners on the owner’s certificate have the same outstanding indebtedness. 18 Apr 2008 SR 26/2008 s2. DIVISION 2 Registration Fees for Persons Dealers 15 If, pursuant to section 68 of the Act, a person applies to be registered as a licensed dealer, the fee for the licence is $105. 7 Jly 2006 cT-18.1 Reg 3 s15. Police departments 16(1) The fee for a certificate of registration issued to a police service pursuant to section 69 of the Act is $105. (2) No more than five vehicles may be registered pursuant to a certificate of registration issued pursuant to subsection (1). 7 Jly 2006 cT-18.1 Reg 3 s16. 10 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES Fee for drivers 17(1) In this section, “five-year driver’s licence” means a driver’s licence issued pursuant to section 40 of the Act that expires five years after the date of its issue. (2) Subject to subsection (4), the fee for a five-year driver’s licence is: (a) $100, if the person applying for the five-year driver’s licence elects to pay the full fee at the time the administrator issues the applicant his or her driver’s licence; or (b) $125, if the person applying for the five-year driver’s licence elects to pay for his or her driver’s licence in annual instalments of $25. (3) If a person elects to pay for his or her five-year driver’s licence in annual instalments of $25 pursuant to clause (2)(b), each annual instalment of $25 is due and owing on the date indicated by the administrator. (4) If a driver’s licence is issued to an applicant by the administrator on or after January 1, 2011 and the administrator elects to issue the driver a licence for a period of less than five years, the fee the driver must pay pursuant to either clause (2) (a) or (b) is prorated so that the fee bears the same proportion to the total fee as the number of months for which the licence is to be in force bears to 60 months, rounded as necessary. 10 Dec 2010 SR 119/2010 s3; 26 Apr 2024 SR 24/2024 s4. Fee for “6” or “M” endorsement 17.1(1) In this section and in section 17.2, “driver’s licence” means a driver’s licence to operate a motorcycle. (2) Pursuant to clause 268(2)(f) of the Act, the administrator shall retain the fees collected pursuant to this section. (3) Subject to subsection (4), in addition to the fees prescribed in section 17, a driver must pay a fee of $500: (a) to obtain a driver’s licence with a “6” endorsement; (b) to obtain a driver’s licence with an “M” endorsement with a novice 1 restriction; (c) to obtain a driver’s licence with an “M” endorsement with a novice 2 restriction; or (d) to obtain a driver’s licence with a “6” endorsement, “M” endorsement with a novice 1 restriction or “M” endorsement with a novice 2 restriction, if the driver’s previous endorsement expired for more than five years before the date of the application to obtain the driver’s license. (4) The fee set out in subsection (3) is not payable: (a) for a “6” endorsement if, before obtaining a driver’s licence with a “6” endorsement, the driver successfully completes a motorcycle training course acceptable to the administrator; 11 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 (b) for an “M” endorsement with a novice 1 restriction if, before obtaining a driver’s licence with an “M” endorsement with a novice 1 restriction, the driver successfully completes a motorcycle training course acceptable to the administrator; or (c) for an “M” endorsement with a novice 2 restriction if, before obtaining a driver’s licence with an “M” endorsement with a novice 2 restriction, the driver successfully completes a motorcycle training course acceptable to the administrator. (5) A driver is required to successfully complete a motorcycle training course acceptable to the administrator only once for the purposes of subsections (3) and (4), unless otherwise required to complete a motorcycle training course pursuant to the Act or regulations. (6) If a driver applies for a driver’s licence with an “M” endorsement with no novice restrictions, and has completed a motorcycle training course acceptable to the administrator on or after January 1, 2016, the administrator shall refund the driver the amount of $450 if all of the following apply: (a) at the time the driver obtains his or her “M” endorsement with no novice restrictions, he or she has not been convicted of a contravention of any of the following while operating a motorcycle: (i) this Act or the regulations; (ii) an offence as defined in section 137 of the Act; (iii) a law of any province or territory in Canada or a bylaw of a municipal corporation in Canada that is substantially similar to a an offence in clause (i) or (ii); and (b) at the time the driver obtains his or her “M” endorsement with no novice restrictions, he or she has not been held to be 50% or more at fault for a motor vehicle accident involving the operation of a motorcycle. 17 Jne 2016 SR 39/2016 s3. Transitional 17.2(1) Section 17.1 applies only to those persons who, before the coming into force of that section, did not hold a driver’s licence with a “6” endorsement, “M” endorsement with a novice 1 restriction or “M” endorsement with a novice 2 restriction. (2) Notwithstanding subsection (1), if a driver holds a driver’s licence with a “6” endorsement, “M” endorsement with a novice 1 restriction or “M” endorsement with a novice 2 restriction before the coming into force of section 17.1, and for any reason is required by the administrator to reapply for his or her “6” endorsement, section 17.1 applies, with any necessary modification. 17 Jne 2016 SR 39/2016 s3. 12 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES DIVISION 3 Other Registration Fees Fee re moving vehicles 18(1) Subject to subsection (1.1), the fee for each registration permit that is valid for seven days is $13 if the registration permit is for the purpose of operating or moving a motor vehicle, trailer or semi-trailer from a point in Saskatchewan to a point in another province. (1.1) No registration permit mentioned in subsection (1) shall be issued for the commercial purpose of transporting passengers, commodities or equipment that is mounted on or attached to a motor vehicle. (2) Subject to subsection (3), the fee for each registration permit that is valid for 24 hours is $15 if the registration permit authorizes the operation of: (a) an empty motor vehicle or an empty motor vehicle while towing an empty trailer or empty semitrailer; (b) a trailer or semi-trailer, either empty or with a load; (c) a motor home when transporting goods for private purposes; or (d) a motor vehicle transporting goods when operating at a gross vehicle weight of up to and including 5 000 kilograms. (2.1) Subject to subsection (3), the fee for each registration permit that is valid for eight days is $24 if the registration permit authorizes the operation of: (a) an empty motor vehicle or an empty motor vehicle while towing an empty trailer or empty semi-trailer; (b) a trailer or semi-trailer, either empty or with a load; (c) a motor home when transporting goods for private purposes; or (d) a motor vehicle transporting goods when operating at a gross vehicle weight of up to and including 5 000 kilograms. (3) The following vehicles are not eligible for a registration permit pursuant to subsection (2) or (2.1): (a) a vehicle used for the transportation of passengers for compensation in a taxi or bus operation; or (b) a vehicle used for the transportation of more than eight students to and from school. 7 Jly 2006 cT-18.1 Reg 3 s18; 19 Feb 2010 SR 6/2010 s3. 13 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 Fee to transport goods, etc. 19(1) The fee for a registration permit that is for the transportation of passengers, goods, wares, merchandise and other commodities and that is not for a purpose described in section 18: (a) subject to clause (b), is $0.006 per tonne kilometre or per passenger kilometre or $11, whichever is greater, for a vehicle, combination of vehicles or a towing vehicle in a combination of vehicles that is not registered with the administrator or proposed to be operated in a class other than the class in which it is registered; (b) is $11 if: (i) the vehicle or trailer is registered but proposed to be operated in a class other than the class in which it is registered; (ii) the fee for registering the vehicle or trailer in a class in which it is proposed to be operated is identical to or lower than the fee for registering the vehicle or trailer in the class in which it is already registered; and (iii) the registration permit is issued for a period of three days or less; (c) is $0.036 for each tonne kilometre of excess weight or $11, whichever is greater, for each vehicle that: (i) is registered with the administrator; (ii) is to be operated for a single trip; and (iii) has a gross vehicle weight in excess of the gross vehicle weight for which the vehicle is registered; (d) subject to subsection (5), for each vehicle that is registered with the administrator, that is to be operated for other than a single trip and that has a gross vehicle weight in excess of the gross vehicle weight for which the vehicle is registered, per year is the total of: (i) the fee payable for that class of vehicle at the permit weight less the fee payable for that class of vehicle at its registered gross vehicle weight; and (ii) $75 per tonne or part of a tonne that the permit weight exceeds the maximum fee payable for that class; (e) notwithstanding clauses (a) to (d), is $72 for the operation of a vehicle that: (i) is owned by a resident of a state or province other than Saskatchewan; (ii) is registered in a state or province other than Saskatchewan; (iii) is used for the transportation of a travelling show; and (iv) is issued for a period of 60 days or less; 14 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES (f) issued to a resident of a state or province other than Saskatchewan for the transportation of exhibits or livestock to be shown or displayed at exhibitions or race meets, or for the transportation of dogs to field trials, is $11 for each round trip; (g) for each loaded semitrailer or trailer that is not registered with the administrator but that is attached to a power unit that is registered with the administrator, is $11 for each round trip. (2) For the purpose of calculating fees pursuant to clauses (1)(a) and (c), fractions of a tonne are to be calculated to the nearest tonne. (3) The maximum fee payable pursuant to clause (1)(a) or (c) for each registration permit for a vehicle operated by a resident of Saskatchewan is $120. (4) Subject to subsections (5) and (6), if the Ministry of Highways issues a permit described in clause (1)(d) for a period of less than one year, the fee shall be prorated so that the fee levied bears the same proportion to the total fee as the number of days for which the permit is to be in force bears to 365 days, rounded as necessary. (5) The minimum fee payable for a permit described in clause (1)(d) is $10. (6) If the permit mentioned in clause (1)(d) is issued pursuant to section 8 of The Vehicle Weight and Dimension Regulations, 1999 and allows transportation of forest products for the winter season as designated in an agreement pursuant to section 19 of The Vehicle Weight and Dimension Regulations, 1999: (a) the fee is one-quarter of the fee prescribed in clause (1)(d); and (b) subsection (4) does not apply. 7 Jly 2006 cT-18.1 Reg 3 s19; 19 Feb 2010 SR 6/2010 s4; 26 Apr 2024 SR 24/2024 s5. Winter weight season operations 20(1) In this section, “winter weight season” means the period prescribed in The Vehicle Weight and Dimension Regulations, 1999. Calculation of fees 21 For the purposes of calculating the fees pursuant to this Division, the weight of a towing unit is to be included in the application for registration if the unit is not registered with the administrator. 7 Jly 2006 cT-18.1 Reg 3 s21. 15 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 DIVISION 4 General Matters respecting Registration Fees Prorating of fees 22(1) Subject to subsection (2), if the fee to be paid for a certificate of registration is required to be prorated by the administrator, the registration fee determined in accordance with this Part is to be adjusted so that the fee levied bears the same proportion to the total fee as the number of days for which the certificate is to be in force bears to 365 days, rounded as necessary. (2) If the fee to be paid for a certificate of registration may be prorated, and if the amount is calculated in another jurisdiction on behalf of Saskatchewan pursuant to the IRP, the registration fee calculated pursuant to these regulations: (a) is to be prorated in accordance with subsection (1); or (b) is to bear the same proportion to the total fee as the number of days for which the certificate is to be in force bears to 365 days, rounded as necessary. (3) If a person applies to register a vehicle with the administrator and elects, at the same time, to pay the basic premium for the vehicle in instalments pursuant to section 5 of The Automobile Accident Insurance (General) Regulations, 2002, the person is deemed to have elected to pay the registration fee for the vehicle in instalments in accordance with, as the case may be: (a) subsections (4), (5), (6), (7), (8), (9), (10), (11) and (12); or (b) subsections (4.1), (5.1), (6.1), (7.1), (8), (9), (10), (11) and (12). (4) On the date of the deemed election mentioned in subsection (3), the person shall pay: (a) a down payment of the registration fee calculated in accordance with subsection (5); (b) if required in the circumstances mentioned in subsection (6), a one-time fee; and (c) a finance fee equal to 4% of the total of the amounts payable pursuant to clauses (a) and (b). (4.1) Notwithstanding subsection (4), if the date of the deemed election mentioned in subsection (3) is on or after a date set by the insurer pursuant to The Automobile Accident Insurance Act and the deemed election is with respect to a class of vehicle as determined by the insurer pursuant to The Automobile Accident Insurance Act, on the date of the first monthly payment mentioned in subsection (8), the person shall pay: (a) a down payment of the registration fee calculated in accordance with subsection (5.1); (b) if required in the circumstances mentioned in subsection (6.1), a one-time fee; and (c) a finance fee equal to 4% of the total of the amounts payable pursuant to clauses (a) and (b). 16 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES (5) The down payment of the registration fee payable pursuant to clause (4)(a) is the amount RF calculated in accordance with the following formula: ARF x CWD RF = 365 where: ARF is the annual registration fee for the vehicle being registered; and CWD is the number of days from and including the date the certificate of registration is issued to the applicant up to and including the date designated by the person as the date the first monthly instalment is to be paid. (5.1) The down payment of the registration fee payable pursuant to clause (4.1) (a) is $0. (6) For the purposes of clause (4)(b), if, at the date of the deemed election, the administrator determines that the amount of the annual registration fee remaining after payment of the down payment calculated pursuant to subsection (5) cannot be divided into 11 equal monthly instalments: (a) the administrator shall: (i) determine equal monthly instalment payments for each of the 11 payment months; and (ii) determine the amount of the annual registration payable that would remain after payment of the 11 monthly instalments mentioned in subclause (i); and (b) the applicant shall, on the date of the deemed election, pay the amount mentioned in subclause (a)(ii) as a one-time fee. (6.1) For the purposes of clause (4.1)(b), if, at the date of the deemed election, the administrator determines that the amount of the annual registration fee remaining after payment of the down payment calculated pursuant to subsection (5.1) cannot be divided into 12 equal monthly instalments: (a) the administrator shall: (i) determine equal monthly instalment payments for each of the 12 payment months; and (ii) determine the amount of the annual registration payable that would remain after payment of the 12 monthly instalments mentioned in subclause (i); and (b) the applicant shall pay the amount mentioned in subclause (a)(ii) as a one-time fee. (7) For the purposes of subsection (4), in each month of the first 11 months following the date of the deemed election, the person shall pay a monthly amount equal to the sum of: (a) a monthly instalment calculated by dividing the registration fee remaining to be paid into 11 equal monthly instalments; and (b) a finance fee of 4% of the monthly instalments paid pursuant to clause (a). 17 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 (7.1) For the purposes of subsection (4.1), in each month of the first 12 months following the date of the deemed election, the person shall pay a monthly amount equal to the sum of: (a) a monthly instalment calculated by dividing the registration fee remaining to be paid into 12 equal monthly instalments; and (b) a finance fee of 4% of the monthly instalments paid pursuant to clause (a). (8) A person who is deemed to have made an election shall pay the monthly amount mentioned in subsection (7) or (7.1), as the case may be, on the date each month that is designated by that person to the administrator. (9) In each month of each year after the anniversary date of his or her deemed election, the person shall pay a monthly amount equal to the monthly amount required by subsection (10). (10) For the purposes of subsection (9), the monthly amount the person shall pay is: (a) if, at the anniversary date, the administrator determines that the annual registration fee: (i) can be divided into 12 equal monthly instalments, the monthly instalment as determined by the administrator; or (ii) cannot be divided into 12 equal instalments, the monthly instalments determined pursuant to subclause (11)(a)(i); and (b) a finance fee of 4% of the monthly instalments paid pursuant to clause (a). (11) If, on each anniversary date after the deemed election, the administrator determines that the annual registration fee to be paid by the person for the following year cannot be divided into 12 equal monthly instalments for each of the 12 payment months in the following year: (a) the administrator shall: (i) determine equal monthly instalment amounts for each of the 12 payment months; and (ii) determine the amount of the annual registration payable that would remain after payment of the 12 monthly instalments mentioned in subclause (i); and (b) the person shall, along with his or her first monthly instalment payment, pay the amount mentioned in subclause (a)(ii) as a one-time fee and a finance fee equal to 4% of the one-time fee. (12) A person who is deemed to have made an election shall pay the monthly amount mentioned in subsection (10) on the date each month that is designated by that person to the administrator.. 7 Jly 2006 cT-18.1 Reg 3 s22; 19 Feb 2010 SR 6/2010 s5; 26 Apr 2024 SR 24/2024 s6. 18 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES Refunds 23(1) In this section, “outstanding indebtedness” means, with respect to a person, an indebtedness of that person that: (a) is owed to the administrator on the date that a refund is payable to that person; and (b) is owed: (i) to the insurer pursuant to The Automobile Accident Insurance Act or pursuant to any regulations made pursuant to that Act; (ii) to the administrator pursuant to a deductible finance agreement and that person has defaulted on a payment pursuant to that deductible finance agreement; or (iii) to the administrator for any fee or charge imposed on that person pursuant to the Act. (2) Subject to subsections (3) to (5), the minister or the board may, on the application by or on behalf of the person seeking the refund: (a) authorize a full refund of the registration fee paid for one Class PV or Class LV vehicle registered in the name of an amputee who is a member of the Saskatchewan Branch of the War Amputations of Canada; (b) authorize a full refund of the registration fee paid for one Class PV or Class LV vehicle registered in the name of a paraplegic or quadriplegic who is a member of the Saskatchewan Division of the Canadian Paraplegic Association; (c) authorize a full refund of the registration fee paid for one Class PV or Class LV vehicle registered in the name of a member of the Consular Corps; or (d) authorize a proportionate refund for the cancellation of a certificate of registration for a vehicle, but, if a refund is authorized pursuant to this clause, the administrator may retain an administration fee of $10. (3) If the administrator considers that it is appropriate to do so in order to relieve financial hardship or an undue adverse effect on a person whose driver’s licence has been suspended, revoked or cancelled by the administrator, the administrator may authorize a refund of the driver’s licence fee, or a portion of it, paid by the person, but, if a refund is authorized pursuant to this subsection, the administrator may retain an administration fee of $15. (4) If a person is eligible for a refund pursuant to this section and the person has an outstanding indebtedness, the administrator may: (a) if the outstanding indebtedness is equal to or greater than the amount of the refund, apply all of the refund towards satisfaction of that outstanding indebtedness; or (b) if the outstanding indebtedness is less than the amount of the refund: (i) apply that portion of the refund required to satisfy the outstanding indebtedness; and (ii) pay any remainder of the refund to the person. 19 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 (5) Notwithstanding subsections (2) to (4): (a) no refund may be authorized and no refund is payable for the cancellation of a perpetual trailer registration; and (b) the administrator is not required to pay, and no person is eligible for, a refund if the amount of the refund is less than $5. 10 Dec 2010 SR 119/2010 s4; 23 Dec 2016 SR 100/2016 s7; 14 Dec 2018 SR 86/2018 s3. Transfers of registration 24(1) A registrant shall pay a registration fee calculated pursuant to subsection (2) if the registrant applies to transfer a certificate of registration from a vehicle that has been disposed of or whose use has been discontinued to another vehicle that is to be registered. (2) The registration fee required to be paid pursuant to subsection (1) is the amount F calculated in accordance with the following formula: F = NF – OF where: NF is the registration fee that would otherwise be required to be paid pursuant to these regulations for a certificate of registration for the vehicle with respect to which the certificate of registration is to be transferred; and OF is the prorated amount of the registration fee that was paid pursuant to these regulations or a predecessor to these regulations for the certificate of registration for the vehicle that has been disposed of or whose use has been discontinued. (3) For the purposes of subsection (2): (a) the prorated amount mentioned in OF of the formula is to be based on the number of days since the certificate of registration was issued to the date of the transfer of the certificate of registration; and (b) subject to subsection (4), if the amount F is less than 0, the administrator shall refund that amount to the registrant as soon as possible after the transfer of the certificate of registration has been made. (4) The administrator is not required to make a refund pursuant to clause (3)(b) if the amount of the refund is less than $5. (5) Notwithstanding subsections (1) to (3), if a registrant applies to transfer a perpetual trailer registration to another trailer or semi-trailer, as the case may be, of the same class that is owned by the registrant, the total amount paid, other than the transfer fee required pursuant to subsection 10(3) or 11(3), to obtain the original perpetual trailer registration is to be applied against the other vehicle’s perpetual trailer registration fee. 20 T-18.1 REG 3 TRAFFIC SAFETY ACT FEES (6) Notwithstanding subsections (1) to (5), there is no refund of any registration fee if a registrant: (a) applies to transfer a perpetual trailer registration for another perpetual trailer registration of a different class of trailer or semi-trailer; or (b) applies to transfer a perpetual trailer registration for a trailer registration with a finite term. (7) Any registration fee required by this section is in addition to the fee that is otherwise required to be paid pursuant to section 10 or 11, and any money applied to the registration fee pursuant to this section shall not reduce the amount of any fee required pursuant to section 10 or 11. 7 Jly 2006 cT-18.1 Reg 3 s24. Trailers and semi-trailers 25 If a trailer or semitrailer is operated as part of a combination of vehicles, the combined gross vehicle weights of all the vehicles coupled or joined together and the combined weight of the load carried on all those vehicles is to be included in the registered gross vehicle weight of the towing vehicle. 7 Jly 2006 cT-18.1 Reg 3 s25. PART III Administration Fees Driver testing fees 26 The fee payable for: (a) each road test required pursuant to the Act in connection with the issuance of a driver’s licence is: (i) if the licence applied for is a Class 1, 2, or 3 driver’s licence, $100; (ii) if the licence applied for is a Class 4 or 5 driver’s licence, $55; (iii) if the endorsement applied for is a school bus endorsement, $40; (iv) if the endorsement applied for is a heavy trailer endorsement, $100; (v) if the endorsement or licence applied for is a motorcycle endorsement or licence, $55; and (vi) if the endorsement applied for is a well service rig endorsement, $75; (b) the issuance of an air brake endorsement requiring a practical test is $55; (c) the issuance of a pre-trip inspection test is $55; (d) the issuance of a well service rig air brake test is $25; (e) the issuance of a driver ability assessment road test, to determine a customer’s ability to operate a motor vehicle, is $75; (f) the issuance of a driver ability assessment written examination is $25; 21 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 (g) a test, other than one described in clauses (a) to (f), is $55; (h) each sitting at which one or more written examinations are taken, regardless of the number of examinations taken in a sitting, is $25; (i) in addition to the fees set out in clauses (a) to (h), the issuance of an oral exam if an individual is unable to complete a written exam is $85. 23 Dec 2016 SR 100/2016 s8. (2) The fee payable for: (a) a new personalized licence plate printed on a memorial cross licence plate, a regular licence plate, or veteran’s licence plate, other than a new personalized licence plate mentioned in clauses (b) to (e), is $75; (b) a new personalized licence plate issued to the holder of a radio operator certificate issued pursuant to the Radiocommunication Act (Canada) bearing the call sign of the holder is: (i) $25 if printed on a regular licence plate; (ii) $75 if printed on a special design licence plate or a Rider Pride licence plate; (iii) $100 if printed on a collector’s licence plate; or (iv) $125 if printed on a vintage Rider licence plate; (c) a new personalized licence plate printed on a Rider Pride licence plate or a special design licence plate is $125; (d) a new personalized licence plate printed on a collector’s licence plate is $150; 25 TRAFFIC SAFETY ACT FEES T-18.1 REG 3 (e) a new personalized licence plate printed on a vintage Rider licence plate is $175; (f) a non-personalized Rider Pride licence plate or special design licence plate is $50; (g) a non-personalized collector’s licence plate is $75; (h) a non-personalized vintage Rider licence plate is $100; (h.1) a non-personalized Support our Troops licence plate is $55; (i) each replacement or duplicate of a lost or existing regular licence plate, collector’s licence plate, memorial cross licence plate, Rider Pride licence plate, special design licence plate, veteran’s licence plate, Support our Troops licence plate, or vintage Rider licence plate with the same letters, numbers or combination of letters and numbers as the lost or existing regular licence plate, collector’s licence plate, memorial cross licence plate, Rider Pride licence plate, special design licence plate, veteran’s licence plate, Support our Troops licence plate or vintage Rider licence plate is $20; (j) each replacement of an existing personalized licence plate with the same letters, numbers or combination of letters and numbers as the existing personalized licence plate printed on: (i) a memorial cross licence plate or a veteran’s licence plate is $20; (ii) a Rider Pride licence plate or special design licence plate is $70; (iii) a collector’s licence plate is $95; (iv) a vintage Rider licence plate is $120; (j.1) a new regular licence plate, if that plate is less than 2 years old, is $15; (j.2) a replacement regular licence plate is $15; (k) a non-personalized licence plate printed on a special design licence plate is $50; (l) a vehicle registered as a Government of Canada vehicle, Class GC, except an RCMP vehicle is $37; (m) a vehicle registered as a Government of Canada vehicle, Class GC, RCMP vehicle is $15; (n) each transfer, exchange or replacement of a certificate of registration accomplished in one transaction is $15; (o) each permit issued by the administrator pursuant to the Act is $15; (p) Repealed. 23 Dec 2016 SR 100/2016 s15. (2) The fee payable for each registration search by licence plate number is $20. (3) The fee payable for confirmation of a driver’s licence record or vehicle registration record is $20 for each record. (4) The fee payable for each registration search by vehicle identification number is $20 for each vehicle identification number, if the number of searches done at one time does not exceed 25. (4.1) The fee payable for a registration search by vehicle identification number in each jurisdiction in Canada is: (a) if the number of searches does not exceed 25, $20 for each vehicle identification number searched; and (b) if the number of searches exceeds 25, $5 for each additional vehicle identification number searched. (5) The fee payable for registration searches by vehicle identification number if the number done at one time exceeds 25 is $500. (6) The fee payable for a list of active licence plates and corresponding registration information is $20 per search to a maximum of 10 vehicles. (7) The fee payable for a search of 10 or more driver’s licences or vehicle registrations made by a collection agency or financial institution is $500, subject to a maximum of 500 records on any one computer disk or tape. (8) The fee payable for historical vehicle registration information is $50 for each personal identification code to which the vehicle is assigned. IRP fees 36(1) The fee payable for: (a) each registration and issue of an IRP cab card pursuant to the IRP is $35; (b) each replacement IRP cab card is $15; (c) each change of vehicle information that results in a change in the registration fee payable is $35; (d) each change of vehicle information that does not result in a change in the registration fee payable is $15; (e) each addition to a fleet on any one occasion is $35; (f) each replacement of a vehicle in a fleet is $35; and (g) each replacement plate is $15. (2) The following provisions apply to any fees payable pursuant to the IRP: (a) fees owing will be based on the currency of the jurisdiction to which the fees are due and owing; (b) the fees must be paid to the administrator in Canadian funds; and (c) the conversion rate used to determine the amount of Canadian funds due and owing is to be the daily exchange rate determined by the administrator’s financial institution. 14 Dec 2018 SR 86/2018 s4. (2) A person in default is indebted to the administrator for the amount in arrears, any administrative fees associated with a dishonoured payment and any interest chargeable pursuant to subsection (3), and the administrator may recover the arrears, administrative fees and any interest against the person in default. (3) If the amount owing by the person in default is not paid on or by the date set out in the statement of account or collection letter issued by the administrator, the person in default is liable for the amount owing and shall pay interest equal to 1.5% per month on the amount owing. (4) The administrator may waive the interest mentioned in subsection (3) if the administrator considers it appropriate.
